Staff finds that the project meets the tower Real Property provisions in Section 17.84(6) of the St. Croix County Zoning Ordinance since it will provide 715-3M-4677 temporary service during a high usage time prior to the installation of permanent cellular Recycling equipment on the site as approved by land use permit #L00073 Oil June 9.. 2007. Use of the 715-386-4675 temporary facility on the site shall be limited to July 16 30, 2007. The temporary facility shall he removed in its entirety by July 30, 2007. This letter confirms zoning oval according to the plans you have submitted to the Planning T and approval Zoning Department to co-locate Verizon Wireless telecommunications facilities on an existing tower Real P rty owned by the American Tower Corporation on the property listed above in the Town of Somerset. 715 -4677 Staff finds that the project meets the tower provisions in Sections 17.85(2) and 17.87(2) of the St. Croix R cling County Zoning Ordinance based on the following findings: -386-4675 1. Approval of this land use permit includes the addition of new Verizon Wireless facilities to an existing tower owned by the American Tower Corporation, including a three panel antenna at a centerline height of 156 feet and a related cable bridge and pre-fabricated equipment ` shelter; 2. All proposed Verizon Wireless antennae and equipment meets the required setbacks and x~ height requirements in the Commercial District; 3. The existing tower has the capacity to structurally support the proposed Verizon Wireless facilities as certified by a registered professional engineer for the American Tower Corporation on February 14, 2007; 4. The proposed Verizon Wireless facilities meet mechanical and electrical standards as indicated in Sheets A-3 through A-6, G-1,and G-2, and E-1 of the specification sheets dated t March 29, 2007 and submitted as part of this permit application; 5. The proposed Verizon Wireless facilities will provide cellular and Personal Communication Services (PCS) that will not interfere with other existing facilities or pose a threat to public health and safety as certified by Jonathan Nowlin, Radio Frequency Engineer for Verizon Wireless, in a memo dated May 3, 2007; and 6. Co-location is an accepted use in the Commercial District and is encouraged by the Ordinance. This permit has been issued to the applicant, Verizon Wireless.. with the following conditions, which arc the responsibility of Verizon Wireless or agents acting on its behalf: 1<n~ l . The applicant shall contact the Planning and Zoning Department at least tive days prior to commencing installation of the proposed antennae and facilities. 2. The applicant shall inform the Zoning Administrator when construction is complete and submit photos of the completed antennae and facilities. I` 3. The applicant shall have one (1) year from the issuance of this land use permit to commence construction. If the pen-nit expires, the applicant will be required to secure anew land use pen-nit. ST. The applicant shall notify the Zoning Administrator of any change in name or ownership of the approved facilities and provide new contact information for the purpose of keeping the file updated. 5. Any minor change (or addition) in the project shall require prior review and approval by the Zoning Administrator. Any major change and/or addition to the originally approved plans will require the submittal of a new land use permit application. 6. Within 12 months of cessation of operation or use of the wireless facilities, all unused antennas and equipment shall be removed at the applicant's expense. After the facilities are removed, the site shall be restored to its original condition or an improved condition. This approval does not allow for any structures (temporary or permanent), activities, or development beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of Somerset to obtain the necessary building permits for the proposed construction.
