HomeMy WebLinkAbout040-1198-10-000(2) CWIX COUNTY PLANNING ZONING January 11, 2012 File#: LU87406 Steve King 333 North Cove Rd. = Hudson, WI 54016 I Re: Land Use Permit for construction of a conforming accessory structure in the Lower St. Croix Riverway District CodeAdministrad Parcel #13.28.20.904, Computer #040-1198-10-000 Town of Troy 715-386-4680 Dear Mr. King: Land Information & Planning This letter confirms zoning approval according to plans submitted on December 22, 715-386-4674 2011 for the following activities that require a land use permit: Real Prop 5r'7y~ To construct a conforming accessory structure with <10,000 sq. ft. filling 715-396'=4677 and grading in the Lower St. Croix Riverway District in the Town of Troy Reding pursuant to Section17.36.F.2.a.1) and 17.36.F.2.a.2) of the St. Croix County 15-386-4675 Zoning Ordinance and standards pursuant to Section 17.36.1-1.1. According to the site plan and narrative, the proposed project consists of construction of a 24' x 24' accessory structure outside the 40-foot bluffline setback with associated grading that will involve a total of 600 sq. ft. of land disturbance. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of an existing principal, structure located at 333 N. Cove Rd., Lot 8 of Bomar Hts. 1 st Addition subdivision plat, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The proposed accessory structure is more than 200 feet from the OHWM of the St. Croix River, greater than 25' from any property line, and is greater than 40 feet from any blufflines pursuant to requirements in Section 17.36.G.5.c.a); 3. The proposed building construction will result in approximately 600 sq. ft. of land disturbance that will not affect slope preservation zones or encroach into the f -a bluffline setback, and per building specifications submitted by the applicant's agent, the roof will not exceed the maximum height of 35 feet; 4. The proposed structure will be approximately 14.5' in height according to construction drawings. The applicant proposes to manage stormwater runoff from the new impervious roof surface via two 24' long by 1' wide rock infiltration trenches alongside the accessory structure; i 6. The Town of Troy has reviewed the project for their Riverway permit and the their building inspector will review the submitted plans and land use permit prior to issuance of a building permit; 7. Steve Olson, Land & Water Conservation Dept., reviewed the application and found the proposed trenches were sized using 72 square feet, not 72 cubic feet, so the rock trenches with 30% void space only provides 7 cubic feet of storage volume. However, the 48 square foot area of rock trench will be adequate assuming the soils will infiltrate at a minimum of 0.5 inches per hour. With conditions to have sandy soil underneath the rock trenches, the LWCD will have no objection to the proposed project; 8. Mike Wenholz of the Wisconsin Department of Natural Resources has reviewed the application and is in support of the project due to its conformity with ordinances; 9„ A site plan prepared by the applicant indicates the location of the proposed garage, which is not on a riparian lot and there is no surface water drainage toward the river; 10. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This land use permit approval is for the construction of a conforming accessory structure with <10,000 sq. ft. of land disturbance, as indicated in the plans submitted, and as provided in the conditions below: R 1. The applicants or their contractor shall contact the Zoning Administrator prior to commencing construction and install erosion and sediment control measures indicated in the approved plans. 2. Prior to commencing construction, the applicants and/or their general contractor shall obtain any other permits required, including but not limited to a building permit from the Town of Troy; 3. During construction the applicant and their agent(s) shall comply with all inspection requirements for the building construction. 4. Prior to construction, a stormwater management plan must be submitted to the Zoning Administrator for approval that directs runoff from new impervious surfaces into infiltration trenches that will provide a minimum storage capacity of 72 cubic feet of water. The applicant shall record an affidavit on the deed to the property to provide for long-term operation and maintenance of the infiltration trenches as required in Section 17.36.H.7.g. 5. All areas of disturbed soil must be stabilized with temporary cover to prevent erosion until permanent vegetation consisting of native species can be established per 17.36.H.7.e.4 and 17.36.H.8. 6. The finished accessory structure shall not exceed the maximum roof height allowed in Sections 1.7.13(3) and 17.36.G.4. Within 30 days of substantially completing the proposed building construction, the applicant shall submitto the Zoning Administrator certification from the contractor that the construction has been dor~ecompliance with the approved plans. Copies of the recorded stormwater management nd photos of the completed project must be submitted to the Zoning Administrator to affidavit 12 document compliance with permit conditions. 9. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall of exceed one year. 10i, Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. F This approval does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of the Zoning Administrator. } Your information will remain on file in the St. Croix County Planning and Zoning Department.
