CROIX COUNTY, WISCONSIN Case: 43-97 Complete Application Received: May 20, 1997 Hearing Notice Publication: Weeks of June 9 & June 16, 1997 Hearing Date: June 26, 1997 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and conducted an on-site inspection, the Board finds the following facts: 1. The applicants are Farmers Co-op, 930 10th Ave. Baldwin, Wisconsin 54002, and Equity Co-op, 116 E. Birch St., Amery, Wisconsin 54001. 2. The applicants on May 20, 1997, filed with the Zoning Office an application for a special exception request for an agricultural/management service center. 3. The Weeks Estate, Lyle Weeks, Administrator, is the owner of the property which is the subject of the application and is 51 acres located in the SW 1/4 of Section 32, T31N, R16W, Town of Cylon, St. Croix County, Wisconsin. 4. The subject property is currently used for crops. 5. Special Exception request is for a permit for an agricultural/ management center in a commercial district under Section 17.18 and 17.18(1)(a). A special exception is required where there is any agricultural/management center. 6. Ken Weiske, being duly sworn, stated that he is the General Manager of the co-op in Baldwin, and they are partners with the Amery co-op in the Ag Service Center being proposed on Highway 63 and County Road S. It is believed that this new ag service center will meet the needs of a wide area of the population. Weiske said that it will be a state of the art facility with plans to protect the environment. 8. The fertilizer plant will include activities in the storage and mixing/blending of dry fertilizers, crop protection products and liquid fertilizers. Seed and anhydrous ammonia will also be available for sale. Equipment maintenance would be done on site. 9. Future uses may include retail lawn and garden business, bulk feed ingredients, salt, grain drying and storage, bagged feeds, pet food and sales of farm related items such as fencing, hardware and livestock supplies and equipment. To expand the plant for these uses, the applicants will need to return to the Board of Adjustment for approval. 10. The land is in a commercial district. 11. The Town of Cylon has approved this application with conditions. 12. Under Section 17.18 and 17.18 (1) (a) an application may be made for a special exception for an agricultural /management center in a commercial district. 1.3. The Board of Adjustment finds that this special exception application conforms with the requirements for granting a special exception under 17.18 and 17.18(1)(a). _ DECISION On the basis of the above Findings of Fact, Conclusions of Law, and the record herein, the Board approved the applicant's request for a special exception for an agricultural /management center in a commercial district and has been approved on the following vote: T. Neumann Yes Chairman Bradley Yes with the following conditions: 1) Establish ownership 2) Permit to be granted to Equity Co-op and Farmers Co-op for activities in the storage and mixing/blending of dry 2 fertilizers, crop protection products and liquid fertilizers. Seed and anhydrous ammonia may be available for sale. Equipment maintenance may be done on site. Any future uses must be presented to the Board of Adjustment for approval. 3), Company owners and operators to be responsible for meeting all Federal, State, and County regulations governing the transportation and storage of all hazardous materials. 4) Company owners and operators shall immediately notify appropriate Federal, State, County and Town authorities of all spills or releases of hazardous materials. 5) Company owners and operators to be responsible for clean up of hazardous materials spills or releases that are located on or off the site of that migrate from the site to neighboring properties. Company owners and operators shall be responsible to mitigate the effects of hazardous materials spills on neighboring properties. 6) State approved plans to be submitted to zoning office before construction. 7) Notify zoning office of start of construction. 8) Paving of 25 feet wide hard surface and per zoning ordinance: 20 feet of hard surfacing per building resulting in 40' of hard surface between buildings as follows: 20' on all 4 sides of new building 40' of surfacing between buildings 9) Special Exception permits may be terminated under Section 17.70(7)(d) of the St. Croix County Zoning ordinance if the plan or the conditions of the decision are not followed. APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694(10), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons 3 legally entitled to notice of the Board of Adjustment proceedings which resulted in this decision was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwestern Court Reporters, Hudson, Wisconsin.
