CROIX COUNTY, WISCONSIN The Application of: DECISION Dr. Donald J. & Beth Ann Arvold File No. 83-92 A hearing was held in the above referenced matter on Jan. 28, 1993 before the St. Croix County Board of Adjustment, Chairperson John Bradley and members, Jerome Neuman, Robert Stephens, Bernard Kinney, and George Menter. The applicant, Dr. Donald & Beth Ann Arvold, whose address is 1696 250th St., Emerald, WI 54012 requests a variance permit pursuant to section 17.64(1)(b) of the St. Croix County Zoning ordinance for the following described parcel of land, which 'cant owns located in the SW 1/4 of the SE 1/4 of Section 29, 29N- 16W, Town of Cylon, St. Croix County, Wisconsin. ~I The applicant proposes to add a two by four (2x4) foot extension on the front entrance of the building. This addition would be two (2) feet closer than the existing building which is seventy-three (73) feet from the right-of-way of STH 64. The undue hardship applicant claims as a basis for the variance is there is a need to provide safer access for patients of the chiropractor office which is located in the basement of the building. i FINDINGS OF FACT 1) A site plan was submitted showing the location of the building and addition. 2) The proposed construction would provide safer access to the basement level while also providing separate entrance to the main floor. 3) The township of Cylon supports the proposal. CONCLUSIONS OF LAW The Board of Adjustment has the authority to grant variance permits as per 17.70(5)(c)3 when hardships can be demonstrated. DECISION Based on the finding of fact and conclusions of law, the application of Dr. Donald & Beth Ann Arvold for a variance permit has been granted. If the proposal is not commenced within that time, a new application must be submitted and approved before proceeding with the proposal. If the proposal is not completed within that time, an extension of the decision must be obtained. This decision may be revoked by the Board, after notice and hearing, if any condition of the decision is violated. This decision may be appealed by any person aggrieved by the decision by filing with the St. Croix County Circuit Court an action for certiorari within 30 days of the date of filing this decision. Applicant assumes all risk of relying on this decision within the 30 day appeal period. As we discussed over the phone last week, depending on what your property is zoned, you will need Rycling a special exception permit for your helicopter pad as either a use in the Commercial District 5-386-4675 pursuant to Section 17.18(1)(a), or as a private airstrip in any of the Ag districts pursuant to Section 17.14(6)(g) of the St. Croix County Zoning Ordinance. As part of the special exception review and approval process, you may be required to bring your chiropractor business into compliance with the Ordinance.
