The St. Croix County Board of Adjustment conducted a public hearing on
April 22, 1986 to consider the request of Dennis L. Peterson for a special
exception use, Article 8.4 B(4)(b), Setback from a Town Road, ST. CROIX COUNTY
ZONING ORDINANCE.
The St. Croix County Board of Adjustment conducted an on site inspection
of the site in question.
After inspection, the St. Croix County Board of Adjustment entered an
executive session to discuss the request..
After returning to open session, the following decision was rendered:
Motion by Supervisor Sweitzer to approve the request as due to the terrain
there is no other area to construct the garage. Seconded by Supervisor Kinney.
Motion carried. Vote to approve: Kinney, yes;
Sweitzer, yes;
Meinke, yes.
All variances approved must be acted on or constructed within one(1) year
from date of approval or they shall be null and void.

BOARD OF ADJUSTMENT MEETING AND HEARING
April 22, 1986
9:00 - 3:30
Meeting called to order by Supervisor Meinke at 9:00 a.m. in Room B4, Courthouse,
Hudson. Present were Supervisors Meinke, Kinney, and Sweitzer.
Election of Officers:
Chairman: Meinke
Vice Chairman: Kinney
Secretary: Sweitzer
Minutes of the March meeting and hearing approved as read.
Hearing called to order by Chairman Meinke. Chairman Meinke set the guidelines
for the hearings. Zoning Administrator read notice of the hearings as published
in the local newspapers.

1. Mr Richard Carlson presented his request to place rip rap and stabilize the
shoreline of his property. Zoning Administrator read letter from D.N.R. having
no objection. Mr. Steve Johnson, MN-WI Boundary Area Commission, has no objec-
tions, explaining his reasons for not objecting. Mr. John Pflieder presented his
objections to the project, but has no objections to the rip rap.
2. Mr. Don Boumeester presented his request for a dog kennel on his property,
with 20 runs inside an insulated pole building. The use of the structure would be
for boarding and training dogs. Mrs. James Dalton has no objections. The following
spoke in opposition of the kennel;; 1. Michael Rivard, 2. Margaret Weppner,
5. John De Rosier, 6. Robert Montang.
3. Steve Daniels, 4. Benjamin George,
A petition was presented to the Board opposing the kennels. Mr. Boumeester rebutted
the remarks of the opposition. Mr. Rivard rebutted the remarks of Mr. Boumeester.
Mrs. Weppner would like to see the liability of Mr. Boumeester. Mr. Boumeester
rebutted the remarks, and invited the Board to see how he controls the dogs.
3. Mr Stewart Lentz presented his request to construct a pole building that would
be 106 feet from the centerline of a town road. The building would be Wilbur ehind the
existing tree line and will be replacing the present building. ggren,
speaking for the Town Board, has no objections. Zoning Administrator read letters
having no objections. He also received a telephone call from an adjoining land-
owner having no objections.

4. Mr. Don Drews presented the request of Wisconsin Bell to construct a telephone
sub-station, explaining the need for the building. The building will be 8 X 10, brick.
5. Mr. Sam Vicker presented the request of American Asphalt to construct a tempor-
ary asphalt plant in the county. The asphalt will be for countyand town roads, and
will be in existance for approximately 60 days. Thomas O'Keefe, County Highway
Commissioner, feels that the plant is necessary for road maintenance.
6. Mr. Dennis Peterson presented his request to construct a garage 90 feet from the
centerline of a town road due to the slope of his land.
Hearing recessed for inspection of the properties in question.
Board returned to session, and rendered the following decisions:
1. RichardCarlson: Motion by Supervisor Kinney to approve the request to preserve
the shoreline and bank (rip rap only). Construction may start upon approval from
D.N.R., and U. S. Corps of Engineers. County Zoning Office to inspect upon completion.
No more trees can be removed unless approved in writing from the County Forester.
Seconded by Supervisor Sweitzer. Motion carried. Vote to approve: Kinney, yes;
Sweitzer, yes; Meinke, yes.
2. Don and Julia Boumeester: Motion by Supervisor Meinke to deny the request due
to neighbor objections, noise factors, dogs running loose, gun shots from dog
training. The construction cannot meet the required setbacks stated in the County
Zoning Ordinance. Seconded by Supervisor Kinney. Motion carried. Vote to deny:
Meinke, yes; Kinney, yes; Sweitzer, yes.
3. Stewart Lentz: Motion by Supervisor Kinney to approve the request as it will
cause no adverse effect of the area. The structure will replace the old stucture
which is being removed. Seconded by Supervisor Sweitzer. Motion carried. Vote to
approve: Kinney, yes; Sweitzer, yes; Meinke, yes.
4. Wisconsin Bell: Motion by Supervisor Sweitzer to approve the request as the
additional telephone service is needed in the county. Seconded by Supervisor Kinney.
Motion carried. Vote to approve: Sweitzer, yes; Kinney, yes; Meinke, yes.
5. American Asphalt of Wisconsin: Motion by Supervisor Kinney to approve the request
due to the necessity of blacktop for county and township roads. Seconded by Sup-
ervisor Sweitzer. Motion carried. Vote to approve: Meinke, yes; Kinney, yes;
Sweitzer, yes.
6. Dennis Peterson: Motion by Supervisor Sweitzer to approve the request as due to
the terrain there is no other area to construct the garage. Seconded by Supervisor
Kinney. Motion carried. Vote to approve: Kinney, yes; Sweitzer, yes; Meinke, yes.
A special hearing is scheduled for April 29, 1986 at 10:00 a.m. The next regular
hearing date is May 27, 1986 at 9:00 a.m.
Motion by Supervisor Sweitzer to adjourn. Seconded by Supervisor Kinney. Motion
carried. Meeting and hearing adjourned at 3:30 p.m.
