Land Information
Planning This letter confirms zoning approval according to plans submitted on May 17, 2011 for
715-386-4674 the following activities that require a land use permit:

Re clrng pursuant to Section 17.36. F.2.a.1) and 17.36.F.2.a.2) of the St Croix County
15-386-4675 Zoning Ordinance and standards pursuant to Section 17.36.1-1.1.
According to the site plan and narrative, the proposed project consists of construction of
a 30'x 75' accessory structure outside the 40-foot bluffline setback with associated
grading that will involve a total of approximately 4,750 sq. ft. of land disturbance. A

convenience lavatory will be eventually added within the structure, which will need to be
connected to a Private On-site Wastewater Treatment System (POWTS). A sanitary
permit application must be submitted for staff review and approval for the POWTS and
ruiT
for a private interceptor main that will be needed to connect a building sewer line from
the accessory structure to the POWTS.
Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and
the Lower St. Croix Riverway District based on the following findings:
1. The property consists of a 5.56 acre lot located at 288 Brugler Ct., Lot 4 of CSM
20/5017, is zoned Ag/Residential, and is located in the Rural Residential
Management Zone of the Lower St. Croix Riverway District;
W, 2. The proposed accessory structure is more than 200 feet from the OHWM of the St.
=y Croix River, greater than 25' from any property line, and is greater than 40 feet
from the bluffline pursuant to requirements in Section 17,36.G.5.c.a);
3. The proposed building construction will result in approximately 4,750 sq. ft. of land
disturbance that will not affect slope preservation zones or encroach into the
bluffline setback, and per building specifications submitted by the applicant's
agent, the roof will not exceed the maximum height of 35 feet;
4. The proposed structure will be approximately 23' in height according to Morton
Buildings construction drawings. With conditions that the structure does not

structure is visually inconspicuous, this project will meet standards in Sections17.36 G.5.c.2)a) and
.36 H.1 with regard to being visually inconspicuous;

6. Steyr on, Land & Water Conservation Dept., reviewed the application, visited the site, and
co ed that the project consists of an accessory structure greater than 100 square feet
them a the LWCD recommends the applicant provide a stormwater management and erosion and
sediment control plan consistent with 17.36 H.7.;
7. Mike Itenholz of the Wisconsin Department of Natural Resources has reviewed the application and
commented that the permit must specifically include not only the performance standards of 17.36.1-1,
but alstandards of 17.36.G.5.c.2)a), which applies in this case since the proposed structure will be
within 100 feet of the bluffline setback. Applicants must provide assurance that the building will meet
-visual inconspicuous requirements in 17.36.G.5.c.2)a)i and iv. Infiltration of stormwater and
erosion control measures will be addressed in comments from Land & Water Conservation Dept.;
8. A site plan prepared by the applicants' engineer indicates the location for silt fence (or equivalent
sediment control measure) between the construction area and slopes that drain toward the river,
9. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway
District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor
ill it negatively affect the public health, safety and welfare of County residents.

ft. of land„ isturbance, as indicated in the plans submitted, and as provided in the conditions below:

and install erosion and sediment control measures indicated in the approved plans.
2. r to commencing construction, the applicants and/or their general contractor shall obtain any
permits required, including but not limited to a building permit from the Town of Troy;
3. During construction the applicant and their agent(s) shall comply with all inspection requirements for
the XMilding construction and plumbing in preparation for connection of a private interceptor main to
the ROWTS. An affidavit shall be recorded on the deed to the property at the time a sanitary permit
is issued to disclose that two structures are serviced by a single POWTS.

vvifith Section 17.13(1)(e).
7. Aging, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth

17.36 G' 5.c.2)a) and 17.36 H.1 of the Ordinance.
8. Wth1~~0 days of substantially completing the proposed building construction, the applicant shall
submit b the Zoning Administrator certification from the contractor that the construction has been
done incompliance with the approved plans. Copies of the recorded stormwater management and
POWTG- affidavits and photos of the completed project must be submitted to the Zoning
Adminis rator to document compliance with permit conditions.
9. All ctivities approved as part of this land use permit shall commence within one year from the date
opproval and be substantially completed withiin two years, after which time the permit expires
pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request
extensions of up to six months from the Zoning Administrator. The total time granted for extensions
shall not exceed one year.
10. Failure to comply with the conditions above may result in the revocation of this permit pursuant to
Section 17.36 J.8.b of the Ordinance.
Th i proval does not allow for any additional construction, grading, filling, or clearing of
vegetation beyond the limits of this request. Any remaining site work above and beyond what is
identifieas part of this land use permit application shall be subject to the review and approval of
the Zoning Administrator.

This Affidavit applies to the following real estate, herein referred to as the
"Property": Parcel No. 040-1145-10-36_0
Lot 4 of Certified Survey Map described in Volume 20, Page 5017 as
Document No 799957, being a part of Government Lot 2, Section 12,
Township 28 North, Range 20 West and the Southwest Quarter of the Southwest Quarter (SW '/4 of the
SW 1/4) of Section 7, Township 28 North, Range 20 West, St. Croix County, Wisconsin together with
access easement Document No 799960.
Through this Affidavit, the Owner hereby subjects the Property to the following covenants, conditions, and
restrictions:
1. The Owner or Responsible Party shall be responsible for the routine and extraordinary maintenance of
the storm water management facility(s) in accordance with the approved stormwater management plan on
file at the St. Croix County Planning and Zoning Department.
2. The County, or its designee, is authorized to access the property as necessary to conduct inspections of
the storm water management facility(s) to ascertain compliance with the intent of the storm water
management plan and the practices and procedures prescribed in the operation and maintenance
agreement.
3. Upon notification to the Responsible Party by the County of maintenance problems that require
correction, the specified corrective actions shall be performed by the Responsible Party within a
reasonable time frame as set by the County.
4. The County is authorized to perform the corrective actions identified in its inspection report or its notice
if the Responsible Party does not make the required corrections within the specified time period. The
costs and expenses of such corrective actions shall be the responsibility of the Responsible Party.
5. The terms and conditions contained in this Affidavit shall run with the Property and be binding upon the
successors and assigns of the parties to this Affidavit. Upon the conveyance of the Property by the
Owner or by any of the Owner's successors in title to the Property, the grantor of the Property in any
such conveyance shall be relieved of the obligations provided for herein.
