CROIX COUNTY, WISCONSIN Case: 28-99 Complete Application Received: June 24, 1999 Hearing Notice Publication: Weeks of July 5 and 12, 1999 Hearing Date: July 22, 1999 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicants are Thomas and Kathleen Sandvig, whose address is 2305 Rose Lane, Woodville, Wisconsin 54028 2. The applicant on June 24, 1999 filed with the Zoning Office an application for a variance to remodel and expand a non-conforming structure. 3. The applicant is requesting a variance to the 133-foot setback requirements on a Class D Highway. 4. Locating the structure in a different area on the property cannot be done. The structure has been on the property for approximately 110 years. Most of the work will be done inside the home, as there are problems with the wiring, and a new roof is needed as the old one is collapsing. The addition to the home will be located on the back of the structure and will not be closer to the road. 5. The Board finds that there is a hardship present that is due to physical limitations of the property rather than the circumstances of the applicant. 6. The Board may grant variances in cases where a hardship is present. 7. The Board finds that granting of the variance will not be contrary to the public interest as expressed by the objectives of the ordinance. DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approves the applicant's request for a variance on the following findings: 1. The Town of Baldwin has approved the application. 2. The applicant has asked for a 41-foot variance from the road right-of-way. The road that the home is located on is a rural road with very minimal traffic. 3. The owners have lived in the structure for 15 years and the safety of the homeowner is now in question. The home needs extensive repair to the roof so it will be safe and will preserve the health and safety of the present owners. r 4. There are limitations for relocation on the property. To relocate the home on the property meeting the setbacks would cause the owner to relocate on land that is being used for agriculture. Also, there would be outbuildings that would need to be torn down to accommodate space for the home. 5. The Board believes by granting this variance, that substantial justice has been done. With the following conditions: 1. Variance is to allow the applicant to remodel and repair an existing non-conforming structure. The addition to the home will be no larger than 10-foot by 13-foot . 2. The remodeling of the project will be limited to the plans presented to the Board. 3. This variance is valid for a period of one year from the date of issuance; failure to complete construction of the project in this time period shall result in revocation of the variance. Golz No Chairperson Speer Yes APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings, which resulted in this decision, was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the responsibility of the Board of Adjustment to submit its record (file) of this matter to the circuit court.
