BOARD OF ADJUSTMENT DECISION Request of James Mugg for a ) special exception use, Article ) 8.4 F 1(b), Driveway Separation, ) A-22-83 ST. CROIX COUNTY ZONING ORDINANCE. ) August 23, 2983 Location: SW-11 of SW14, Section 20, ) T31N-R16W, Township of Cylon. ) The St. Croix County Board of Adjustment conducted a public hearing on August 23, 1983 to consider the request of James Mugg for a special exception use, Article 8.4 F 1.(b), Driveway Separation, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Executive Session to discuss the request. After returning to open session, the following decision was rendered. Motion by Supervisor George to grant approval of the request to construct a road that would be approximately 250 feet from an adjoining driveway. Seconded by Supervisor Stephens. Motion carried. Meeting called to order by Chairman Meinke at 10:00 a.m. in the County Board Room, Courthouse, Hudson, Wisconsin. All members present. Minutes of the June meeting and hearing approved as written. Hearing called to order by Chairman Meinke. Zoning Administrator Harold Barber read notice of hearing as published in the county and local newspapers. 1. ARTICLE: 8.4 B 4(b), Highway Setback APPELLANT: William Pearson LOCATION: NEI,, of NE4, Section 4 T28N-R19W, Town of Troy 2. ARTICLE: 8.4 F 1.(b), Driveway Separation APPELLANT: James Mugg LOCATION: SW4 of SW4, Section 20 T31N-R16W, Town of Cylon 3. ARTICLE: 8.4 B 4(b), Highway Setback APPELLANT: John MacLeod LOCATION: SE4 of NE4, Section 4 T28N-R19W, Town of Troy Mr William Pearson presented his request to construct an earth sheltered home that would be 100 feet from the centerline of a town road at the High Ridge Court Subdivision. Questions by members of the Board. Chairman Meinke informed those present that the Board will inspect all properties in question after the hearings. Mr. James Rusch presented the request of James Mugg to construct a road that would be approximately 250 feet from an adjoining driveway. Adjoining landowner Robert Kaczmarski has no objections. Town Board has no objections to the driveway separations. Questions by Board members. Mr. John MacLeod presented his request to construct a house that would be 83 feet from the centerline of a town road. Mr. MacLeod explained that by setting back 133 feet would put the house in a drainage way. Mrs. John Sawyer, adjoining land owner, objected to the setback and questioned the side- yard setback. Doug Cudd, Builder, is in favor of the setback as the house plans fit the site., He feels that this is the only site on the property. Hearing recessed for inspection of the properties involved. Board went into executive session to discuss the requests. Board returned to open session to render the following decisions. 1. William Pearson: Motion made by Supervisor Stephens to grant approval of a 100 foot setback from a town road. Seconded by Supervisor George. Motion carried. Vote to approve: George, yes; Meinke, yes; $tephens, yes. 2. James Mugg: Motion by Supervisor George to grant approval of the request to construct a road that would be approximately 250 feet from an ad- joining driveway. Seconded by Supervisor Stephens. Motion carried. Vote to approve: Stephens, yes; George, yes; Meinke, yes. 3. John MacLeod: Motion by Supervisor George to grant approval to construct a house that would be 83 feet from a town road. Seconded by Supervisor Stephens. Motion carried. Vote to approve: Stephens, yes; George, yes; Meinke, yes. The next scheduled hearing date is September 27, 1983 at 10:00 a.m. Motion, by Supervisor George to adjourn. Seconded by Supervisor Stephens. Motion carried.
