BOARD OF ADJUSTMENT MEETING AND HEARING
Minutes
November 24, 1993
(This meeting was recorded by a court reporter)
The meeting was called to order by Chairman Bradley at 9:00 a.m.
Chairman Bradley explained the procedures of the hearing and
requested that individuals wishing to testify sign their names and
addresses on the sign-up sheet in the rear of the room.
Supervisors Stephens, Bradley, Kinney, Menter, and Neuman were in
attendance. Staff included Tom Nelson, Zoning Administrator, and
Michelle Judge, Recording Secretary.
Next meeting scheduled for December 22, 1993.
Kinney made a motion to change minutes of September 23--Kosa
"Kinney stated self-induced hardship". Menter seconded Motion
carried. Motion by Bradley, seconded by Neumann to adopt September
minutes with changes Motion carried.
Menter asks to change the November 1 minutes, page 4. Role call
vote; Stephens, no; all others yes. Menter abstained from voting.
Motion by Neumann, seconded by Bradley to adopt November 1
minutes Motion carried.
Motion by Stephens, seconded by Neumann to re-hear the Amys appeal.
Reason being not all information was presented. New addition would
be an additional story to the house. Motion carried for December
meeting.
OLD BUSINESS
GAME UNLIMITED: Nelson stated Game Unlimited is before the Board
because of an expanded use, and the need for a special exception.
It had been agreed to postpone so all could be discussed. Matt
Biegert, agent for Game Unlimited brought a proposal asking for the
following: sporting clays will not be done on any legal holidays.
From May 1-September 1, shooting from 9-3 on Sundays, 9-5
Saturdays, M-F 9-8:30 p.m. Clay shooting will not be done one
night per week. Asking that the use be grandfathered in. Stephens
states it cannot be grandfathered in as it is a relatively recent
addition. David Anderson, neighbor of Game Unlimited was sworn-in
and asks for stronger restrictions. States concern over increased
noise. Bradley asks to re-visit site and make a decision at that
time.

The St. Croix County Board of Adjustment (Board) has reviewed your request for the following item:
Conditional use for a limited commercial recreation activity (Tough Mudder event) in the

After the hearing on April 24, 2014, the Board approved the request with conditions. The enclosed

