Dear Mr. Zwald:
St. Croix County is conducting a review of your 590 Nutrient Management Plan that was
approved by the Land and Water Conservation Department as part of your special
exception use permit you received for your livestock operation in the Town of Pleasant
Valley.
Enclosed please find a spreadsheet to aid in your reporting effort. Please complete and
re-submit a nutrient spreading report for 2002's crop year to the Zoning Office by July
12th, 2002. Staff will review the spreadsheet to ensure that the 590 Nutrient Management
Plan is being implemented as approved.

Re: Completion of Waste Storage Facilities for Bomaz Farms

The reception pit and waste storage pond on the Bomaz Farm's new i
essentially complete. The items as shown on the plan prepared by me re i 1
completed yet are:'
1. Seeding of the earthwork around the waste storage pond.
2. Installation of 3 of the 5 agitation pads in the waste storage pond. These could not be
completed because of the lateness of the season when the storage pond was completed. I
believe that the pond can be agitated in the spring Without these in place without significant
erosion of the Class B clay liner. If erosion on the liner does occur, it will have to be
repaired at that time. The owners agree to place the 3 remaining agitation pads in the spring
after the pond is emptied. I understand that the owners have talked with you and Bob Heise
about this.
3. A vent and cleanout port was planned to be installed in the transfer line at the point where
the line crosses the south wall of the second barn. Neither the vent nor the second barn are
built yet. This vent is not required by the 425 standard but should be installed to help
prevent the system from air locking. Also, it would facilitate cleanout. If this should be
needed, it can be added later.
4. The storage pond is not fenced yet.
To the best of my knowledge, belief, and professional judgment, except for the items listed
above, this structure meets the requirements of the NRCS standards 425 "Waste Storage
Pond, 313 "Waste Storage Structure, and 358 "Waste Transfer System" and the
requirements of the St. Croix Co. Waste Storage ordinance. I further believe that, with the
understanding that the remaining work will be completed in the spring, it is environmentally
safe to put this system into service this winter.
Six white fiberglass rods (about 3/8" diameter) were installed in the liner as wear gages to
indicate the amount of erosion of the clay liner. The gage on the south slope would have
been covered by the concrete agitation pad placed there. Three were installed in the east
side slope at the quarter points of the length of the pond about 16' up slope from the bottom.
The fifth was installed in the center of the north slope about 16' up the slope.

FINDINGS OF FACT
Having heard all the testimony, considered the entire record
herein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicants are Greg and Bob Zwald, whose address is 1609
County Road Z, Hammond, Wisconsin 54015.
2. The applicants on May 30, 1996 filed with the Zoning Office an
application for a special exception request for a livestock
operation exceeding the number of animal units per acre.
3. Bomaz Inc. is the owner of the property which is the subject
of this application which is located in the S; of the NE; of
the SW, and the N, of the SE; of the SW, all in Section 8,
T28N, R17W, Town of Pleasant Valley, St. Croix County,
Wisconsin.
4. The subject property is currently used for agriculture.
5. Nelson stated this was a special exception use request to
exceed the number of animal units per acre and noted 1,000
lbs. to be considered one animal unit. He said the Zwalds
need to come up with a plan for waste.
6. Nelson introduce Exhibit #1, a site plan identifying the
proposed structure of the building; Exhibit #2, two pages
detailing the site plan; Exhibit #3, four aerial photos of
property which is to be entered into a lease agreement;
Exhibit #4, a tax roll lease agreement; Exhibit #5,
correspondence from the Town of Pleasant Valley stating their
approval.
7. Greg Zwald, being duly sworn, stated his address to be 1609
County Road Z, Hammond, Wisconsin and Bob Zwald, being duly
sworn, stated his address to be 1603 County Road Z, Hammond,
Wisconsin. They noted they were brothers.
8. Bob Zwald stated he abstained from the Town of Pleasant a ley
vote on their request.
9. Bradley inquired about the site for this request. Greg* stated

