FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and conducted an on-site
inspection, the Board finds the following facts:
1. The applicant is Kevin Derrick, whose address is 1387 Bilmar Avenue, New Richmond,
Wisconsin 54017.
2. The applicant on March 26, 1998, filed with the Zoning Office an application for a special
exception to construct a driveway and home in the shoreland district.
3. Bruce and Bobbie Warner are the owners of the property which is the subject of the
application and is located in the NE 1/4 of the SE 1/4 of Se9tion 23, T31 N-R1 6W, Town
of Cylon, St. Croix County, Wisconsin.
4. The subject property is currently in CRP.
5. The following exhibits were introduced:

Exhibit 5: Letter from the Department of Natural Resources - read into the record

6. Kevin Derrick, being duly swom, stated that he is the owner of the property. He wants
to build a home and will need to do some grading and filling to be able to put in the
driveway and construct the home.
7. The home will not be in the floodplain. It is approximately 80 feet from the Willow River.
The parcel is 80 acres, but a big share of that is in CRP and the location selected for the
home is the best location to build.
8. Jim Thompson, of the Zoning Office, has reviewed this site and zoning recommends
approval of this application.
9. The DNR does not have jurisdiction as the grading will consist of less than 10,000 feet.

10. Under Section 17.29(2xc)3 of the St. Croix County Shoreland Zoning Ordinance an
application may be made for a special exception for filling and grading.
11. The Board of Adjustment finds that this special exception application conforms with the
requirements for granting a special exception under Section 17.29(2xc)3.
12. Special exception uses may be terminated as per 17.70 (7) (d) of the St. Croix County
Zoning Ordinance if the plan or the conditions of the decision are not followed.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the
Board approves the applicant's request for a special exception for filling and grading in a
shoreland district and has been approved on the following vote:

J. Neumann Yes
Chairman Bradley Yes
with the following conditions:
1) Any tree cutting will be done according to the shoreland ordinance
2) Erosion control shall be implemented according to plan
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within
30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin Statutes. St.
Croix County assumes no responsibility for action taken in reliance on this decision prior to the
expiration of the appeal period. St. Croix County does not certify that the identity of all persons
legally entitled to notice of the Board of Adjustment proceedings which resulted in this decision
was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her
expense a transcript of the Board of Adjustment proceedings to the circuit court, which is
available from Northwestern Court Reporters, Hudson, Wisconsin. It is the responsibility of the
Board of Adjustment to submit its record (file) of this matter to the circuit court.