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and visited the site, the Board of Adjustment
makes the following Findings of Fact and Conclusions of Law pertinent to the request:
L The property owner is Game Unlimited Hunting Club, Inc. and the agent is Barry Shaw representing
Tough Mudder.
2. The site is located in multiple parcels: NE 1/4 and SE 1/4 of Section 1.29.19 in Town of St. Joseph, NW 1/4
of Sec. 6.29.18 in Town of Warren, and N 1/2 of Sec. 12.29.19 in Town of Hudson - see site map
submitted with application.
3. The applicant submitted a special exception (nka conditional use) request to allow a Tough Mudder
cross-country challenge race to be held one weekend in July, which has been determined to be a limited
commercial recreational activity in the Ag Residential zoning district. The two-day Tough Mudder
competition would meet the ordinance requirement for being subordinate to the primary agricultural use
of the property, would be compatible with the agricultural uses on that and surrounding properties, and
would not likely attract other commercial related use.
4. The St. Croix County Highway Department Engineer, Jeff Durkee, reviewed the application and made
the following comments:
a) Event organizer Barry Shaw met with the highway department, which made him aware of the
department's access permit application and approval process. We are all in agreement that at
least one additional access will need to be constructed and at least one existing access will need
to be improved to commercial standards.
b) Event organizers will need to work with the sheriff's office and local law enforcement to
provide traffic control during the event.
C) Given the amount of County Highway frontage owned by Game Unlimited the new access point
would remain permanent or be removed following the Tough Mudder event. This decision will
depend on the decision of the land owner and the location of the new access.
5. Town of St. Joseph Plan Commission and Town Board have reviewed the application at their March and
April meetings. The town board submitted a list of 16 questions and/or items to be considered and
addressed at the county's meeting.
6. Town of Warren Plan Commission has reviewed the application at both the March and April meetings
and the Town Board submitted a recommendation on April 22, 2014 after their April 2 meeting as an
additional exhibit at the Board of Adjustment hearing.
7. The Wisconsin Dept. of Natural Resources Wildlife Biologist, Ryan Haffele, submitted a letter that
identified concerns regarding the application, specifically: camping is prohibited on DNR wildlife
areas, cleaning up any litter that may be deposited outside the applicant's event area, unleashed pets are
not allowed on DNR wildlife areas, and parking of vehicles in the public parking areas associated with
the wildlife area.
8. WDNR Regional Shoreland Specialist, Mike Wenholz, submitted comments via e-mail on April 15,
2014: The applicant should determine which, if any, of these waterbodies are navigable. The
applicable setback from navigable waterbodies for buildings and structures is 75 feet from the ordinary
high water mark; this applies to any structures, including those associated with an event such as the
Tough Mudder competition. Additionally, the provisions of s. 17.28 should be applied to preserve
shoreland vegetative protection areas from any activities associated with the event. The department
requests the applicants assure the activities associated with the event will not include any building,
filling, or grading within wetlands, or result in any discharges to wetlands.
9. The proposed Tough Mudder competition event would meet several objectives from the St. Croix
County Comprehensive Plan Economic Development goals and objectives, which includes promoting
the county as a tourism destination, maintaining balance between agricultural businesses, natural
resources, and rural character of the county, and increase opportunities for nature-based recreation.
10. According to the Tough Mudder Operating Plan, page 7 of 19, sanitary facilities for competitors and
spectators will be provided at a ratio of 1 satellite toilet for every 150 persons on site, with four (4)
ADA units to be included. With conditions for adequate number of satellite toilets to be placed in the
base area to serve the estimated number of event participants and/or spectators each day of the weekend
event, this request will not create a public health or environmental hazard.
11. According to the Tough Mudder Operating Plan, page 4 of 19, the proposed hours of operation for the
Tough Mudder competition activities will be Saturday July 19th from 7:00 a.m. to 7:00 p.m. and Sunday
July 20th from 8:00 a.m. to 6:00 p.m. There will be additional hours on site July 1 - 18 for pre-race
obstacle construction and site preparation, as well as post-event cleanup and site restoration from July
20th through September 1, 2014.
12. The event will include a public address sound system that will play music, but the volume will be
controlled to avoid a noise-related nuisance to neighboring property owners.
13. According to the Tough Mudder Operating Plan, page 6 of 19, event workforce will consist of 9 Tough
Mudder staff (lead team and support employees), - 25 contract laborers, 6 - 10 security staff, - 30
parking staff and -5 police officers, and an estimated 100 - 200 volunteers.
14. Traffic to the event will be directed from County Rd. E to two driveway entrances to access designated
parking areas and Base Area (see Operating Plan maps on pages 14 and 18 of 19). With conditions for
providing adequate off-street parking for all participants of the Tough Mudder event per Section 17.56
of the county ordinance and complying with access requirements by the county highway department,
this request would not be contrary to public health and safety.
15. There will be vendors offering food and beverages for sale on the site only during the event weekend.
Participants who are of legal age (21) are given a gift bag that includes a beer ticket upon completion of
the course. The applicant's agent and/or individual vendors will be responsible for obtaining necessary
permits for sale of food and beverages and retail liquor licensing required by the state and town(s).

DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board of Adjustment
approved the conditional use request, with the following conditions:
1. This conditional use permit allows the applicant and the agent to hold a Tough Mudder challenge
competition as a limited commercial recreational activity on the site, as indicated in the application, the
Tough Mudder Operating Plan, and as provided in the conditions below. This approval does not
include any additional uses, structures, or activities on this site.
2. Any aggrieved or interested party may request a reconsideration of this decision based upon Section 6
of St. Croix County Board of Adjustment Rules and By-Laws. The request for reconsideration must be
in writing and submitted with new written evidence so that it can be filed with the Secretary at least 15
days prior to the next regularly scheduled Board of Adjustment meeting date.
3. The applicant and their agent shall be responsible for securing all necessary local, state, or federal
permit requirements, licenses and approvals, including but not limited to municipal liquor licensing.
4. A final course map shall be submitted to the CDD staff for review and verification if any land
disturbance will occur within 300 feet landward of any navigable waters OHWM to determine if any
additional Shoreland zoning permits are required.
5. The applicant and the agent shall implement action items contained in the Tough Mudder Operating
Plan.
6. Restoration and re-vegetation shall be completed in areas located within 300 feet landward of any
OHWM where disturbance has exposed soils to erosion and/or where vegetation removal was necessary
to allow construction of the obstacle course. Standards contained in county Shoreland Overlay
ordinance Sections 17.30.1, 17.30.K.2, and 17.30.N.1.d.3 must be met and acceptable management
techniques used to restore and stabilize those impacted areas.
7. Satellite toilet sanitary facilities at a minimum ratio of 1:150 persons shall be on-site to provide sanitary
wastewater disposal for all participants, spectators, and workforce staff that will be on the Game
Unlimited Hunting Club property, including pre- and post-event activities.
8. Traffic management and off-street parking shall be provided in accordance with requirements in county
ordinance Section 17.56 and the submitted Operating Plan page 16 of 19. There will be 3 designated lots:
lot 1- 2900 parking spots, lot 2 - 500 parking spots, and lot 3 - 770 parking spots for a total of 4,170 off-
street parking spots on 37.5 acres in the NW 1/4 of Section 6, as indicated the maps on pages 13 and 14.
9. The applicant shall comply with the St. Croix County Highway Engineer's access requirements and
county/town driveway standards.
10. The hours of operation for the Tough Mudder competition activities will be Saturday July 19th from 7:00
a.m. to 7:00 p.m. and Sunday July 20th from 8:00 a.m. to 6:00 p.m. There will be additional hours on site
July 1-18 for pre-race obstacle construction and site preparation, as well as post-event cleanup and site
restoration from July 20th through September 1, 2014.

