Lot 1 Parcel #06.28.19.87, Town of Troy Real Nop9lyl Dear Mr. Simpson: 715-386.407 This letter confirms zoning approval according to plans submitted by the applicant on Recycling September 26, 2008 for the following activities that require a land use permit: 715-386-4675 Pursuant to Section 17.36.H.5 - Filling & grading outside of the slope preservation zone and greater than 40 feet from the slope preservation zone in the Riverway overlay district is allowed with a Land Use permit. Staff finds that the proposed activities meet the spirit and intent of the St. Croix County Zoning Ordinance and Riverway District with the following findings: 1. The property consists of 30 acres, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District. 2. The project proposes repair of an existing gully that annually contributes sediment to the St. Croix River and will result in a stable, non-erosive rock-lined stormwater conveyance channel based on plans developed by NRCS staff. 3. The Wisconsin Department of Natural Resources has been sent a copy of the application for review and determination whether a Chapter 30 permit will be required or an Individual Permit for grading on slopes. 4. The St. Croix County Land and Water Conservation Department has reviewed the plans and supports approval of the project. 5. Filling and grading with Rock Rip Rap stabilization outside of the slope preservation zone and greater than 40 feet from the slope preservation zone is allowed with a land use permit in the Lower St. Croix Riverway District pursuant to Section 17.36.H.5 of the St. Croix County Zoning Ordinance; 6. No filling and grading will occur on slopes within 40 feet of the slope preservation zone. With the conditions stipulated above, this project will meet the spirit and intent of the Lower St. Croix Rirway District since it will not degrade the scenic, recreational, or natural values of the St. Croix Riv r Valley, and will not negatively affect the public health, safety and welfare of County residents. This approval is for filling and grading and rip rap stabilization for repair of erosion in a ravine as indicated in the plans submitted and as provided in the conditions below: 1. Prior to commencing construction, the applicant shall obtain final plan approval from the Town of Troy and obtain any permits required by Federal, State, or town regulations for this project. 2. The applicants shall contact the Zoning Administrator prior to commencing grading and rip rap stabilization and when the construction has been completed. ~3. Prior to commencing filling and grading within the ravine, erosion and/or sediment control measures must be installed to intercept runoff from the area above the ravine and provide temporary diversion and/or retention of stormwater. 4. Upon completion of ravine stabilization, the applicants or their contractor shall apply soil stabilization matting, seeding for revegetation with native species, and mulch in accordance with the approved plans and shall supplement with additional erosion control measures as necessary to ensure that sediments do not reach the St. Croix River. All erosion and/or sediment control measures shall be maintained until permanent, self-sustaining vegetation is successfully established on all disturbed areas of the site. 5. No phosphorous fertilizers shall be used to establish and maintain native vegetation on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. Upon completing the site work outlined as part of this land use permit application, the applicants shall submit to the Zoning Administrator photos of the ravine stabilization area and erosion/sediment control measures as viewed from all angles. 7. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 8. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approual does not allow for any additional construction, grading, filling, or clearing of vegetation beyond the limits of this request. Any remaining site work above and beyond what is identified s` part of this land use permit application shall be subject to the review and approval of the Zonin Administrator. Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not limited to obtaining a town building permit, County sanitary permit, and any permits that may be required by the Wisconsin Department of Natural Resources.
