According to the plans you submitted, the proposed project consists of razing an existing nonconforming 2-car garage and reconstructing a 3-car garage over the expanded slab footprint, which will not meet the 25 foot side yard setback required in Section 17.36.G.5.c.3). Staff finds that the proposed project activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: ' 1. The property consists of a 1.16 acre lot, is zoned Ag/Residential, and is Yr located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The proposed garage will be more than 200 feet from OHWM of the St. Croix River, above the 693' floodplain elevation, will not impact slope preservation zones, and is outside the 40' bluffline setback; y~Mf 3. The peak of the roof for the proposed garage will be 22 ft. 4 inches, which does not exceed the maximum height pursuant to Sections 17.12(5) and 17.36.G.4.a.3); 4. St on, Land & Water Conservation Dept., reviewed the application and found that the pro stormwater mitigation plan for the site is adequate to infiltrate runoff as required in Sect 17.36.H.7.d. 8. The consin Department of Natural Resources has reviewed the application and commented that th arage must meet standards listed in Section 17.36.1.3.b 1 - 7) for nonconforming access structures, including implementation of mitigation measures. 9. The applicants shall contact the Zoning Administrator prior to commencing construction and comply with inspection requirements for the building. It is understood that this garage will be r accessory use only and cannot be used as a second dwelling on an Ag Residential lot. 2. All tivities approved as part of this land use permit shall commence within one year from the of approval and be substantially completed within two years, after which time the permit xpires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may equest extensions of up to six months from the Zoning Administrator. The total time granted or extensions shall not exceed one year. ST. The footprint of the structure cannot go any closer than the original building pad to the lot line as per the approved plans. It is being expanded toward the road and interior of Bill's lot according to the mitigation plan. We can do an on-site if you like, but there is no need for a variance based on county General and Riverway ordinances.
