Planning This letter confirms zoning approval according to plans submitted on August 16, 2010
715-386'4674 for the following activities that require a land use permit:

Lower St. Croix Riverway District in the Town of St. Joseph pursuant to Section

Re,-yeling 17.36.F.2.a.9) of the St. Croix County Zoning Ordinance and standards pursuant
715-386-4675 to Section 17.36 G. and H.
According to the plans you submitted on August 24, 2010 and June 24, 2011 the
proposed project consists of construction of a 32 foot by 40 foot garage and 16 foot by
18 foot breezeway. The old garage will also be relocated to the southeast corner oft the
lot.
Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and
the Lower St. Croix Riverway District based on the following findings:
1. The property consists of a 0.59 acre lot zoned Ag/Residential and is in the
Riverway District.

2. The proposed accessory structure is 20 feet high is 200 from the OHWM of the St.
Croix River and is 25 feet from the side lot line. In addition the structure is not
visible from the river, is not in a slope preservation zone, is earth tone in color and
is visually inconspicuous and can therefore be located 40 feet from the bluff line.
Based on these findings this request complies with Section 17.36 G. 4. 5. of the
Lower St. Croix Riverway District.

4. The proposed relocation of the existing garage will be located approximately 100 feet from the bluff line
and 00 feet from the OHWM of the St. Croix River. With conditions the relocated garage is 25 feet
from ast and south side lot lines, this request will and comply with provisions in 17.36 G 5.
5. Th ` osed relocation of the existing garage will not be in a slope preservation zone, will be

1. The applicants shall contact the Zoning Administrator prior to commencing construction
and install erosion and sediment control measures indicated in the approved plans.
2. Prior to commencing construction, the applicants and/or their general contractor shall
`g obtain any other permits required, including but not limited a building permit from the
Town of St. Joseph.

construction project.
5. All areas of disturbed soil must be stabilized with temporary cover to prevent erosion
until permanent vegetation consisting of native species can be established per
17.36.H.7.e.4 and 17.36.H.8.
6. Within 30 days of substantially completing the proposed building construction, the
applicant shall submit to the Zoning Administrator certification from the contractor that
the construction has been done in compliance with the approved plans along with photos
of the completed project and a recorded copy of the affidavit describing the required
maintenance for the infiltration basin.
A 7. All activities approved as part of this land use permit shall commence within one year
from the date of approval and be substantially completed within two years, after which
time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to
expiration, the applicant may request extensions of up to six months from the Zoning
Administrator. The total time granted for extensions shall not exceed one year.

Moving the existing garage and locating it 5 feet from both property lines, as you originally proposed, will
work in your case. We looked at the definitions and the location where you are placing the garage is in
the front yard.

Hi Alex,
Would the 25 foot setback apply to the southeast corner of our lot if that were defined as a rear yard
rather than a side yard? I looked at the definitions in zoning chapter 17 09 with regard to yards and
realize that we have a unique situation with our parcel since its original access was from County Road E
and now is from State Street, (but is somewhat landlocked with respect to a front yard and in respect to
the neighborhood this corner adjoins all other properties rear yard).
It doesn't seem to make sense to have a garage in the middle of our lot when all three of our neighbors
have their garages/sheds within 5 feet of the southeast corner of our property.

The height will be 20 feet and the color will be earth tone.
We are still working out the design and don't have it finalized yet but will be sure that the height does not
exceed 20 feet and that the color is an earth tone as noted in the ordinance.

We are requesting approval to construct an attached garage and breezeway to our existing
home at the above referenced address. Sanitary and private water are currently provided
to the existing structure and no new services are planned. We are also planning to
relocate the existing garage to the southeast corner of the property.
The property is located with the Riverway District; however, the proposed garage is not
visible from the river. In addition, it will be located over 40 feet from the western
property boundary, which is beyond the required bluifline setback.
