H PARCEL #03.31.18.62B, TOWN OF STAR PRAIRIE Planning 715-386-4674 Dear Mr. Scrivener: Real Property, 715-386-4677 This letter confirms zoning approval according to the plans you have submitted to construct a stairway and landing attached to an existing nonconforming Recycling principal structure in the Shoreland District of Cedar Lake in the Town of Star 715-386-4675 Prairie. Staff finds that the proposed accessory structure meets the spirit and intent of the St. Croix County Zoning Ordinance and Shoreland District with the following findings: 1. Single-family dwellings, accessory structures, and additions to existing structures are allowed with a land use permit in the Shoreland District pursuant to Section 17.35(2) (b) of the St. Croix County Zoning Ordinance; 2. The proposed stairway and landing will be attached to the principal structure's second story on the landward side of the building. The proposed stairway is outside the averaged setbacks from the OHWM of Cedar Lake per Section 17.31(2) and from the road per Section 17.60.6.c; 3. No filling and grading are planned for this project; 4. The St. Croix County Highway Department has reviewed the plans and visited the site, and taken measurements to verify that the location of the stairway will meet the averaged setback to CTH H; 5. County staff finds that the St. Croix County Zoning Ordinance does not specifically address nonconforming structures in the Shoreland District, but that the proposed addition will be under 50 percent of the equalized assessed value of the structure consistent with NR 115 Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicants shall notify the Zoning Administrator prior to commencing construction and when all construction is completed. 2. The applicant shall obtain all permits and approvals for this project, including but not limited to a building permit from the Town of Star Prairie. 3. The stairway shall remain within the averaged setback to CTH H as shown in approved site plan. ST. The proposed deck would end up being about 42 Ft. from the centerline of H. The house immediately east of the project location (#1162) is only 34 Ft. from the centerline with the next 3 cabins to the east ranging between 30 to 27 Ft. from the centerline. Fire number #1158 immediately to the west has a setback of 44 Ft. from the centerline with the next three cabins to the west ranging from 44 to 38 Ft. Hopefully this information will help you in your decision making process, and please let me know if you have any other questions. Also present: Tom Heintz, Patty Schachtner, Steve Lewis and Doug Rivard. Meeting called to order 6:43 p.m. Discussion of a Land Use Permit Application from John Scrivener, 1160 County Road H, New Richmond, WI. Scrivener wishes to add a stairway/landing/fire escape to the south side of his cabin. Motion by Kathy M and seconded by Deb R to recommend the Town Board deny the request due to a non-compliant setback of six foot X fourteen foot deck to County Road H, not necessary to a minimum compliant fire escape. Motion carried. Motion to adjourn made by Jeff L and seconded by Deb R. Motion carried Public Hearing - Comprehensive Plan Star Prairie Town Hall August 24, 2010, 7 P.M. Question and answer session. Ellen Denzer, Senior Planner for the St Croix County Planning and Zoning Department assisted in answering questions from the public. Members of the Plan Commission and Town Board member were also introduced. Public Hearing - Comprehensive Plan. Meeting was called to order at 7:40 P.M. with a motion by Jeff P. and seconded by Jeff L. Motion carried. Public was given the opportunity to make comments on the Comprehensive Plan. Comments were received both verbally and in written statements. The following comments/changes were received: Ellen Denzer, Senior Planner, St. Croix County Planning and Zoning. Presented corrections to the Comprehensive Plan. See corrections below: 1. Typos on front cover. 2. Acknowledgements - update list of Star Prairie Town Board supervisors. 3. Town Clerk and Treasurer names updated. 4. Added "Introduction" to page 5 5. Added "agricultural enterprise area designation" on page 137 and on page 243. 