CROIX COUNTY, WISCONSIN Case: 45-98 Complete Application Received: September 8, 1998 Hearing Notice Publication: Weeks of October 5 and 12, 1998 Hearing Date: October 22, 1998 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicants are Bruce and Sharon Achterhof, whose address is 560 270th Street, Woodville, Wisconsin 54028. 2. The applicants on September 8, 1998, filed with the Zoning Office an application for a special exception request for a two family dwelling permit. 3. Bruce and Sharon Achterhof are the owners of the property which is the subject of the application and located in the SE 1/4 of the NE 1/4 of Section 1, T28N, R16W, Town of Eau Galle, St. Croix County, Wisconsin. 4. The subject property is currently used for a residence. 5. Special Exception request is for a two Family Dwelling permit under Section 17.15(6)(a). A special exception is required where there is a two family dwelling in the Ag/Residential District. 6. The following exhibits were presented: Exhibit 1: Special exception application Exhibit 2: Letter from the Town of Eau Galle recommending approval of this special exception Exhibit 3: Copy of soil test and septic inspection stating that soils are suitable for a duplex Exhibit 4: Photograph of property Exhibit 5: Staff report Exhibit 6: Letter from building inspector dated September 21, 1998 stating that the property meets code for a multiple family dwelling 7. Bruce Achterhof, being duly sworn, stated that he is the owner of the property. He is asking for a special exception for a two family dwelling in the ag/residential district. 8. The applicants have lived at this property as their primary residence and have rented out the other half of the residence. 9. The applicants have a buyer for the property who wish to continue using it as a duplex. The buyers need to continue to use the property as such in order to generate enough income to qualify for the financing needed to purchase this property. 10. The structure has been inspected by a building inspector and found to be code compliant for a multiple family dwelling. 11. The septic system has been inspected and is found to be code compliant. The results of the soil tests that have been taken prove that the system is treating the waste properly. 12. The Town of Eau Galle recommends approval of this application. 13. Under Section 17.15(6)(a) an application may be made for a special exception for a two family dwelling. 14. The Board of Adjustment finds that this special exception application conforms with the requirements for granting a special exception under 17.15(6)(a). DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's request for a special exception for a two family dwelling in the ag/residential district and has been approved on the following vote: D. Wert Yes Chairperson Speer Yes APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify 2 that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings which resulted in this decision was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the responsibility of the Board of Adjustment to submit its record (file) of this matter to the circuit court.
