Re: Land Use Permit for Utilities within the Road Setback, Paul Nelson
Parcel # 01.28.16.113, Town of Eau Galle
Dear Mr. Krostay:
This letter confirms zoning approval according to the plans you have submitted to construct a gas regulator within
the road setback of 60`x' Avenue on property owned by Paul Nelson in the Town of Eau Galle.
Staff finds that the proposed gas regulator meets the spirit and intent of the St. Croix County Zoning Ordinance with
the following findings:
1. Public utility housings and structures may be placed between the setback line and the highway pursuant to
Section 17.63(2) of the Ordinance.
2. The proposed regulator site will be approximately 600 square feet in area and will be located approximately
10 feet from the edge of the right-of-way of 60`x' Avenue on property owned by Mr. Paul Nelson.
3. The proposed regulator will be used to supply distribution gas to Pine Meadows, a new subdivision also
owned by Mr. Paul Nelson.
4. The proposed regulator site will be screened from 60`x' Avenue by large pine trees.
5. The pipes leading to the proposed regulator will be bored underneath the trees and will require little if any
excavating.
6. The St. Croix County Land and Water Conservation Department has reviewed the application and visited the
site and does not have any objections to the project.
7. The approval of this project meets the intent and purpose of the Ordinance and will not affect the public
health, safety and welfare of County residents.
Approval of the land use permit is subject to the following conditions:
1. Prior to commencing construction, the applicants shall secure a building permit for the gas regulator from the
Town of Eau Galle.
2. The applicants shall contact the Planning and Zoning Department prior to commencing site preparation
and when all construction is completed.
3. Prior to commencing construction, the applicants shall submit to the Zoning Administrator an agreement
in writing stating that the owner will remove the gas regulator and all other associated structures at his
own expense when necessary for road improvements.
4. Prior to commencing and throughout construction, the applicants shall implement Best Management
Practices for erosion and sediment control for any excavating or filling and grading activities according to
the Wisconsin Construction Site Best Management Practice Handbook. Permanent groundcover shall be
reestablished on all disturbed areas immediately upon completion of the construction.
5. Immediately upon completion of the construction of the gas regulator, the applicants shall submit to the
Planning and Zoning Department an as-built drawing and photos of the completed project.
6. The applicants shall have one (1) year from the issuance of this land use permit to commence construction of
the gas regulator. The applicants may request an extension of up to six months frorn the Zoning
Administrator prior to the one-year deadline. If the land use permit expires, the applicant will be required to
secure a new land use permit.
This approval does not allow for any construction or filling and grading activities beyond the limits of this
request. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please
contact the Town of Eau Galle to obtain the necessary building permits. It is your responsibility to ensure
compliance with all other local, State, or federal rules or regulations.

It is understood that said facilities located within the highway setback of St. Croix County Zoning
Regulations; that said facilities are to be relocated at the expense of We Energies when and if
necessary for the improvement of the highway.
