The property consists of 14.24 acres, is zoned Ag/Residential, and is located in the Shoreland overlay District of the St. Croix River. 2. The project proposes extending an existing walking trail by grading a path approximately five (5) ft. wide by approximately 400 ft. long. The trail will traverse steep slopes using switchbacks and will require installation of retaining timbers and/or rip-rap on the uphill side of the trail in designated areas. Staff performed a site visit to discuss methods for stabilizing the steeper portions of the trail and for handling runoff from slopes above the trail. 3. The Wisconsin Department of Natural Resources reviewed the application and had no specific comments regarding the proposed project. No Chapter 30 permit or an Individual Permit will be required for grading on slopes that are outside the Lower St. Croix Riverway District in compliance with 17.29(2)g. 4. The St. Croix County Land and Water Conservation Department has performed a site visit, reviewed the plans, and supports approval of the project. LWCD staff will be consulted on erosion and sediment control measures during trail construction and when permanent vegetative stabilization is being established. ST. Pursuant to General Zoning Section' 17:29(2)(6) Filling & grading `less than 10;000 s"" q. ft. within 300 ft. of the OHWM on slopes 12% to 24.9% is allowed with a Land Use Permit if standards 1. - 7.a & b. are met. 6. With conditions to install erosion and sediment control measures and temporary diversions that direct runoff away from the ravine until permanent stabilization measures have been completed, the project will meet the standards in 17.29(2)(c).1-7. 7. With conditions stipulated above, this project will meet the spirit and intent of the county ordinance Section 17.26(3)(b) by preventing and controlling water pollution, by protecting spawning grounds, fish and aquatic life and preservation of shore cover and natural beauty. This approval is for filing and grading to install trail from the applicant's rear yard down to the river waterfront, as indicated in the site plan submitted and as provided in the following conditions: 1. Prior to commencing construction, the applicant shall obtain any permits required by `Federal, State, or town regulations for this project. 2. The applicants shall notify the Zoning Administrator prior to commencing grading and stabilization and again when the construction has been completed to schedule a final site inspection. 3. Prior to commencing filling and grading, erosion and/or sediment control measures must be installed to intercept runoff from the steep slopes above the trail and provide temporary diversion of stormwater runoff until the trail has been completed. 4. Upon completion of the trail, the applicants or their contractor shall apply soil stabilization matting, seeding for revegetation with native species, and mulch in accordance with the approved plans and shall supplement with additional erosion control measures as necessary to ensure that sediment-laden runoff does not reach the St. Croix River. All erosion and/or sediment control measures shall be maintained until permanent, self-sustaining vegetation is successfully established on all disturbed areas of the site. 5. No phosphorous fertilizers shall be used to establish and maintain native vegetation on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 6. Upon completing the site work outlined as part of this land use permit application, the applicants shall submit to the Zoning Administrator photos of the trail and permanent stabilization measures to document compliance with conditions. 7. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. ST. We are eager to get going and I will be talking tomorrow with Tom Landry about the schedule. I notice the permit letter wants us to notify your office "prior to commencing construction;" you can assume that we will be seriously underway by July 1, but if there is any unforeseen and significant delay or change, I will let you know. One minor (I hope) problem: Paragraph 2 on the first page of your letter describes the proposed trail extension as 400 ft. long. That is the approximate length of the existing/established trail. The extension to this existing 5-6 ft. wide trail will be an additional 800 to 1000 feet of length, the finished total trail then being about 1200-1400 feet in length, including switchbacks and transverse/lateral movements. I don't know if this matters to anyone but me, but I do want the finished product to be consistent with our statement of intent and what the county is approving. Thanks again, Pam, for the help you and Steve have given. The two of you do a marvelous job of putting a human and supportive face on a "sticky" and sometimes bureaucratic - but necessary - function. Your property, which consists of Lot 5 on CSM 20/5080, is adjacent to the St. Croix River and is located Re cling within the Shoreland overlay district. -386-4675 According to our discussion today, the project involves expanding an existing deck on the house. Shoreland zoning does not address the proximity of your house/deck to the bluffline, so there are no setback issues concerning the expansion. We reviewed the location of your building sewer and septic tank based on an as-built drawing so that your contractor can avoid damaging them when placing footings for the deck. This project will disturb less than 2,000 square feet a; (grading/filling) on slopes <12% and greater than 300' from the OHWM, so you will not be required to obtain a Land Use permit pursuant to Shoreland Zoning Chapter 17.29(2)(a). The original Private On-site Wastewater Treatment System (POWTS) was designed and installed based on design wastewater flow for four (4) bedrooms (600 gallons/day) with a maximum occupancy of eight (8) persons. The proposed plans do not include any additional bedrooms and occupancy remains unchanged, therefore the project will not affect the function of the POWTS. We also discussed the possibility of a future project to create a pathway for access to the river. I provided you copies of section 17.29 of the zoning ordinance that specify the amount of filling and grading that is allowed without obtaining a land use permit. Please plan to review concept plans with our office prior to grading on steep slopes (20 - 24.9% angle) or within 300 feet of the Ordinary High Water Mark (OHWM) of the St. Croix River. The most recent survey map indicated the `T. location of iron pipes that mark a meander line, which may/may not be equal to the `V OHWM.
