Land Information Parcel #28.30.19.288, Town of St. Joseph Planning 715-386-4674 Dear Mr. Heise: Real Prope This letter confirms zoning approval according to the plans you have submitted for 715-3$ 677 filling and grading an area of 6800 square feet within 300 feet of the Ordinary High Water Mark (OHWM) of Perch Lake to construct trail, a shelter building, and steps for Regis cling structural erosion control on the property referenced above in the Town of St. M-386-4675 Joseph. Staff finds that the proposed project meets the spirit and intent of the St. Croix County ,l Zoning Ordinance and Shoreland District with the following findings: 1. Filling and grading less than 10,000 square feet in area less than 300 feet from the OHWM on slopes less than 25 percent measured over a horizontal distance of 50 feet is allowed with a land use permit in the Shoreland District pursuant to Sections 17.29(2)(c) of the St. Croix County Zoning Ordinance; 2. Land disturbance activities for public improvements affecting slopes 25 to 29.9% measured over horizontal distance of 50' requires a land use permit pursuant to Sections 17.12(8) and 17.12(9) of the St. Croix County Zoning Ordinance; 3. A 16' x 20' shelter building is proposed for this project, 4. Project will include filling and grading of -850 linear feet of trail and timber stairs will be built in highly erodible sections of trail, which will utilize a combination of crushed rock and timber steps anchored into the ground that will prevent erosion on steeper sections of foot trail; 5. The shoreline of the lake is currently unimproved and is vegetated with trees and typical woodland undergrowth. A rain garden plan was submitted, which will have the capacity to infiltration 48 cubic feet of stormwater runoff from the shelter roof. With conditions for maintaining the current level of native vegetative cover along the shoreline to preserve wildlife habitat and provide infiltration of storm water runoff from impervious surfaces and any disturbed areas consistent with the standards in the Shoreland District, the natural beauty and ecology of Perch Lake will be protected; 6. A permit will not be required unless the grading were to exceed 10,000 sq. ft. within the 75-foot setb om the OHWM of Perch Lake. 8. Wit itions stipulated above, this project will meet the spirit and intent of the county ordinance Se 7.26.(3)(b) to prevent and control water pollution and Section 17.02 since it will not ne y affect the public health, safety and welfare of County residents. Based on th findings, approval of the land use permit is subject to the following conditions: 1. Prr to commencing construction, the applicant shall obtain any permits required by Federal, St' , or town regulations for this project. 2. The pplicant shall be responsible for supervision of any laborers and implementation of the ap oved project plan in compliance with these conditions. 3. a applicant shall install approved stormwater management device (rain garden) that will infiltrate runoff from the shelter roof as required in 17.29(2)(c)3. 4. The applicant shall install and maintain erosion and sediment control measures as proposed in plan submitted in order to prevent contaminated runoff from reaching Perch Lake until permanent stabilization has been successfully established on all disturbed areas of the site. Fns 5. The current level of native trees, shrubs, and groundcover along the shoreline shall be maintained. 6. Within 30 days of completing construction of the shelter, the applicant shall submit to the Zoning - Administrator photos of the completed project as viewed from all angles.
