Houlton, WI 54082 Re: Land Use Permit for construction of a conforming accessory structure in Code Administration the Lower St. Croix Riverway District 715-386-4680 Parcel #14.30.20.855A Computer #032-2086-30-100 in Town of Somerset Land Information & Planning Dear Mr. & Mrs. Scruton: 715-386-4674 This letter confirms zoning approval according to plans submitted on March 30, 2012 for Propeiq Real 715-33968G--467 4677 the following activities that require a land use permit: Recy:,ding To construct a conforming accessory structure with <10,000 sq. ft. filling and 71-5-386-4675 grading in the Lower St. Croix Riverway District in the Town of Somerset pursuant to Section 17.36. F.2.a.1) and 17.36.F.2.a.2) of the St. Croix County Zoning Ordinance and standards pursuant to Section 17.36.H.1. According to the site plan and narrative, the proposed project consists of construction of a 28' x 32' accessory structure and concrete walkway outside the 40-foot bluffline setback and on slopes <12% facing the river. The building with associated grading will involve a total of 1350 sq. ft. of land disturbance. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 2.75 acre non-riparian lot located at 1515 Twin Springs Rd., is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The proposed accessory structure will be more than 200 feet from the OHWM of the St. Croix River, greater than 25' from any property line, and is greater than 40 feet from the bluffline pursuant to requirements in Section 17.36.G.5.c.a); 3. The proposed building construction will result in 1350 sq. ft. of land disturbance that will not affect slope preservation zones or encroach into the bluffline setback; 4. The proposed garage will be - 18.5 ft. in height, which will not exceed the maximum height of 20 feet in compliance with Section 17.12.(5). With conditions that the structure does not protrude above the bluffline as viewed from near mid- river, that windows and building materials on the structure utilize earth-tone colors and non-reflective surfaces, this project will meet standards in Sections17.36 G.5.c.2)a) and 17.36 H.1 with regard to being visually inconspicuous; ST. The Town of Somerset building inspector will review the ui mg construction plans and land use permit in conjunction with UDC compliance inspections for the town; 6. The applicant proposes to route stormwater runoff from the roof into a 1500 gallon concrete tank that will then be used to water gardens adjacent to the structure. The gardens will also intercept passive runoff from concrete walkways to meet infiltration requirements. Installation of infiltration device(s) must provide stormwater control consistent with requirements in Section 17.36 H.7.; 7. Steve Olson, Land & Water Conservation Dept., reviewed the application and finds the stormwater management plan complete. He recommended that the applicant not use phosphorous fertilizer unless soil tests confirm it is needed and that an affidavit be recorded to document the stormwater plan. 8. Mike Wenholz of the Wisconsin Department of Natural Resources has reviewed the application and stated that as long as the project meets the bluffline setback and does not encroach within the slope preservation zone, the department had two comments regarding issuance of the permit. First, assure that an appropriate stormwater management plan and erosion and sediment control plan be included with the permit and second, that the applicant obtains any waterway permits if necessary; 9. The applicant proposes use of sediment logs for erosion and sediment control, which will be installed to control runoff from the construction area and contain it on the applicant's property; 10. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic recreational or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This land use permit approval is for the construction of a conforming accessory structure with <10,000 sq. ft. of land disturbance, as indicated in the plans submitted, and as provided in the conditions below: 1. The applicants or their contractor shall contact the Zoning Administrator prior to commencing construction to schedule an inspection that will verify installation of erosion and sediment control measures comply with the approved plans. 2. Prior to commencing construction, the applicants and/or their general contractor shall obtain any other permits required, including but not limited to a building permit from the Town of Somerset; 3. All areas of disturbed soil must be stabilized with temporary cover to prevent erosion until permanent vegetation consisting of native species can be established per 17.36.H.7.e.4 and 17.36. H. S. 4. The finished accessory structure shall not exceed the 20' maximum roof height allowed in Sections 17.13(3) and 17.36.G.4. The structure may not be used as a second dwelling unit in compliance with Section 17.13(1)(e). 5. All siding, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature, with windows that are not more reflective than ordinary window glass, so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a) and 17.36 H.1 of the Ordinance. Within 3rdays of substantially competing the proposed building`construction, the applicant shan sbmit to the zoning Administrator certification from the contractor that the construction has been done in compliance with the approved plans. Photos of the completed project must be submitted to the Zoning Administrator to document compliance with permit conditions. 7. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall"not exceed one year. 8. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section-17.36 J.8.b of the Ordinance. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. Any remaining site work above and beyond what is identified as part-of this land use permit application shall be subject to the review and approval of the Zoning Administrator. Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not limited to obtaining a town building permit and any permits that may be required by the Wisconsin Department of Natural Resources.
