CROIX COUNTY, WISCONSIN Case: 3-94 Complete Application Received: 2/8/94 Hearing Date: 3/24/94 Dates of Publication: 3/7/94 and 3/14/94 Reheard: 4/28/94 FINDINGS OF FACT Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicant is Sheriff Ralph Bader/St. Croix County Sheriff's Department whose address is St. Croix County Government Center, 1101 Carmichael Road, Hudson, Wisconsin 54016. I 2. The applicant on February 8, 1994 filed with the Zoning Office an application for a special exception use permit for a firearm training facility. This is an after-the-fact permit request. 3. The State of Wisconsin, Department of Natural Resources, is the owner of the following described property which is the subject of the application which is located in the W; of the NW-, of Section 15, T31N-R16W, Town of Cylon, St. Croix County, Wisconsin. 4. The subject property is presently used as vacant land. 5. The property is zoned conservancy under the current Zoning Code of the St. Croix County Zoning Ordinance. 7. The Town of Cylon supports the application. 8. Sheriff Bader indicated that in April of 1993 the Sheriff's Department obtained a side contract with the DNR for the use of this property as a firearm training facility. 9. The location of this firearm training facility would be at the end of a dead end road, that being 230th Street, Town of Cylon. 10. A 10 foot berm was built for shooting. The Sheriff's Department would be hauling in the targets and taking them back out again after the shoot. They would clean up the shells, cigarette packages, etc. after each shoot. 17 11. It was stated by Sheriff Bader that the Sheriff's Department has control of the site only on certain days which they have contracted with the DNR. 12. Bader stated that the Sheriff's Department would have approximately 6 to 8 shoots a year and they would comply with the request from the Town of Cylon in reporting to them after each shoot. The shooting hours would be varied and they will be having only 1 night shot a year. 13. Safety of the people shooting and the surrounding neighbors is of utmost importance to the Sheriff's Department. Sheriff Bader stated they always announce over their PA system that they will be shooting so that if anybody is there that they will know who is shooting. 14. It was noted by Sheriff Bader that the shoots will be done around the various hunting seasons. SPECIAL EXCEPTION The application for a special exception permit meets the requirements of §17.15(m) of the Zoning Code as follows: Firearm training facilities are special exception uses. CONCLUSIONS OF LAW Based upon the above Findings of Fact, the Board concludes that: 1. The County and the Board of Adjustment has authority under Section 17.70(c)4 of the Zoning Code to approve a permit. 2. Special Exception Use Permits may be terminated as per 17.70(7)(d) of the St. Croix County Zoning Ordinance if the plan or the conditions of the permit are not followed. ORDER AND DETERMINATION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board made a motion to conditionally approved the application and voted as follows: Chairman Bradley YES T. Filipiak YES J. Neuman YES T. Dorsey YES. The motion carried and the application is herein approved with the following conditions: 1. This permit expires on April 28, 1995. No shooting may continue after this date unless a new permit or permit extension is granted in writing by the Zoning Office. 2. You must allow free and unlimited access to your project site at any time to any Zoning office employee who is investigating the project's operation or maintenance. 3. The Zoning Office may change or revoke this permit if the project becomes detrimental to the public interest. 4. Your accepting this permit and beginning the project means that you have read, understand, and agree to follow all conditions of this permit. 5. You must keep a copy of this permit at the project site at all times that you are present until said application expires. 6. There shall be ongoing surveillance of the area to make sure there is no unauthorized shooting on the property. 7. The township shall be contacted prior to and after each shoot. 8. The Sheriff's Department shall provide the township information regarding how long they shot and how many rounds they shot. 9. There is to be a certified instructor on the premises at all times during the shoot. 10. Gun safety should be of utmost concern. 11. The site shall be cleaned up after each shoot, removing all spent cartridges, targets and other miscellaneous debris associated with the shoot. APPEAL RIGHTS This decision may be appealed by any person aggrieved by filing an action in certiorari in the circuit court of this County within 30 days after the date of filing shown above. The County assumes no liability for and makes no warranty as to the legality of any construction commenced prior to the expiration of this 30-day period. Wisconsin. The applicant proposes to:-use _ this area for occasional training facility. About six to eight times per year the Sheriff's Department will be using the site for outdoor firearms training Safety of this type of training was the first criteria looked at. The site is remote and an earthen back-stop has been erected. There will be no buildings. All equipment used will be brought to the site and removed the same day as the training The Countv does not infer this to be a public use area other than the current DNR use.
