BOARD OF ADJUSTMENT MEETING AND HEARING IyQ~

March 24, 1992
The meeting was called to order by Chairman Kinney at 9:00 A.M.
Chairman Kinney explained the procedures of the hearing
requesting that individuals wishing to testify sign their names
and addresses in the front of the room.
Supervisors Bradley, Kinney, Menter, Sinclear, and Stephens were
all in attendance. Staff included Zoning Administrator and
Corporation Counsel Greg Timmerman.
Stephens made a motion to approve the agenda. Seconded by
Bradley. Motion carried.
OLD BUSINESS
LAWRENCE HORTSCH & DARYL ZIMMER
Lawrence Horsch and Steve Hanks presented the proposal for two
lifts in the Riverway District. There is a management policy to
review the proposals allowing 1 lift per 3 lot owners.
Discussion. Neighbors and township support the proposals.
Easements need to be described and recorded for other landowners.
Stephens made a motion, seconded by Bradley to approve the tow
applications with the condition easement agreements be written.
Motion carried.
JON-DE FARM
Nelson explained that there was additional information being
provided for the requested special exception to exceed 250 animal
units or the farm.
Bob Heise, Land Conservation Department, presented the animal
waste plan for the proposal. Discussion.
Wayne Loocke, town chairman of Rush River, expressed concerns
over the number of animals and water quality.
Gene Nelson, Eric MacBeth, Molly Monican, Dick Dahlke, Deb
Rasmussen, and Dane Rasmussen all expressed the same concerns for
water.quality. Discussion.

The hearing was called to order at 10:00 A.M. Nelson read the
notice of thelhearing as published:
The St. Croix County Board of Adjustment has scheduled a public

hearing for Tuesday, March 24, 1992 at 9:30 A.M. in the County
Board Room of the St. Croix County Courthouse, Hudson, WI to
consider the following appeals to the St. Croix County Zoning
Ordinance. An onsite investigation will be made of each site in
question, after which the board contemplates adjournment into
closed session for the purpose of deliberating on the appeals,
pursuant to Sec. 19.85(1)(a), Wisconsin Statutes, and will
reconvene into open session for the purpose of voting on the
appeals.

Ken presented a plan to continue the operation of the gravel
operation in Troy township. there is from 2 - 10 years of
material remaining depending on the demand.
The township of Troy supports the proposal.

DENNIS ULLOM
Nelson explained that this was a request for a contractor storage
yard and firewood processing facility.
Dennis Ullom provided a site plan and facility concept.
Discussion.
The township of Warren supports the proposal.
JOHN PFLEIDER
John presented a request to reinstate his permit for the garage
and retaining wall that was revoked by the Board of Adjustment in
December of 1991.
A letter was read from Dan Koich of the DNR expressing concerns
of the structure having been placed on slopes exceeding 12%.
Jim Rusch, county surveyor, testified that in his opinion, the
garage has been placed on slopes exceeding 12%.
various exhibits were presented and general discussion was heard
regarding these issues.
SANDRA POMASL
A request was presented to place a garage 36' from the centerline
of a town road. The structure would be no closer than the
existing residence.
The township of Springfield supports the proposal.
HENRY NECHVILLE
Henry presented a request for a nonmetallic mining operation and
a berm in the existing gravel pit that is in the f lood plain of
the Kinnickinnic river.
The berm would be installed to divert water out of the pit during
flood periods.
There is less than 8 acres that can be moved and he would like to
place a concrete crushing facility in the NE portion of the
graved pit. Discussion on the facility plan.
The township of Warren support the proposal with conditions.
WILLIAM MACDONALD
Bill is requesting an off premise sign at the location of the SE
1/4 of the SE 1/4 of Sec. 18, Township of Cylon. This sign would
be directional in purpose for his auto salvage facility.
The township supports the proposal.
MATHY CONSTRUCTION
Perry AderhoAz presented a facility plan for a requested hot mix
plant to be used for thd'STH 35 project. This operation would be
located in the Rohl pit permitted before. This is permitted by

special exception for up to a 120 day period for government
roads.
The township supports the proposal provided it be limited to
Sept. 1 through Oct. 15, 1992.
Gary Senn and Gerald Cedarhouse expressed concerns on the
existing rock quarry not living up to the original proposal.
Also discussed were hours of operation.
