This letter confirms zoning approval according to plans submitted on January 23, 2012
Real Property
715-346-4677 for the following activities that require a land use permit:
Recycling To fill and grade <10,000 sq. ft. within 300 ft. of the Ordinary High Water Mark
715-386-4675 (OHWM) of an unnamed wetland that is being considered "navigable" in the
Shoreland District pursuant to Section17.29.(2)(c) of the St. Croix County Zoning
Ordinance.
According to the plans you submitted, the proposed filling and grading will be necessary
to construct a principal structure and a detached garage and extend a driveway. The
land disturbance will be on slopes <12% and will exceed the 2,000 sq. ft. allowable
without a land use permit.
Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and
Shoreland District based on the following findings:
1. The property consists of a 35 acre parcel created via map of survey, is zoned
Ag/Residential, and is located, in the Shoreland District of an unnamed wetland,
which is identified as seasonally navigable,
2. The proposed 3-bedroom house is within 300' from the wetland's OHWM and will
meet required side and rear yard setbacks from property lines;
3. The proposed house is intended for use as the principal structure on the property
and may not exceed the maximum height allowed in Section 17.13.(3) of the
ordinance;
4. The applicant's plan includes an erosion control and storm water management
plan featuring a French drain infiltration system to assimilate runoff from
approximately 2600 sq. ft. of impervious surfaces. With conditions to install
appropriate sediment control measures e.g. silt fence or sediment "logs" below the
construction area, to maintain erosion control measures until self-sustaining
permanent vegetation is established on all disturbed areas, to prohibit the use of

phosphorous fertilizer to establish and main ain a lawn, to implement the storm water"management
plan, and record a maintenance and monitoring agreement against the property for the infiltration
device(s), negative impacts to water quality of the pond will be minimized;
5. A'mound-style POWTS was installed in 2011 that will provide wastewater treatment for the proposed
dwelling;
6. The Town of Star Prairie building inspector will review the submitted plans and land use permit prior to
issuance of a building permit for the town;
7. Steve Olson, Land & Water Conservation Dept., reviewed the land use permit application. After
reviewing detail drawings and calculations for infiltration volume submitted on February 3, 2011,
Steve determined the stormwater and erosion control plans are adequate for the site. The applicant
shall record a stormwater operation and maintenance agreement on the deed to the property;
8. The Wisconsin Department of Natural Resources has been sent a copy of the application for review.
The proposed infiltration devices are not considered "structures" and will be outside the 75OHWM
setback to comply with stormwater requirements. In addition, the applicants have been working with
the DNR wildlife division to preserve the wetland area for waterfowl migration purposes. Mike Wenholz
requested that appropriate stormwater management plan and erosion and sediment control plan be
included in the permit;
9. If constructed as proposed, this project will meet the spirit and intent of the Recreational Residential
Shoreland District. With conditions for installation of erosion prevention, sediment control, and long-
term stormwater management devices, it will not degrade the water quality or scenic value of the
wetland, nor will it negatively affect the public health, safety and welfare of County residents.
This land use permit approval is for filling and grading <10,000 sq. ft. within 300' of the OHWM, as indicated
in the plans submitted, and as provided in the conditions below:
1. Prior to commencing construction, the applicants and/or their agent shall obtain any other permits
required, including but not limited to a building permit from the Town of Star Prairie;
2. Prior to commencing construction, the applicants and/or their agent shall contact the Zoning
Administrator and schedule an on-site meeting to review construction schedule and verify
installation of erosion and sediment control measures as indicated in the approved plans.
3. Sediment and erosion control measures must be maintained until all disturbed areas are fully
stabilized. No phosphorous fertilizers shall be used on the disturbed areas of the site, unless a soil
test confirms that phosphorous is needed to establish permanent vegetative cover and must be
limited to areas that do not drain directly into surface waters.
4. The finished principal structure shall not exceed the maximum roof height allowed in 17.13(3), will
remain outside the 75' setback from the OHWM, and will meet the side yard setbacks required in
17.27(1)(c);
5. The stormwater management plan must be implemented as part of the project with runoff infiltration
devices (rain garden) installed per approved plans. Per plan details submitted, French drain
infiltration devices will provide capacity to infiltrate - 396 cubic feet of runoff. The applicant shall

6. Within 30 days of substantially completing the proposed house construction, the applicant shall
submit to the Zoning Administrator certification from the contractor(s) that the construction has been
done incompliance with the approved plans. Photos of completed stormwater management
structures must be submitted upon completion.
7. All activities approved as part of this land use permit shall commence within one year from the date
of approval and be substantially completed within two years, after which time the permit expires.
Prior to :expiration, the applicant may request extensions of up to six months from the Zoning
Administrator. The total time granted for extensions shall not exceed one year.
This approval does not allow for any additional construction, grading, filling, or clearing of
vegetation beyond the limits of this request. Any remaining site work above and beyond what is
identified as part of this land use permit application shall be subject to the review and approval of
the Zoning Administrator.
It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations that
apply to this property. Your information will remain on file in the St. Croix County Planning and Zoning
Department as a matter of public record b.
