The Responsible Party shall be responsible for the routine and extraordinary maintenance of the storm water management device(s) in accordance with the operation and maintenance agreement on file at the St. Croix County Planning and Zoning Department. The infiltration devices must assimilate stormwater runoff from all impervious surfaces on the property. - 2. The County, or its designee, is authorized to access the property as necessary to conduct inspections of the storm water management device(s) to ascertain compliance with the intent of the storm water management plan and the practices and procedures prescribed in the operation and maintenance agreement. 3. Upon notification to the Responsible Party by the County of maintenance problems that require correction, the specified corrective actions shall be performed by the Responsible Party within a reasonable time frame as set by the County. 4. The County is authorized to perform the corrective actions identified in its inspection report or its notice if the Responsible Party does not make the required corrections within the specified time period. The costs and expenses of such corrective actions shall be the responsibility of the Responsible Party. 5. The terms and conditions contained in this Affidavit shall run with the Property and be binding upon the successors and assigns of the parties to this Affidavit. Hudson, WI 54016 Re: Addendum Land Use Permit for construction of a conforming accessory structure in the Lower St. Croix Riverway District Code Administration Parcel #35.30.20.609H, 175 Riverview Acres Rd. 715-386-4680 Computer #030-2067-20-000 in Town of St. Joseph Land Information Dear Mr. Nicholson and Ms. O'Flanigan: Planning 715-386-4674 This letter confirms zoning approval according to plans submitted on January 3, 2012 as an addendum to other zoning requests for the following activities that require a land Real Property use permit: 715-396-4077 Recycling To construct a conforming accessory structure with <10,000 sq. ft. filling and 715-386-4675 grading in the Lower St. Croix Riverway District in the Town of St. Joseph pursuant to Section 17.36.F.2.a.1) and 17.36.F.2.a.2) of the St. Croix County Zoning Ordinance and standards pursuant to Section 17.36.1-1.1. According to the site plan and narrative, the proposed project consists of construction of a 26' x 30' accessory structure outside the 40-foot bluffline setback with associated grading that will involve a total of -800 sq. ft. of land disturbance. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 1.52 acre lot located at 175 Riverview Acres Rd., is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The proposed accessory structure is more than 200 feet from the OHWM of the St. Croix River, greater than 25' from any property line, and is greater than 40 feet from the biuffline pursuant to requirements in Section 17.36.G.5.c.a); 3. The proposed building construction will result in -800 sq. ft. of land disturbance that will not affect slope preservation zones or encroach into the bluffline setback; 4. The proposed garage will be approximately 18 ft. in height according to construction drawings submitted by the applicant, which will not exceed the maximum height of 20 feet in compliance with Section 17.12.(5). With conditions that the structure does not protrude above the bluffline as viewed from near mid- river, that windows and building materials on the structure utilize earth-tone colors and non-reflective surfaces, this project will meet standards in Sections17.36 G.5.c.2)a) and 17.36 H.1 with regard to being visually inconspicuous; ST. Steve Olson, Land & Water Conservation Dept., reviewed the application and the stormwater management plan. The applicant proposes to install a 3 ft. wide, 8 inch deep rock infiltration trench around the perimeter of the garage, which will have the capacity to assimilate 101 cubic feet of runoff, In compliance with conditions contained in the Board of Adjustment's Decision filed March 2, 2012, additional stormwater management will be required for all impervious surfaces (roof, deck, etc.) on this property per mitigation requirements in Section 17.36.1.5. The applicant must work with the Zoning Administrator to select appropriate methods to infiltrate the additional volume of runoff (rain gardens, pervious pavers, infiltration trenches, etc.). Installation of infiltration device(s) must provide stormwater control consistent with requirements in Section 17.36 H.7.; 7. Mike We~nholz of the Wisconsin Department of Natural Resources has reviewed the application and stateat the department had no comments regarding issuance of the permit; 8. The applicant's agent proposes use of sediment logs for erosion and sediment control, which will be installed to control runoff from the construction area and contain it on the applicant's property; 9. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This land use permit approval is for the construction of a conforming accessory structure with <10,000 sq. ft. of land disturbance, as indicated in the plans submitted, and as provided in the conditions below: 1 The applicants or their contractor shall contact the Zoning Administrator prior to commencing 0A~0 construction and install erosion and sediment control measures indicated in the approved plans. ~\5\✓2. Prior to commencing construction, the applicants and/or their general contractor shall obtain any ~6 other permits required, including but not limited to a building permit from the Town of St. Joseph; ✓3. Prior to construction, an amended stormwater management plan must be submitted to the Zoning Administrator for review and approval to direct runoff from all impervious surfaces into infiltration device(s) that will provide a minimum capacity to assimilate 1.5 inches of rainfall. The applicant shall record an affidavit on the deed to the property to provide for long-term operation and maintenance of the infiltration devices as required in Section 17.36.H.7.g. 4. All areas of disturbed soil must be stabilized with temporary cover to prevent erosion until permanent vegetation consisting of native species can be established per 17.36.H.7.e.4 and 17.36.H.8. 5. The finished accessory structure shall not exceed the maximum roof height allowed in Sections 17.13(3) and 17.36.G.4. The structure may not be used as a second dwelling unit in compliance with Section 17.13(1)(e). 6. All siding, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature, with windows that are not more reflective than ordinary window glass, so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.30-C-65.c.2~a)..and-1 6.1.1 of the Ordinance.. Within 30 days of substantially completing the proposed building construction, the applicant shall submit to the Zoning Administrator certification from the contractor that the construction has been dpne in compliance with the approved plans. Copies of the recorded stormwater management aNdavit and photos of the completed project must be submitted to the Zoning Administrator to document compliance with permit conditions. 8. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 9. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Sectio 17.36 J.8.b of the Ordinance. This a proval does not allow for any additional construction, grading, filling, or clearing of vege ion beyond the limits of this request. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of the Zoning Administrator. W l.U S EIVE® 2012 To: Pam Quinn, Steve Olson, UVuNiY LZO NMG OFFtCE E Subject: Stormwater Infiltration, 175 Riverview Acres Road Needed infiltration for the garage is 97.5 cubic feet of stormwater generated from the impervious nature of the new garage. My plans to infiltrate are: 3 feet of washed rock, 8 inches deep along the 86 feet of the garage perimeter. 3 feet by 86 feet by 8 inches of rock equals 170 cubic feet times 30% of void space is 51 cubic feet of storage. The existing soils are a sandy loam and using a conservative infiltration rate of 2 inches per hour and the (172 square feet x 0.16 feet) 27.5 cubic feet of infiltration per hour over a peak discharge of 2 hours from a typical storm event this would provide (27.5 cubic feet x 2 hours) 55 cubic feet of storm water infiltration. This 55 feet of storm water infiltration and the 51 feet cubic feet of storage together equals 101 cubic feet, and is more than the required, 97.5 cubic feet needed to infiltrate the stormwater generated from the garage. Erosion control will be provide by installing sediment logs on the down gradient slope of the construction site. Sincerely Bob Nicholson.