6. Added a new section pertaining to the Squaw Lake Agriculture Enterprise Area (14 pages, including a map). Leon Orr, owns property along 220th Ave, east of County Road C and on the west side toward the river. The property along 220th Ave., on the east side of County Road C was subdivided. Four lots of the 80 acres were filed as a CSM with St. Croix County and the Town of Star Prairie last fall. Orr requests that these lots be shown as Rural Residential (yellow), just as it is across the road on the west side of County Road C. This would prevent any future confusion as to what those 4 lots are planned and zoned for. His second request dealt with 15 acres on the west side of County Road C, west of 127th Street. This area is part of an earlier subdivision development worked on with St. Croix County and the Town of Star Prairie. Unfortunately, the economy forced Orr to halt the project. The land south of 127th Street is correctly shown as Rural Residential (yellow). However the 15 acres on the north side of 220th, which part of the development, is not marked correctly. He requests that this also be shown as Rural Residential (yellow). Allen Campeau stated that the Future Land Use Map shows his property in the New Ag Enterprise area even though the County and the State says his property is not in it. If the State or County does not recognize it, where does that put his property? Campeau does not see any advantage of being in Agriculture/Forestry if the State does not recognize his property. Eric Wolf owns property along Brave Drive, and to the west. His property was previously considered "Open Space", but now is has changed to Mixed Rural/Conservation Design and the back corner of his property is considered Open Space. Wolf requests that the Open Space portion of his land be changed to Rural Conservation Design. Bruce Emerson, wishes to have his 40 acre parcel of land on 220th Street be listed as Ag Residential or Conservation Design Residential or mixed-use. He would like to put some lots in the 10 acres of woods. This is very low class farm land and should not be held out for farm use only. Emerson did not request it to be farm only and he has spoken at meetings not to have it locked-in to Ag only. Motion to close Public Hearing was made by Jeff L. and seconded by John H. Motion carried. 7:53 P.M. Public Hearing - Road and Driveway Ordinance Star Prairie Town Hall August 24, 2010 Question and answer session preceded the Public Hearing. Motion made by John H and seconded by Jeff L to open the Road and Driveway Ordinance - Public Hearing. Motion carried 8:12 P.M. No comments were received. Motion to close Road and Driveway Ordinance - Public Hearing was made by Mike B and seconded by Deb R. Motion carried. Resolution to Recommend Adoption of the Town of Star Prairie 2010-2030 Comprehensive Plan. Motion by John H and seconded by Deb R to table the Comprehensive Plan Resolution pending further review of the requested changes made by Ellen Denzer, Leon Orr, Allen Campeau, Eric Wolf and Bruce Emerson. Motion carried. Special Meeting of the Plan Commission to take place on August 30, 2010, 7:00 P.M. at the Star Prairie Town Hall. Town of Star Prairie Road and Driveway Ordinance. Motion by Kathy M and seconded by Jeff P to recommend adoption of the Road and Driveway Ordinance to the Town Board. Motion carried Motion to adjourn made by John H and seconded by Jeff L. It has been disheartening how the lack of communication has now led us to two distinct decisions brought forward to the Town of Star Prairie for action by St. Croix County Zoning for review/approval, then moved forward for decision to the board of adjustments with no regard to the Town's position. The town has in both instances worked in good faith to comply with the requested time lines established by the County. It is important to work as a team in support of our common mission, to promote and protect public health, environment, safety, and general welfare and to further maintenance of safe and healthful conditions for the people and communities within the Town of Star Prairie, a community of St. Croix County. We must strive to promote better communications in future requests to ensure all government entities impacted by these decisions have been able to pay due diligence to their respective processes in an expedient manner and proper communications and notifications have been met by all to ensure approving bodies have had opportunity to forward their concerns before final approval of the County. In future requests of St. Croix County to review for input/approval of variances, special exceptions, CSM's, permitting, etcetera by the Town of Star Prairie: 1. We would request an opportunity for final communication, albeit in writing or verbal, by both the Town and St. Croix County Zoning, to ensure our concerns are addressed and brought forward to the Board of Adjustments for their review prior to their decision. 2. We would request you to refer the requestor of application to the Town for compliance with our review process so as to expedite their review. Thank you.
