Staff finds that the project meets the tower provisions of the St. Croix County Zoning Ordinance, Section 17.87(2) based on the following findings of fact: 1. Approval of this land use permit includes the addition of a new Nextel facilities to an existing ATC tower, including 12 antennas, 15 coaxial cables, a cable ladder, an ice bridge, an equipment shelter, and a utility meter; 2. All proposed new Nextel equipment meets the required setbacks and height requirements of the Ordinance; 3. The existing tower and proposed Nextel facilities meet structural and electrical standards as certified by Henry Bellagamba, Wisconsin Professional Engineer; 4. The existing tower has the capacity to structurally support the proposed Nextel facilities as certified by Thomas Schepke, Wisconsin Professional Engineer; 5. The proposed Nextel facilities will not interfere with other existing facilities on the tower; 6. The proposed and existing facilities on site meet FCC and FAA requirements and will not interfere with public communication systems, which will be on separate frequencies; 7. The proposed and existing facilities on site will not pose a threat to public health and safety; 8. The proposed Nextel facilities will feature SMR/I-DEN technology; 9. Co-location is an accepted use in the Agricultural District and is encouraged by the Ordinance; and 10. The application was found to be complete. This permit has been issued with the following conditions: 1. The applicant shall contact the Planning and Zoning Department at least five days prior to commencing construction of the proposed facilities. 2. The applicant shall ensure that Best Management Practices are used during the construction of the facilities to control erosion and sedimentation on site. 3. The applicant shall inform the Planning and Zoning Department when construction is complete and submit photos of the completed facilities and antennae. 4. The applicant shall have one (1) year from the issuance of this land use permit to commence construction. If the permit expires, the applicant will be required to secure a new land use permit. 5. Any minor change (or addition) in the project shall require review and approval by the Zoning Administrator. Any major change and/or addition to the originally approved plans will require the submittal of a new land use permit application. 6. Within 12 months of cessation of operation or use of the wireless facilities, all unused antennas and equipment shall be removed at the operator's expense, unless a written exemption is provided by the Zoning Administrator. After the facilities are removed, the site shall be restored to its original condition or an improved condition. 7. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. This approval does not allow for any structures or development beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of Glenwood to obtain the necessary building permits for the proposed construction. Application for Land Use Permit Phone 763-786-1445 Nextel Communications - Collocation of communications equipment Fax 763-786-1030 Dear Ms. Shillcox: www.prosourcetech.com Nextel Communications (Nextel) is proposing to collocate cellular equipment on the existing cell tower owned by American Tower Corporation (ATC) located just northwest of Glenwood City. As part of this project, Nextel is proposing to collocate antennas on the existing tower, as well as construct a 12 ft x 20 ft equipment shelter at the base of the tower. The purpose of the installation of the proposed equipment is to provide increased cellular coverage to the area and connect with other Nextel sites within the network. Nextel is working with ATC regarding technical equipment issues and leasing details. The Land Use Permit allowed for the total of 12 antennas and 15 coaxial cables. Nextel is now going back to install the additional 3 antennas and 6 coaxial cables per the original approval. The antennas and coaxial cables will be installed at the same height and location as described in the original approval and no additional equipment will be installed on the ground. Although Nextel had 1 year to install there equipment from the date of the original 2005 approval, per our discussion this morning, the County is willing to administrative approve these additional antennas and coaxial cables and grant Nextel a 1 time 6 month extension on the Land Use permit in order for Nextel to install this additional equipment this Winter 2007.
