Hudson, WI 54016 Code Administration Re: Land Use Permit for reconstruction of a conforming accessory structure in 715-386-4680 the Lower St. Croix Riverway District Land Information G Parcel #13.28.20.576-I, Town of Troy Planning 715-386-4674 Dear Mr. & Mrs. Weekes: Real Property This letter confirms zoning approval according to plans submitted on October 5, 2009 715-384:4677 for the following activities that require a land use permit: Recycling To reconstruct an conforming accessory structure in the Lower St. Croix 715-386-4675 Riverway District in the Town of Troy pursuant to Section 17.36.F.2.a.1 of the St. Croix County Zoning Ordinance. According to the plans you submitted, the proposed reconstruction consists of demolition of a burned garage/pool house, rebuilding a garage/guest house over the existing footprint, and reconnecting the structure to an existing POWTS. Staff finds that the proposed activities meet the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property consists of a 3.18 acre lot, is zoned Ag/Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The former garage structure was hit by lightning and destroyed by fire, but the foundation is more than 200 feet from OHWM of the St. Croix River, greater than 25' from any property line, and greater than 100 feet from the bluffline; 3. The proposed reconstruction of the accessory structure will be a minor modification of the previous footprint and the roof will not exceed the height of the existing structure; 4. The proposed reconstruction of the accessory structure will not require filling and grading other than excavation for a replacement septic tank and building sewer to be connected to the existing POWTS; 5. Windows and building materials on the structure must meet standards in Sections 17.36 G.5.c.2)a) and 17.36 H.1; ST. Stevey.01son, Land & Water Conservation Dept., reviewed the application and commented that stomp water management is required for accessory structures greater than 100 sq. ft. per Section 17. H 7. Runoff from the structure's roof must be infiltrated; approximately 2600 sq. ft. generates 325 cu, . of stormwater during a 1.5" rainfall. The plans need to include landscaping or other means for controlling stormwater runoff. 8. The A consin Department of Natural Resources has reviewed the application and commented that the Department does not have any objections to this project provided it meets the standards listed in NR 1 8. Specifically, if trees or other vegetation needs to be removed either due to the new buildi dimensions or because it is determined they are dead or dying, then a vegetative ma gement plan must be submitted and implemented in order to adequately screen the new ding. All setbacks listed in NR 118 for the building and new septic tank location must be met. uilding height requirements must also be met. And, please be advised, if the total amount of grading for both the proposed building and septic tank are > 10,000 sq. ft., then a Storm Water permit is needed; 9. If constructed as proposed, this project will meet the spirit and intent of the Lower St. Croix Riverway District. It will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, nor will it negatively affect the public health, safety and welfare of County residents. This appf'gval is for the reconstruction of a conforming accessory structure, as indicated in the plans submitted-,--and as provided in the conditions below: 1. The applicants shall contact the Zoning Administrator prior to commencing construction and comply with inspection requirements for the building and POWTS. It is understood that this garage/guesthouse will be for accessory use only and cannot be used as a second dwelling on an Ab Residential lot. 2. lThe finished garage/guesthouse shall not exceed the maximum roof height allowed in 17.36.G. 3. A stormwater management plan must be developed that provides infiltration for 325 cubic feet of runoff and must be submitted for staff review and approval. Infiltration may be achieved through a combMation of methods, for example installation of a rain garden, infiltration trenches, or rain barrels for any gutters and downspouts that releases runoff into vegetated areas on this lot. The approvE0 stormwater plan must be implemented as part of the reconstruction and included in the certification requirement in Condition #5. 4. All siccing, shingles, trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature, with windows that are not more reflective than ordinary window glass, so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a) and 17.36 H.1 of the Ordinance. W 5M days of substantially completing the proposed accessory structur applicant shall submit to the Zoning Administrator certification from the contractor that the construction has been done in compliance with the approved plans. 6. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires puruant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 7. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approval does not allow for any additional construction, grading, filling, or clearing of vegetation b yond the limits of this request. Any remaining site work above and beyond what is identified part of this land use permit application shall be subject to the review and approval of the Zoning Administrator. Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but not limited to obtaining a town building permit, County sanitary permit, and any permits that may be required by the Wisconsin Department of Natural Resources.
