CROIX COUNTY, WISCONSIN Case: 47-98 Complete Application Received: September 24, 1998 Hearing Notice Publication: Weeks of October 5 and 12, 1998 Hearing Date: October 22, 1998 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicants are David and Lori Maddock, whose address is 69 Winnipeg Avenue, St. Paul, Minnesota 55117. 2. The applicants on September 24, 1998, filed with the Zoning Office an application for a special exception request for a temporary occupancy permit. 3. David and Lori Maddock are the owners of the property which is the subject of the application and located in the NE 1/4 of the NE 1/4 of Section 10, T31 N, RI 6W, Town of Cylon, St. Croix County, Wisconsin. 4. The subject property is currently a vacant lot. 5. Special Exception request is a Temporary Occupancy permit under Section 17.70(3)(c)(3). A special exception is required where there is any temporary occupancy permit. 6. The following exhibits were presented: Exhibit 1: Special exception application Exhibit 2: Letter from the Town of Cylon recommending approval of the application Exhibit 3: Copy of sanitary permit and inspection report with a copy of the site plan Exhibit 4: Copy of the site plan showing both structures and the septic system Exhibit 5: Copy of the floor plan for the existing structure (garage) Exhibit 6: Staff report 7. David Maddock, being duly sworn, stated that he is the owner of the property and bought the property in 1995. He is asking for this permit to live in a garage on the property while they are building their house. He plans to finish off the garage so that it may be lived in. 8. The septic system will be connected to the garage and the applicants will be allowed to keep the bathroom in the garage after the new structure is built. The ordinance allows for a bathroom in an accessory structure such as this. 9. The Maddocks will return the garage back to the garage state after the new structure is built, and will render the garage uninhabitable. 10. The septic system has state approved plans. 11. Construction of the new home will begin in the spring of 1999 and will be completed in approximately one year. 12. The Town of Cylon recommends approval of this application. 13. Under Section 17.70(3)(c)(3) an application may be made for a special exception for temporary occupancy. 14. The Board of Adjustment finds that this special exception application conforms with the requirements for granting a special exception under 17.65(1)(b) and 17.65(3)(c). DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's request for a special exception for a temporary occupancy permit and has been approved on the following vote: R. Wert Yes Chairperson Speer Yes with the following conditions: 1) Temporary residence must meet all state and local building codes and all appropriate permits must be obtained. 2) There will be a restriction placed on the deed stating that the garage will be rendered uninhabitable when the new structure is completed. 3) The permit is good for 12 months from the date decision is filed. 2 APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings which resulted in this decision was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the responsibility of the Board of Adjustment to submit its record (file) of this matter to the circuit court.
