CROIX COUNTY, WISCONSIN The Application of: DECISION James McGraw/Dale Blecklin File No. 36-92 A hearing was held in the above referenced matter on June 25, 1992 before the St. Croix County Board of Adjustment, Chairperson John Bradley and members, Jerome Neuman, Robert Stephens, Bernard Kinney, and George Menter. The applicant, James McGraw/Dale Blecklin, whose address is 2516 Hwy. 12, Woodville, WI 54028, requests a special exception permit pursuant to section 15.03(3), St. Croix County zoning ordinance for the following described parcel of land, which applicant owns located in the SW 1/4 of the SW 1/4 if Section 26, T29N-R16W, Town of Baldwin, St. Croix Co. Wisconsin. The applicant proposes to place demolition material from the Baldwin school in an abandoned gravel pit. The demolition fill and pit will then be reclaimed. FINDINGS OF FACT (1.) The proposed site is presently an abandoned borrow pit. Demolition will be less than 10,000 cubic yards; (2.) The site meets the location and performance standards of NR502.04, WI Adm. Code; (3.) The DNR supports the proposal; (4.) The ,township supports the proposal; (5.) The request is for a one time disposal operation; (6.) A compacted two foot soil cap with a six inch layer of topsoil is the proposed final cover. CONCLUSIONS OF LAW The Board of Adjustment has the authority to grant special exceptions for demolition sites. r r DECISION Based on the finding of fact and conclusions of law, the application of James McGraw/Dale Blecklin special exception use permit is granted subject to compliance with the provisions of Section NR502.12, WI Adm. Code and the following conditions; 1. The site shall be operated in a nuisance free manner; 2. The Zoning Office'will be contacted when project is completed. If the proposal is not commenced within that time, a new application must be submitted and approved before proceeding with the proposal. If the proposal is not completed within that time, an extension of the decision must be obtained. This decision may be revoked by the Board, after notice and hearing, if any condition of the decision is violated. This decision may be appealed by any person aggrieved by the decision by filing with the St. Croix County Circuit Court an action for certiorari within 30 days of the date of filing this decision.
