Motion carried unanimously. Findings of fact: The reduced setback would not violate the public interest in terms of health and safety. ' Granting this waiver would be consistent with the preservation and enjoyment of substantial w k' property rights. Lot 1, CSM vol Code Administration Dear Mr. Rigwald, 715-386-4680 I have determined that your project to construct a 400 square foot attached or Land Information detached garage, a 224 square foot sunroom, and a 60 square foot addition will not Planning 715-386-467 require a land use permit under the Shoreland or General Zoning grading provisions. The total disturbed are will be less than 1000 square feet and the Real Pperty slopes based on the topographic maps are less than 12%. 715-386-4677 Your proposal may need modification to comply with structure setbacks. This lot Rtycling has a previously platted 100 foot setback from the right of way, which is also 133 715-386-4675 feet from the centerline of 112 th street. This previously platted setback takes precedence over the current 50-foot setback requirement. By using a scaling ruler on your drawing the sunroom and porch encroach on the 100-foot setback by approximately 5 feet. This measurement is "to close to call" and you should do an onsite measurement for more accurate results. Once you verify the distance you may have to modify your addition to comply with the 100-foot setback or a setback reduction can be applied for $825. Your proposal meets the required 75-foot setback from the ordinary high water mark. The existing sewer system will not be in an area that will be disturbed. This decision was based on the site plan and building specifications that you submitted to the Planning & Zoning Department on January 29, 2009 and a review of the topographic maps.
