According to the plans you submitted, the proposed remodeling consists remodeling and expanding the existing principal structure that will remain connected to an existing - Private On-site Wastewater Treatment System (POWTS) that was sized for a 4- bedroom dwelling. r Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 2.2 acre lot, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The existing house was built in 1970 and a recent survey verified that it is greater than 200 feet from the OHWM of the St. Croix River, greater than 25' from any x. property line, and meets the 40-foot setback from the bluffline; 3. The proposed expansion of the house footprint will be parallel to the bluffline and will not affect the riverward side or encroach into the 40 ft. bluffline setback, and the roof will not exceed the maximum height of 35 feet; 4. The proposed expansion of the existing house will require <10,000 square feet of filling and grading for excavation for the new foundation and for stormwater a infiltration trench as shown in the site plan prepared by Ogden Engineering; 16, 5. Windows and building materials on the structure meet standards in Sections17.36 G.5.c.2)a) and 17.36 H.1; ST. The existing POWTS was'const~ucted'in Decembe'r'-1970,'was inspected"iii Decembef2009; and"at"°"--- this time is not in need of modification or replacement; 7. The Town of Troy Plan Commission and Town Board approved the proposed plan in December 2009 after confirmation that the proposed expansion will be outside both the 40' bluff line and 200' OHWM setbacks. Troy's building inspector will review the construction plans and land use permit prior to issuance of a building permit for the town; 8. Steve Olson, Land & Water Conservation Dept., reviewed the application and commented'that the stormwater management plan is adequate for the site. There shall be some form of perimeter erosion, control (straw wattles, silt fence, or similar) down-gradient of all disturbed areas during construction. All disturbed areas shall be seeded with native vegetation. The stormwater management plan shall be referenced on the deed to the property; 9. Mike Wenholz from the Wisconsin Department of Natural Resources has reviewed the application and had two concerns: first, that appropriate stormwater management and erosion control plans (in Subchapter III.V, Section 17.36.H.7. of St. Croix County Ordinance) are submitted and approved by your department, and second, that vegetation management standards (in Subchapter III.V, Section 17.36.H.8.e. of St. Croix County Ordinance) are met; 10. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This land use permit approval is for the reconstruction of a conforming principal structure as indicated in the plans submitted, and as provided in the conditions below: 1The applicants shall contact the Zoning Administrator prior to commencing construction and install 20 i/erosion and sediment control measures that will intercept runoff during construction as indicated in the approved plans. 2. The applicant and their agent(s) shall comply with all inspection requirements for the building construction. 3. The finished principal structure shall not exceed the maximum roof height allowed in 17.36.G. 4. All siding, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature, with windows that are not more reflective than ordinary window glass, so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 0.5.c.2)a) and 17.36 H.1 of the Ordinance. DYlLic~Gf~~r 5. Per submitted plans, one tree designated for removal and'fwo trees will be planted after construction. Within 6 months from the date of approval, planting of replacement trees shall be completed in compliance with the schedule contained in Section 17.36.H.8 - Vegetation Management and notification provided to the Zoning Administrator. 6. The stormwater management plan must be implemented as part of the reconstruction project. The applicant shall record an affidavit on the deed to the property to provide for long-term operation and maintenance of the stormwater infiltration system. Within 30 days of substantially completing the proposed house expansion, the applicant shall submit to the Zoning Administrator certification from the contractor that the construction has been done in compliance with the approved plans. 8. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall' not exceed one year. 9. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section17.36 J.8.b of the Ordinance. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation, beyond the limits of this request. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of the Zon ng Administrator. ,Your information will remain on file in the St. Croix County Planning and Zoning Department. I did receive a copy of the Town Riverway application and read through the proposed additional work. As your application narrative points out, the expansion of the porch parallel to bluffline won't result in exceeding the allowed 1500 sq. ft. maximum footprint and complies with the land use permit conditions. I have included the modified site plan to the permit file. The changes to the screened porch can be documented in photos I typically take upon notification of project completion. Since the main project did not require County Board approval, I am making a guess that this new part of the project does not as well, and that you can pass on it at the administrative level. Please let me know as soon as possible - the Township Planning Committee will discuss October 6, and the Town Board the next week. Copy of the application to the Township is attached.
