CROIX COUNTY, WISCONSIN Case: 33-02 Complete Application Received: September 12, 2002 Hearing Notice Publication: Weeks of October 7 and 14, 2002 Hearing Date: October 24, 2002 Decision Date: December 18, 2002 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicants are Kevin and Dayna Grant, whose address is 100 Squirrels Run, Woodville, WI 54028. The property address is 250' Street, Glenwood City, WI. 2. The properties are located in the SW'/4 of the NW 1/4, Section 35, T30N-R16W, Town of Emerald, St. Croix County, Wisconsin. 3. The Special Exception request is for a permit to construct a private airstrip in the Ag/Residential District pursuant to Section 17.15(6)(p). 4. The applicant is working with the FAA and the Wisconsin Department of Transportation to obtain all permits necessary for this airstrip. 5. The Board of Adjustment found that this special exception application conforms with the requirements for granting a special exception under Section 17.15(6)(p). 6. The Board of Adjustment found that the spirit and intent of the ordinance would be met by granting this special exception permit. DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's request for a special exception permit for a permit to construct a private airstrip and hangar in the Ag/Residential District and has been approved based on the following findings: 1. The Town of Emerald has recommended approval of the request. 2. The Department of Transportation- Bureau of Aeronautics has recommended approval in a letter dated December 17, 2002. 3. The Federal Aviation Administration has recommended approval in a letter dated December 16, 2002. 4. The Board finds that the concerns brought up by landowners at the October 24, 2002 hearing have been addressed. 5. The airstrip is being located on a remote piece of property that is 59 acres in size. 6. The Board finds that the spirit and intent of the ordinance would be met by granting this request. With the following conditions: 1. This approval allows Kevin Grant (the applicant) to maintain a private airstrip as submitted in the application and presented at the public hearing for his personal use. 2. The applicant must comply with the ordinance standards regarding private airstrips (see attachment). 3. Touch and go's are to be limited to the use of the owner. 4. This approval does not allow the applicant to use the airstrip for ultra lights (aircraft). 5. The applicant must keep a flight log of all users of the airstrip. The flight log shall be available for Zoning Staff to review periodically to ensure the airstrip is predominantly being used as a private airstrip. 6. The applicant must construct the primary residence on this property within one year of the special exception permit issuance date (January 2004). 7. The applicant shall submit a statement indicating that the applicant shall be strictly liable for any and all damage caused to any person or property by the operation of any aircraft to or from the airstrip in question. 8. Comply with all DOT and FAA requirements and obtain any permits necessary. 9. The applicant shall have one (1) year from the issuance of the Special Exception permit to commence construction. If the Special Exception permit expires, the applicant will be required to secure a new Special Exception permit before the mechanical lift can be constructed. 10. Any minor change (or addition) in expansion of the project, shall require review and approval by the Zoning Director. Any major change and/or addition to the originally approved plan will go through the special exception approval process, where applicable, as stated in the ordinance. 11. These conditions may be amended or additional conditions may be added if unanticipated conditions arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 12. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. The following vote was taken to approve: Rose, yes; Krueger, yes; Golz, yes; Peterson, yes; Chairperson Speer, yes. Motion carried. 2 APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(10), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings, which resulted in this decision, was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwestern Court Reporters, Hudson, Wisconsin.
