Staff finds that the project Real Property meets the applicable tower provisions in Section 17.82 (1) (a of the current St Croix County 715-386=4677 > Wireless Communication Service Ordinance which references Section 17.82 and Section 17.83 Recycling (1)(2)(6) of the 1997 Wireless Communication Ordinance based on the following findings: 715-3864675 h 1. Approval of this land use permit includes the addition of 9 antennas on a 196 foot existing wireless tower owned by Charles LeVake. A list of these replacements and additions is on pages 1 and 2 of the structural analysis report that was completed by Trevor Axner, Professional Engineer. ~ 2. The existing and proposed antennas comply with FCC and FAA regulations. 3. The existing tower has the capacity to structurally support the new equipment. 4. The tower and components will be removed within 12 months of cessation of operation or use. 5. The co located antennas do not increase the height of the tower. ? 6. Co locating on a tower is a permitted with a land use permit in the Ag. Residential ti District. This permit has been issued to Guy Stewart / AT&T with the following conditions; 1. The applicant shall contact the Planning and Zoning Department at least five days prior to commencing installation of the proposed antennae and equipment. I 2. The applicant shall inform the Zoning Administrator when construction is complete and submit photos of the completed antennae and equipment. 3. The applicant shall have one (1) year from the issuance of this land use permit to complete construction. If the permit expires, the applicant will be required to secure a new land use permit. 4. The applicant shall notify the Zoning Administrator of any change in name or ownership of the approved facilities and provide new contact information for the purpose of keeping the file updated. zT, v-, 5. Any minor change (or addition) in the project shall require prior review and approval by the i Zoning Administrator. Any major change and/or addition to the originally approved plans will require the submittal of a new land use permit application. ST. Within 12 months of cessation of operation or use of the wireless facilities, all unused antennas and equipment shall be removed at the applicant's expense. After the facilities are removed, the site shall be restored to its original condition or an improved condition. This approval does not allow for any structures (temporary or permanent), activities, or development beyond the limits of this request. Your information will remain on file in the St. Croix County ' Planning and Zoning Department. Please contact the Town of St. Joseh to obtain the necessary building permits for the proposed construction.