9. Bradley inquired about the site for this request. Greg stated
he wants to get going with their contractors because they are
on a time table. He noted they have already moved a lot of
dirt.
10. Bradley asked if they had a long-term lease with their
parents. Greg stated yes. He said the family corporation
owns 160 acres and his parents own 300 acres independently of
the corporation and that the corporation was created in 1974.
Greg stated they rent 300 acres and have 475 acres which is
tillable.
11. Greg stated they have 400 head of cattle which consists of
milking and dry animals. They have 100 cows as well as dry
cows and they are currently renting a portion of their herd to
neighbors. Bob stated they intend to add 300 cows to their
current 100 cows.
12. Greg stated they have a 590 manure nutrient management plan.
13. Bradley asked if they plan on using manure pit tankers. Bob
stated they want to use tankers, but want to remain flexible
to change so they can remain competitive. Greg referred to
Schottler's plan and their options for manure management.
14. Bob stated they want to work with their neighbors and what
they are requesting is not a drastic change from what they are
already doing it is just on a larger scale. He noted that the
dry cows would be housed at the old site and the milk cows
would be in the new building.
15. Bradley asked if they had received complaints from neighbors
regarding odor, etc. Greg stated liquid manure systems which
flush out into fields create a lot of odor. He said what they
would be doing is scrapping the manure into an alley
collection which would be gravity flowed to an outdoor storage
where it will crust over and then two times a year they would
agitate and mix it to get it to the field at which time it
will create an odor.
16. Bradley asked how often they scrape into the alley collection.
Greg stated
they scrape three times a day and store it in the
center of the grate. Bob noted they scrape to keep ahead of
freeze ups.
17. Greg addressed the issue of property values decreasing because
of the odor, etc. Bob added that they have done a lot of
planning, have hired an engineer and are trying to incorporate
the best plans possible. He feels there can be a symbiosis
with agriculture and housing development. Greg noted the
manure pit will be to the north and downhill 250 feet.

CONCLUSION OF LAW
The Board Concludes that:
1. The Board of Adjustment has authority under Section 17.70 (5)
(c) 4 to approve special exception uses.
2. Special Exception uses may be terminated as per 17.70 (7) (d)
of the St. Croix County Zoning Ordinance if the plan or the
conditions of the decision are not followed.
3. Section 17.14 (6) (h) allows a special exception for a
livestock operation exceeding the number of animal units per
acre.
DECISION
On the basis of the above Findings of Fact, Conclusion of Law, and
the record herein, the Board approves the applicant's request for
a special exception use for a livestock operation exceeding the
number of animal units per acre on the following vote:
Chairman Bradley yes
A. Jensen yes
C. Mehls yes
G. Menter yes
with the following conditions:
1. This decision expires on June 27, 1997. No construction may
begin or continue after this date unless an extension is
granted in writing by the Board of Adjustment prior to the
expiration date.
2. The applicant must complete this project according to the
plans submitted. Minor changes in the project must be
submitted to and approved in writing by the Zoning Office
before the project starts or continues. Major changes must be
brought back to the Board of Adjustment for review and
approval.
3. The applicant is responsible for obtaining any permit or
approval required for the project by municipal, town or county
zoning ordinances or by the U.S. Army Corps of Engineers
before starting the project.
4. The applicant must provide confirmation that he/she has
completed permit process with all other regulatory agencies.
5. The applicant must allow free and unlimited access to the
project site at any reasonable time to any Zoning Office
employee who is overseeing the project's construction,
operation, or maintenance.
CONCLUSION OF LAW
The Board Concludes that:

7. This decision has been issued with the understanding that any
construction equipment used is the right size to do the job
and can be brought to and removed from the project site
without unreasonable harm to vegetative cover and/or wildlife
habitat. The removal of vegetative cover and exposure of bare
ground shall be restricted to the minimum amount necessary for
construction. Areas where soil is exposed must be protected
from erosion by seeding and mulching, sodding, diversion of
surface runoff, installation of straw bales or silt screens,
construction of settling basins, or similar methods as soon as
possible after removal of the original ground cover.
8. The applicant must keep a copy of this decision at the project
site at all times until the project has been completed.
9. Tom Nelson, Zoning Administrator, shall be notified prior to
beginning the project. Call him at (715)386-4680 so that
compliance inspections can be made.
10. Applicant must submit a 590 Plan to the Land Conservation
Office and Zoning Office and obtain an Animal Waste Permit.

11. Permit is valid for long-term lease property.
12. Accepting this decision and beginning the project means that
the applicant has read understands, and agrees to follow all
conditions of this decision.
APPEAL RIGHTS
This decision may be appealed by any person aggrieved by filing an
action in certiorari in the circuit court of this County within 30
days after the date of filing shown below. The County assumes no
liability for and makes no warranty as to the legality of any
construction commenced prior to the expiration of this 30-day
period or the identity of any person who may claim to be aggrieved
by this decision.
