CROIX COUNTY, WISCONSIN Case: 60-95 Complete Application Received: 9/20/94 Hearing Date: 10/27/94 Dates of Publication: Weeks of 10/10/94 and 10/17/94 FINDINGS OF FACT Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicant is the St. Croix County Highway Department, whose address is 1150 Davis Street, Hammond, Wisconsin, and owner Town of Eau Galle and Village of Woodville. 2. The applicant on September 20, 1994 filed with the Zoning Office an application for a special exception use for filling and grading on the bed of a navigable body of water. This is an after-the-fact application. 3. The Town of Eau Galle and the Village of Woodville are the joint owners of the property which is the subject of the application which is located in the NE, of the NW; of Section 2, T28N-R16W, Town of Eau Galle, St. Croix County, Wisconsin. 4. The subject property is presently unused land. 5. The property is zoned Ag.-Residential under the current St. Croix County Zoning Ordinance. 6. The Town of Eau Galle supports the application. 7. Introduced as Exhibit #1 was a copy of the specifications for the Carr Creek Bridge; Exhibit #2, State of Wisconsin Department of Transportation Plan of Proposed Improvement South Side Drive, Village of Woodville and Town of Eau Galle Carr Creek Channel Improvements, St. Croix County; Exhibit #3, packet of information; Exhibit #4, letter from the Town of Eau Galle supporting this application. 8. Roger Humphrey, St. Croix County Highway Engineer, stated that this project has been in discussion for several years. This was a concrete overpass. A couple of people have driven over this in high water and have been carried down stream. This is a liability issue. Humphrey indicated that they have secured all permits necessary except for this one. 9. This project is on the town and village line. They share jurisdictional road responsibilities; 50 percent of the project is funded through the Village of Woodville, 25 percent funded through the Town of Eau Galle and 25 percent funded through the County Aid Bridge Fund. CONCLUSIONS OF LAW The Board concludes that: 1. The Board of Adjustment has authority under Section 17.70(5)(c)4, County zoning ordinance, to approve or deny a request for a special exception use. 2. Special exception uses may be terminated as per 17.70(7)(d), County zoning ordinance, if the plan or the conditions of the decision are not followed. 3. Section 17.29(2), County zoning ordinance, allows a special exception for filling and grading on the bed of a navigable body of water. DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approves the applicant's request for a special exception use for filling and grading on a bed of navigable body of water on the following vote: Chairman Bradley Yes T. Filipiak Yes T. Dorsey Yes J. Neuman Yes. APPEAL RIGHTS This decision may be appealed by any person aggrieved by filing an action in certiorari in the circuit court of this County within 30 days after the date of filing shown below. The County assumes no liability for and makes no warranty as to the legality of any action taken by the applicant in reliance on the decision prior to the expiration of this 30-day period, or the identity of any person who may claim to be aggrieved by this decision.
