Thanks, I received the non-interference letter.
In reference to the land use permit, we can't issue the permit until the structural modifications are installed
and certified by the engineer.
In reference to the landscaping plan; you never submitted one. I received a copy of the plan from the
Richmond site and then was asked to produce an estimate for installation of the required landscaping at
the Glenwood site. I did the estimate for the Glenwood site based on the plantings at the Richmond site.
If you have a different plan, we will look at it.

Alex,
You are correct about the structural showing that without reinforcement the tower would fail. In
the conclusion section of the report it states that after the modifications are completed the tower
would be able to support AT&T's additional antennas. I am attaching a copy of the proposed
modifications that AT&T is required to do to bring the tower into structural compliance. American
Tower would not allow us to lease space on their tower is the tower did not pass "Structurals".

That said, if you want to condition your zoning approval upon completion of the tower modifications, that
is fine with us. We're just about there ...the only question is the number of plantings you are requiring. At
73 trees you are asking for a tree approx. every 4 feet, and actually closer than that considering we will
not be able to place trees in front of the access gate and road of approx. 25 feet. Does the County really
want this many trees? Have you personally been up to the site? The fenced compound is not even visible
to the neighbors or roads on three sides. Let me know as we want to move this forward. I will provide
requested "signed" interference letter. Thanks Alex.

Steve,
The engineering report that you sent specifically states on page 2 that this tower does not meet the
requirements of ANSI-222-G. ANSI-222-G is the "Structural Standards for Steel Antenna Towers and
Antenna Supporting Structures" I can't issue a permit for the addition of the antennas if the structure won't
support them.
The landscaping plan is for the New Richmond site. I inspected the New Richmond site last October and there
were 5 foot high Arbor Vitae trees. The Glenwood site is 75 feet by 75 feet fenced and would require (73) 6 foot
high trees. I went with last years estimate of $266 per tree planted and mulched for a sub-total of $19,418. Then
add 20 percent for a total of $23,301. This dollar amount ($23,301) can be a check or a letter of credit.
The statement of non-interference must be signed by Jason Hall.
The lease agreement does say that American Tower will remove all the improvements. With this agreement we
will not need the financial assurance or the landowner acknowledgement.

The Richmond tower was built in 1998, not 2008. Please look at paragraph 11 in the attached lease which
specifically states that the tower is to be removed when no longer in use. The agreement you reference
below regarding the tower removal is in fact in the lease which has been sufficient in every other County
we have done business in. This paragraph also addresses that the site needs to be restored to the
original condition before the tower was built. We will use the same landscaping plan as was done in the
attached plan for Richmond. I am also attaching the radio frequency letter addressing the type of services
we will be using and a copy of the passing structural from a qualified engineer. This should satisfy
everything you are looking for with the exception of the landscaping escrow fee. Please let me know the
amount of the fee and we will mail you a check this week. Would it be possible to get the zoning approval
letter from you this week as well? Thank you Alex.

The Richmond tower was done in July of 2008 and the Glenwood tower was done in October of 2001. If you look
at section 17.82 (1) (b) that section addresses the requirements for towers from 8-28-1997 to 8-20-2002. The
ordinance that applied to these 2 towers when they were constructed required an agreement where the tower
owner agreed to take down the tower and all the associated equipment if the use was ever discontinued. The
Richmond tower has the required agreement. The Glenwood tower has an agreement signed by the landowner
stating that the tenant, American tower will remove all the equipment when required. However, American Tower
never signed the agreement; therefore they are not bound to it. The absence of this agreement requires a bond
or letter of credit or cash to remove the added components.
And yes, it's possible that some day we will have an abandoned tower with only a few added components that are
removed by using these bonds or letters of credit.
So, can you get American Tower people to sign the agreement stating that they will remove the Glenwood Tower
and all the additional items that have been added to it? Or it may have been signed and we never received a
copy.
The landscaping plans can be the same style; however they should contain the information that is specific to the
Glenwood site.

Ok...so it applies to the antennas on the tower ...not the shelter. That said, why would the bond be so high
for a $1000 job to remove some antennas? Also, isn't your concern that the tower be removed when it is
no longer in use? American Tower would never let us leave our antennas on their tower if we were not
using them and paying rent. And so long as the County is assured the tower would be removed when no
longer in use, the antennas would also have to come down with the tower... right? I have read your
ordinance over about three times now, and it seems like the performance bond is for removal of the tower
not individual tenants on the tower. Did you receive bonds from the other 3 carriers on the pole?

For item #4 below, the bond that was required for the Richmond site was for the removal of the tower. You
did not require a bond for the removal of the shelter or antennas nor do I believe your ordinance requires
one. I just read your ordinance and the removal bond is in reference to the "transmission facility"... (d) A
performance bond in a form acceptable to the Zoning Administrator in an amount sufficient to provide
for removal of the transmission facility. The tower is the transmission facility, not the shelter at the base
of the tower nor the antennas. Please review this and reply. Thanks.

I received 1 e-mail that contained a structural analysis report stamped by engineer WM Garrett that stated the
structure does not meet the requirements to support the existing requirements. I also received a set of tower
modification plans that describe what needs to be done to the tower in order for it to support the proposed

equipment. Did the "mid panel horizontals" get installed? And if so, did an engineer sign off on the structure?
There was no information on the remaining items on # 1 from my February 8 e-mail. There was no information for
items #2, #3 and #4.
The landscaping requirements are in my February 10 e-mail.

I reviewed the application and we need some more information. I have attached a copy of the ordinance for
reference.
1.) 17.87 (4) (a) 1 through 5 This is a report from a professional engineer that certifies the tower design, the
compliance with structural and electrical standards, describes the towers capacity to accommodate the
additional antennas, describes any lighting on the tower, and certifies that the tower won't cause any
interference. This report needs to have an original "wet ink" engineers stamp and signature.
2.) 17.87 (4) (b) 1. Is a statement on what type of services that these antennas will provide. That information
can come from you.
3.) 17.87 (c) is a landowner acknowledgement that states they will abide by the terms and conditions of the
land use permit including the restoration and reclamation.

4.) 17.87 (d) is an estimate for what it would cost to remove the antennas and associated building and then a
performance bond for that amount.
Since you are proposing additional buildings on the ground the landscaping requirements from the original special
exception permit in 2001 will need to be met. The required landscape plan was not in the file so one of our field
people is out looking at the site right now. I will let you know what he finds out.
