Real Propee, This letter confirms zoning approval according to plans submitted on March 31, 2011 for
715-38G'=4677 the following activities that require a land use permit:

715-386-4675 To fill and grade <10,000 sq. ft. within 300 ft. of the Ordinary High Water Mark
(OHWM) of an unnamed navigable water in the Shoreland District pursuant to
Section17.29.(2)(c) of the St. Croix County Zoning Ordinance.
According to the plans you submitted, the proposed filling and grading will be necessary
to construct a habitable pole building and install a Private On-site Wastewater
Treatment System (POWTS) to service its wastewater. The land disturbance will be on
4 slopes >12% and will exceed the 1000 sq. ft. allowable without a land use permit.

j Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and
Shoreland District based on the following findings:
4 1. The property consists of a 4.8 acre lot, is zoned Ag/Residential, and is located in
the Shoreland District of an unnamed pond, which is identified as navigable in the
Pioneer Ridge Subdivision plat;

h 2. The proposed building will be a habitable pole-type construction on a slab
foundation, is greater than 300' from the OHWM, and will meet required side and
' .4 rear yard setbacks from property lines;
3. The proposed habitable pole barn roof is intended for use as the principal structure
on the property and may not exceed the maximum height allowed in Section
17.13.(3) of the ordinance;
4. The applicant's plan includes an erosion control and storm water management
plan featuring an infiltration trench and a rain garden to assimilate roof runoff. With
conditions to install appropriate sediment control measures e.g. silt fence or
sediment "logs" below the construction area, to maintain erosion control measures
until self-sustaining permanent vegetation is established on all disturbed areas, to

prohibit the use of phosphorous fertilizer to establish and maintain a`lawn; td-iirhplement"the 9t6rm v"
water management plan, and record a maintenance and monitoring agreement against the property for
the infiltration basins, negative impacts to water quality of the pond will be minimized;
5. A sanitary permit has been issued for installation of a mound POWTS;
6. The Town of St. Joseph building inspector will review the submitted plans and land use permit prior to
issuance of a building permit for the town;
7. Steve Olson, Land & Water Conservation Dept., reviewed the land use permit application. The
stormwater and erosion control plans are adequate for the site. The applicant shall record a
stormwater operation and maintenance agreement on the deed to the property;
8. The Wisconsin Department of Natural Resources has been sent a copy of the application for review.
Typically the DNR will not require an individual grading permit for land disturbance <10,000 sq. ft.
within 300 feet of the OHWM of the pond;
9. If constructed as proposed, this project will meet the spirit and intent of the Recreational Residential
Shoreland District. With conditions for erosion prevention, sediment control, and long-term stormwater
management, it will not degrade the water quality or scenic value of the pond, nor will it negatively
affect the public health, safety and welfare of County residents.
This land use permit approval is for filling and grading <10,000 sq. ft. within 300' of the OHWM, as indicated
in the plans submitted, and as provided in the conditions below:
1. Prior to commencing construction, the applicants and/or their agent shall obtain any other permits
required, including but not limited to a building permit from the Town of St. Joseph;
2. Prior to commencing construction, the applicants and/or their agent shall contact the Zoning
Administrator and schedule an on-site meeting to review construction schedule and verify
installation of erosion and sediment control measures as indicated in the approved plans.
3. Sediment and erosion control measures must be maintained until all disturbed areas are fully
stabilized. No phosphorous fertilizers shall be used on the disturbed areas of the site, unless a soil
test confirms that phosphorous is needed to establish permanent vegetative cover and must be
limited to areas that do not drain directly into surface waters.
4. During construction the applicant and their contractors shall comply with all inspection requirements
for the building construction and installation of the POWTS.
5. The finished principal structure shall not exceed the maximum roof height allowed in 17.13(3), will
remain outside the setback from the OHWM, and will meet the side yard setbacks required in
17.27(1)(c). If at any time this structure becomes accessory to another dwelling, an appropriate
sanitary permit must be obtained for connection to the POWTS and the pole barn may not be
inhabited as a second dwelling on this parcel;
6. The stormwater management plan must be implemented as part of the project with infiltration
structures installed per approved plans. Within 30 days of substantial completion of the project, the

7. Within 30 days of substantially completing the proposed house construction, the applicant shall

submit to the Zoning Administrator certification from the contractor(s) that the construction has been
done. incompliance with the approved plans. Photos of completed stormwater management
structures must be submitted upon completion.
14 a8. All activities approved as part of this land use permit shall commence within one year from the date
of approval and be substantially completed within two years, after which time the permit expires.
Prior to 'expiration, the applicant may request extensions of up to six months from the Zoning
Admin'istrator. The total time granted for extensions shall not exceed one year.
This approval, does not allow for any additional construction, grading, filling, or clearing of
vegetation beyond the limits of this request. Any remaining site work above and beyond what is
identified as part of this land use permit application shall be subject to the review and approval of
the Zoning Administrator.
