A sanitary permit application has been submitted for staff review and approval in compliance with Chapter 12 of the ordinance. Staff finds that the proposed activities meet the applicable St. Croix County Zoning Ordinances and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of 1- acre non-riparian lot, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The proposed excavation is more than 200 feet from the OHWM of the St. Croix River and is greater than 100 feet from any bluffline; 3. The osed excavation and installation of a replacement POWTS will result in ap mately 700 sq. ft. of land disturbance that will not be within 40 feet of a slope pr ation zone; 5. A s ry permit application has been submitted for review and approval by state- certi code administration staff and the permit will include conditions that the land use p mit be issued prior to excavation for the replacement POWTS; 6. Stev Ison, Land & Water Conservation Dept., will be sent a copy of the land use p it application and the sanitary permit. This project will be similar in nature to eviously approved POWTS replacements that did not receive any objection from the LWCD; 7. The Wisconsin Department of Natural Resources will be sent a copy of the land use permit application and sanitary permit. The DNR has previously concurred with the Planning & Zoning memo regarding replacement POWTS in the Riverway District; 8. constructed as proposed, this project will meet the spirit and intent of the Lower St. 1 .1 ix Riverway District. It will not degrade the scenic, recreational, or natural values ofNt e St. Croix River Valley, nor will it negatively affect the public health, safety and Ifare of County residents. This la use permit approval is for the installation of a replacement POWTS, as indicated in the ans submitted, and as provided in the conditions below: 1. r to commencing excavation for installation of the non-pressurized in-ground re cement POWTS, the applicants and/or their general contractor shall obtain a sta sanitary permit issued by POWTS-certified Zoning department staff. 2. The licants or their contractor shall contact the Zoning Administrator prior to co encing installation of the POWTS to schedule inspections as required in §SPS 38 and in Section 12.6.A.1 of county ordinance; 3. to the short duration of land disturbance required for installation and the site's istance to the river, sediment control measures will not be required. Upon ompletion of the POWTS installation, seed and mulch cover must be applied to bilize all exposed soils in compliance with requirements in Section 17.36.H.5a.3 d 4. ST. Tie applicant shall comply with long-term POWTS maintenance and inspection requirements pursuant to §SPS 383.52(1) and Section 12.7.13 of the county ordinance. I 5. All ities approved as part of this land use permit shall commence within one ye m the date of approval and be substantially completed within two years, aft ich time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prio ; o expiration, the applicant may request extensions of up to six months from the icing Administrator. The total time granted for extensions shall not exceed one year. 6. Failur to comply with the conditions above may result in the revocation of this p it pursuant to Section 17.36 J.8.b of the Ordinance. This pproval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request.
