According to the plans you submitted, the proposed remodeling consists of demolition of a small portion of the existing house, elevate the house, excavate and construct a basement foundation under the structure, reset the house on the new foundation, and connect the structure to a replacement Private On-site Wastewater Treatment System (POWTS) that will be installed on the lot. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 1.70 acre lot, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The existing house was built in the 1960's with a crawl space/slab foundation, is greater than 200 feet from the OHWM of the St. Croix River, greater than 25' from any property line, and is 40 feet from the bluffline; 3. The proposed reconstruction of the house will be a minor modification of the previous footprint that will not affect the riverward side or encroach into the 40 ft. bluff line setback, and the roof will not exceed the maximum height of 35 feet; 4. The proposed remodeling of the existing house will require <10,000 square feet of filling and grading for excavation for the basement foundation and a replacement POWTS; a, ST. The Town of St. Joseph building inspector will review the submitted plans and land use permit prior to issuance of a building permit for the town; 7. Steve Olson, Land & Water Conservation Dept., reviewed the Michael Givens land use permit application and conducted a site visit on December 18, 2009. The stormwater and erosion control plant adequate for the site. The department recommends the erosion control is maintained until disturbed areas are fully re-vegetated. The applicant should record a stormwater operation and Intenance agreement on the deed to the property. In addition, it appears that some tree trimming and possible clearing has taken place on the slope preservation zone. Chapter 17.36 H.8.e.j;does not allow for clearing or vegetation removal in the slope preservation zone. The LWCD recommends the applicant provide additional trees in the slope preservation zone to replace any trimming that has taken place; 8. The Wisconsin Department of Natural Resources has reviewed the application and recommended that the site's exposed soil be seeded and mulched as quickly as possible after grading has been completed. No Chapter 30 permit is needed, however DNR agrees with LWCD vegetative management requirement for replacement of trees in the slope preservation zone. Section f 17.36.8.e.1) states "Vegetation on lands within the OHWM setback, bluff line setback, and the slope preservation zone shall be left undisturbed" unless approved by a DNR forester; 0. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This land use permit approval is for the reconstruction of a conforming principal structure, as indicated in the plans submitted, and as provided in the conditions below: r Q y Zd 1. The applicants shall contact the Zoning Administrator prior to commencing construction and install tirosion and sediment control measures indicated in the approved plans. 2. trbuilding ing construction the applicant and their agent(s) shall comply with alinspection requirements for construction and installation of the replacement POWTS. 3. The-finished principal structure shall not exceed the maximum roof height allowed in 17.36.G. 4. The stormwater management plan must be implemented as part of the reconstruction project and included in the certification requirement in Condition #5. The applicant shall record an affidavit on the deed to the property to provide for long-term operation and maintenance of the infiltration system. - - - 5. Within 6 months from the date of approval, planting of replacement trees shall be completed in compliance with the schedule contained in Section 17.36.H.8 Vegetation Management and notification provided to the Zoning Administrator. 6. Within 30 days of substantially completing the proposed house remodeling, the applicant shall submit to the Zoning Administrator certification from the contractor that the construction has been done inompliance with the approved plans. 8. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 1: 9. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. Any remaining site work above and beyond what is identified as part of this land use permit application shall be subject to the review and approval of e Zoning Administrator.
