The St. Croix County Board of Adjustment conducted a public hearing
on August 25, 1981 to consider the request of Robert Muller for a special
exception use, Article 2.6 F 13, Private Airstrip, ST. CROIX COUNTY
ZONING ORDINANCE.
The St. Croix County Board of Adjustment conducted an on-site
inspection of the site in question.
After inspection, the St. Croix County Board of Adjustment entered
an Executive Session to discuss the request.
After returning to open session, the following decision was rendered:
Motion by Supervisor Handlos to give approval on condition that he
receive approval from the St. Croix Electric Co-op and state approval
in relation to the powerline, and the written approval be given to the
Zoning Administrator for the records. Seconded by Supervisor Meinke.
Motion carried. Vote to approve.

Enclosed you will find two copies of the Hold Harmless Agreement you
agreed to sign upon approval of your airstrip by the St. Croix County
Board of Adjustments. Please have you and your wife sign one of the
copies and send the same to Harold Barber so that it may be kept in
his file on the matter. You may keep the remaining copy for your
records.

AGREEMENT INDEMNIFYING ST.. CROIX COUNTY
The undersigned, Robert and Nancy Muller in
exchange for approval by the St. Croix County Board of Adjustments
for a private/personal airstrip, as a special exception to Agricul-
tural-Residential Zoning under the St. Croix County Zoning Ordinance,
hereby agree(s) to indemnify and hold harmless St. Croix County, the
St. Croix County Board of Adjustments, and their agents and employees,
against all loss, cost, damage, or liability on account of any injury
or damage to persons or property occurring from any aircraft operating
either to or from the above mentioned airstrip. This agreement is exe-
cuted by the undersigned pursuant to Paragraph 14 of the Airstrip Stan-
dards used by'the St. Croix County Board of Adjustments as of the date
of approval of the above mentioned airstrip.

CERTIFICATE OF AIRPORT SITE APPROVAL
The Wisconsin Department of Transportation, pursuant to Section
114.134, Wisconsin Statutes, hereby issues a Certificate of Site Approval
to ROBERT J. MULLER for the location of an airport, known as MULLER
Airport, in Section 1, T30N, R17W, Town of Erwin Prairie, St. Croix
County as described in Application for Airport Site Approval dated
January 18, 1980
This Certificate is issued subject to the following conditions:
(1) The above site is approved for a private use airport only.
(2) Aerial approaches to all runways shall clear all public roads,
highways, railroads, waterways, and other traverse ways in accordance
with Section 114.134(2), Wisconsin Statutes.
(3) This Certificate shall expire eighteen months from the date
issued below if the airport has not been completed. The applicant may
request additional time to complete the airport and the Department of
Transportation may issue an extension or require the applicant to
submit a new Application for subsequent determination.
(4) This Certificate is issued and based upon the determination by
the Department of Transportation that the above location for the proposed
airport is compatible with existing and planned transportation facilities
in the area. This determination in no way preempts or waives any
ordinances, laws, or regulations of any other governmental body or
agency.
(5) In the event the above location is no longer used as an
airport, the owner shall notify the Department of Transportation imme-
diately, and the Certificate will expire three months after such notice
is received.

Dear Mr. Muller:
This is in reply to your letter of August 27, 1931 requesting our opinion as to
whether we would object to yonr use of an airstrip on your property located
in Section 1, Erin Township, St. Croix County, Wisconsin.
The drawings you have furnished us indicate that you are aware of the existing
electric line located along the south: border of your property.
Your letter also :indicates your intention of crossing well above our electric
line while using the airstrip (in particular, as the air approach is from the
south).
The Cooperative has no jurisdiction over the granting of or refusal of permission
to use a private airstrip. We are concerned about the safe operation of our
electric system as well as your welfare and that of the general public.
It would appear that.your planned use of the airstrip would not Interfere with
our electric lines. We would voice no objection as long as the regulatory
bodies of St. Croix County and the State of Wisconsin grant all necessary
approvals.
