Adkinson 600S.2 Id Street, #406 Minneapolis, MN 55401 Re: Land Use Permit for Rip Rap Shoreline Protection in the Lower St. Croix Riverway District Code Administra 179 Glenmont Road, Parcel #26.28.20.638E, Town of Troy 715-386-4680 Dear Ms. Adkinson: Land Information Planning This letter confirms zoning approval according to plans submitted by Environmental 715-386-4674 Landscape Management, Inc. on April 23, 2012 for the following activities that require a land use permit: Real Prope 715-3 677 To stabilize an existing seawall and eroding shoreline with rip rap in the R ding Lower St. Croix Riverway District in the Town of Troy pursuant to e Section 7386-4675 17.36 F.2.a.5) and 17.36.H.6 of the St. Croix County Zoning Ordinance. According to the plans you submitted, proposed work consists of installing native ri limestone rip rap over filter fabric along -150 linear feet of the St. Croix River shore at or above the Ordinary High Water Mark (OHWM).of 680' MSL. Existing vegetation will } be protected during placement of the limestone. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of -2 acres, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The existing retaining walls are made of timbers and have been eroded during periods of high water; 3. Rock rip rap and other Shoreland protection measures are allowed with a land use permit if the project meets standards in Section 17.36 H.6 of the Ordinance; 4. The proposed rip rap will stabilize an area subject to erosion and will prevent loss of vegetation or undermining of the slope preservation area; 5. The Wisconsin Department of Natural Resources has been sent a copy of the plans for review. If the rip rap is placed above the 680' OHWM, no chapter 30 permit is needed. 6. The St. Croix County Land and Water Conservation Department has reviewed the plans and has no comments on this project. If installed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This approval is for the placement of rip rap shoreline protection, as indidated in the plans submitted, and as provided in the conditions below: 1. The applicants shall contact the Zoning Administrator prior to commencing installation and when the rip rap protection has been completed. 2. If existing vegetation is disturbed or removed, it will be replaced with native species appropriate for use as supplemental slope stabilization. The shoreline/beach will be restored to existing conditions upon project completion. 3. The rip rap will consist of natural limestone or other similar materials that will be inconspicuous as seen from the river. 4. Within 30 days of substantially completing the installation of the proposed shoreline protection, the applicant shall submit to the Zoning Administrator photos of the completed project. 5. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 6. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of the Zoning Administrator. Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your respo'ns'ibility to ensure compliance with any other local, state, or federal rules or regulations, including but not limited to obtaining a town Riverway permit. On 04/11/2012, Doug Meyers with Environmental Landscape Management sent additional photos indicating that all the riprap will be placed above the ordinary high water mark, and any grading will be under 10,000 square feet. Therefore, the Department does not have Ch. 30 jurisdiction and a riprap permit is not required. If at any time rock will be placed below the ordinary high water mark a permit would be required. It is the intention to install (local) St Croix limestone rip rap over filter cloth to secure the shoreline during spring flooding events. The materials will be placed along the shoreline at a height of approximately 4 feet. As you can see from the attached plan/drawing, all materials will be placed above the OHNV_M of 680 feet. All existing plant material will be protected during placement of the rip rap and will not be disturbed. Any and all areas of the shoreline/beach that are disturbed during construction will be stored to pre-existing condition. The are no proposed alterations of vegetation and topography. Any vegetation that is destroyed will be replaced with similar native species. Plant replacement must be available, locally grown and of a reasonable size sold in a plant nursery. The limestone rip rap will be sized in the 6" to 18" range and of irregular shape. All stone will be supplied by local quarries. The underlayment fabric will offer permanent erosion control. The product specified is Pyramat High Performance TRIM or a product that has equal stabilization quality and is approved for this application.