11. No signage, other than those required as posted warnings to the public, is approved as part of this permit.
All signage on and off the site must adhere to the standards and permit requirements in the St. Croix
County Sign Ordinance Section 17.65.
12. All lights on the site must be downward directed and shielded away from neighboring properties and the
road to prevent glare.
13. Prior to any activity on this site the applicant shall be responsible for securing all necessary local, state,
and federal permits and approvals and submitting copies of such to County CDD.
14. Prior to any activity on this site, the applicants shall submit to the Zoning Administrator a cash
compliance deposit in the amount of $1,100 to be held by the Zoning Administrator until conditions
have been met, at which time the deposit will be refunded in full.
15. These conditions may be amended or additional conditions may be added if unanticipated
circumstances arise that would affect the health and/or safety of citizens or degrade the natural
resources of St. Croix County. Conditions will not be amended or added without notice to the applicant
and an opportunity for a hearing.
16. Any new owners of the property must adhere to the standards and conditions of the approved
conditional use permit. Any change or addition in use of the property, buildings, and/or business; or
modification of or addition to the property, building, or facilities; or changes to the current project
details shall require prior review by the Zoning Administrator to determine if the use may be allowed.
The conditional use decision applies to the property rather than to the individual, is valid for the
specific premises, and is not transferrable to other properties per Article VII Section 4 of the Board of
Adjustment Rules.
17. The applicants shall have one (1) year from the date of this approval of this conditional use permit to
commence use on this site for a Tough Mudder event. Failure to do so may result in expiration or
revocation of the conditional use permit. If the conditional use permit expires or is revoked within this
timeframe, the applicants will be required to secure a new conditional use permit. Prior to expiration
and/or revocation, the applicant may request two (2) extensions of up to six months each from the
Zoning Administrator, for a total time not to exceed one year.
18. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of
this decision and authorizes unannounced compliance inspections by zoning officials during business
hours.
The following vote was taken to approve: Chairman Malick, yes; Peterson, yes; -Nelson, yes; and Sontag, yes.
McAllister, absent. Motion carries.
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the
filing date shown below, pursuant to Sec. 59.694(10), Wisconsin Statutes. St. Croix County assumes no
responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix
County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment

proceedings, which resulted in this decision, was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript
of the Board of Adjustment proceedings to the circuit court. The Planning and Zoning Department can be contacted
for information on how to obtain a transcript. It is the responsibility of the Board of Adjustment to submit its record
(file) of this matter to the circuit court.

The St. Croix County Board of Adjustment has scheduled a public
hearing for Wednesday, November 24, 1993 at 9:30 a.in. at... the
Government Center, 1101 Carmichael Rd., Hudson, Wisconsin. .to
consider the following appeals to the St. Croix County Zoning
Ordinance. An on-site investigation will be made of each site in
question, after which the board contemplates adjournment into
closed session for the purpose of deliberating on the appeals,
pursuant to Sec. 19.85(1)(a), Wisconsin Statutes. The Board will

Zoning office approves of the request. The'Town of Star Prairie
also supports the request.

states need CSM and made a motion not to continue, Menter seconded.

DECISIONS
Having completed the hearing testimony, the Board visited each site
in question. Upon completion, the following decisions were

GAME UNLIMITED
Motion by Stephens, seconded by Menter to conditionally approve the
spatting dayd and taplatball" use on the property. The hours of
operation shall be as follows:
1) Between May 1 and September 1
A. 9:00 a.m. to 3:00 a.m. on Sundays
B. 9:00 a.m. to 5:00 a.m. on Saturdays
C. Other days of the week, except Wednesdays, 9:00 a.m.
to 8:30 p.m.
2) September 1 to April 30 - no time limits.
3) All federal holidays - the uses shall be closed.
