The St. Croix County Board of Adjustment conducted a public
hearing on August 26, 1980, to consider the request of Robert Muller for
a special exception use, Article 2.6F13, Airports/Airstrips, ST. CROIX
COUNTY ZONING ORDINANCE.
The St. Croix County Bbard of Adjustment conducted an on-site
inspection of the site in question.
After inspection, the St. Croix County Board of Adjustment entered
an Executive Session to discuss the request.
After returning to open session the following decision was rendered:
Motion by Supervisor Handlos to deny the request for a private ,
airstrip. Seconded'by Supervisor Meinke. Motion carried. Vote to deny:
Handlos, yes
Meinke, yes
Pierson, yes, 4
The reason for denial is that the neighbors on both ends of the air-
trip object, the 800 foot setback from the powerline would not give the
airstrip the required 2,000 foot runway and there are airstrips and air-
ports within a 15 mile radius that Muller can use.

APPEAL TO BOARD OF ADJUSTMENT

Please take notice that Robert Muller is appealing the
decision of the Board of Adjustment dated August 26, 1980, denying
the said Robert Muller his request for a private airstrip.
The appeal is based on the facts that Mr. Muller's
request for special exception use as to airstrip was refused by the
Board of Adjustment: without any substantiated testimony by the
objecting land owners; that the conclusion that requirements as to
the 2000 foot runway could not be met is in error; that the board
arbitrarily concluded that other airstrips would suffice for his
purpose.
Mr. Muller respectfully requests that a hearing be set
for the purpose of rehearing his application.

CERTIFICATE OF AIRPORT SITE APPROVAL
The Wisconsin Department of Transportation, pursuant to Section
114.134, Wisconsin Statutes, hereby issues a Certificate of Site Approval
to ROBERT J. MULLER for the location of an airport, known as MILLER
Airport, in Section 1, T30N, R17W, Town of Erwin Prairie, St. Croix
County as described in Application for Airport Site Approval dated
January 18, 1980
This Certificate is issued subject to the following conditions:
(1) The above site is approved for a private use airport only.
(2) Aerial approaches to all runways shall clear all public roads,
highways, railroads, waterways, and other traverse ways in accordance
with Section 114.134(2), Wisconsin Statutes.
(3) This Certificate shall expire eighteen months from the date -
issued below if the airport has not been completed. The applicant may
request additional time to complete the airport and the Department of
Transportation may issue an extension or require the applicant to
submit a new Application for subsequent determination.
(4) This Certificate is issued and based upon the determination by
the Department of Transportation that the above location for the proposes:
airport is compatible with existing and planned transportation facilities
in the area. This determination in no way preempts or waives any
ordinances, laws, or regulations of any other governmental body or
agency.
(5) In the event the above location is no longer used as an
airport, the owner shall notify the Department of Transportation imme-
diately, and the Certificate will expire three months after such notice
is received.

Dear Property Owner:
The Board of Adjustments for St. Croix County will be conducting a public
hearing on August 26 1980 , in the County Board Room, at the Court
House in Hudson, Wisconsin regarding a request by' Robert J. Muller
of New Richmond,'WI, to allow an airstrip on his real estate, more particularl
described as E2 SE4 SEC 1, T30N Town of Erin Prairie St. Croix
R17W
County, Wisconsin. On that date, the Board of Adjustments will consider evide
both pro and con, concerning whethex.or not the Board should allow such an
airstrip on that real estate. You are invited to personally attend the public
hearing so that the Board can listen to your views concerning this proposal.
You should also be advised that you have certain rights as an adjacent
property oxmer to such an airstrip. You have the right to object to the
board of Adjustments to the granting of such a request, if your objection is
reasonable. You have the right to be compensated by the airstrip owner if the
airstrip is too close to your land or interferes with a building or the
construction of a building on your land.
After the-airstrip may have been allowed, you have the right to file
a written complaint with the Board of Adjustments concerning, any legitimate
nrohlem you may be having with the airstrip, during the two year period that
the airstrip would be licensed. You also have a right to complain to the
Federal Aeronautics Administration concerning problems which you may have
with either the airstrip or any pilots of airplanes using such airstrip.
Finally, you should be made aware, that owners of airstrips may have limited
rights to remove encroachments, interfering with their airstrips, even on
adjacent real estate.
Again, if you choose to do so, you may attend the public hearing
concerning this request to allow an airstrip on the real estate mentioned
above, and you may voice your concerns to the Board of Adjustments, if you hav
any. If unable to attend you may voice your opinion and concerns in writing,
to be read at the Board of Adjustments. If you have any immediate questions,
please contact the Zoning Administrator in Hammond, Wisconsin at 796-2239.
