According to the plans you submitted, the proposed construction consists of building a garage on stone columns that will not require filling and grading within a ravine that drains to the St. Croix River. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 6.52 acre lot, is zoned Ag/Residential, and is u located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; a 2. The proposed garage will be more than 200 feet from OHWM of the St. Croix River, above the 693' floodplain elevation, will not impact slope preservation zones, and will be greater than 25' from any property line; 3. The roof for the proposed accessory structure will not exceed the maximum height pursuant to Sections 17.12(5) and 17.36.G.4.a.3); 4. The proposed construction of the accessory structure will not require filling and grading other than installation of the column footings and rock infiltration trenches per approved stormwater management plan; 5. Windows and building materials on the structure must meet standards in Sections17.36 G.5.c.2)a) and 17.36 H.1; r. The consin Department of Natural Resources has reviewed the application and commented that a ng as the site is not within the slope preservation zone or bluffline setback, proper metho of erosion control must be installed, inspected at the end of each work day, and maint d after each'/2 inch of rainfall until the project has been completed. 9. If cons cted as proposed, this project will meet the spirit and intent of the Lower St. Croix Riv ay District. It will not degrade the scenic, recreational, or natural values of the St. Croix r Valley, nor will it negatively affect the public health, safety and welfare of County residents. This approval is for the construction of a conforming accessory structure, as indicated in the plans r,1. mitted, and as provided in the conditions below: The applicants shall contact the Zoning Administrator prior to commencing construction and comply with inspection requirements for the building. It is understood that this garage will be for accessory use only and cannot be used as a second dwelling on an Ag Residential lot. 2. Ti approved stormwater plan must be implemented during construction of the garage and a XV. maintenance agreement affidavit recorded as part of the certification requirement in Condition 4. All siding, shingles, trim, and other appurtenances of the structure, including the roof, shall be h tone in color and of a non-reflective nature, with windows that are not more reflective than nary window glass, so as not to be visually conspicuous from the St. Croix River pursuant t, ections 17.36 G.5.c.2)a) and 17.36 H.1 of the Ordinance. 5. Wit 30 days of substantially completing the proposed accessory structure construction, the appl. ant shall submit to the Zoning Administrator photo documentation from the contractor that the c, T truction has been done in compliance with the approved plans and provide a copy of the re ded stormwater maintenance affidavit. I 6. All ivities approved as part of this land use permit shall commence within one year from the dat f approval and be substantially completed within two years, after which time the permit e < a es pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may :request extensions of up to six months from the Zoning Administrator.
