This letter confirms zoning approval according to the plans you have submitted for
Recycling disturbing an area of over 10,000 square feet on slopes ranging from approximately
715-386-4675 12% to 24.9% excavate a driveway and a building pad to construct a new home on lot
9 of Boardman Estates subdivision. This work began earlier this year prior to obtaining
the required land use permit. The land disturbance was identified during review of the
sanitary permit application and you agreed to apply for an after-the-fact land use permit.
Staff finds that the application meets the spirit and intent of the St. Croix County Zoning
Ordinance with the following findings:
1. You applied for and were issued a sanitary permit on September 28, 2009 in
preparation to applying for a building permit from the Town of Somerset;
2. Any construction or land disturbance activities affecting more than 10,000
square feet in area on slopes of 12 - 19.9% is allowed with a land use permit
pursuant to Section 17.12(7) of the St. Croix County Zoning Ordinance;
3. Any construction or land disturbance activities on slopes of 20-24.9% is allowed
with a land use permit pursuant to Section 17.12(8) of the St. Croix County Zoning
Ordinance;
4. The total disturbed area for the project is known to be over 10,000 square feet,
estimated at approximately 30,000 sq. ft. The area includes a 250' driveway
and the future house and pole building site, which is located between three
designated stormwater drainage areas within the lot;
5. The recorded plat for Boardman Estates stated that "no filling and grading or
construction is permitted within the drainage easements" for stormwater control;
6. During a site visit in July 2009 staff observed areas of steep slopes along the
west side of the driveway where erosion control matting had been applied and
grass was emerging. With conditions for maintaining erosion and sediment
control measures until self-sustaining permanent vegetation is established on all
disturbed areas and limiting the use of phosphorous fertilizer, negative
environmental impacts will be minimized and the purpose and intent of the
Ordinance will be met;

7. Stormwater runoff from impervious surfaces will be routed into designate 'tor nwa r ache
easement areas, whose size and capacity were engineered at the time of the subdivision plat and
meet the requirements in 17.12(8)(b) & (c).
8. A stormwater drainage and vegetation plan were submitted to Steve Olson, St. Croix County Land
& Water Conservation Dept. to review for compliance with Sections 17.12(7) and (8). The plan was
found to be complete and addressed LWCD concerns for runoff and erosion control.
9. Carrie Stoltz, Wisconsin DNR, commented that the site appears to be > 1000' feet from any
wetlands or navigable waterways and therefore Mr. Demulling will not need a Chapter 30 permit. He
will also not need a Storm water permit because the graded area is approximately 30,000 sq ft. If
the graded area exceeds 1 acre or 43,560sgft, then the owner needs an individual WPDES Storm
water permit.
Based on these findings, approval of this land use permit is subject to the following conditions:
1. The applicants shall contact the Zoning Administrator on or before November 15, 2009 to schedule
a foltw-up site inspection to evaluate vegetative cover before winter.
2. The applicants shall implement the approved stormwater and vegetation management plan. All
erosion and sediment control measures shall be maintained until permanent, self-sustaining
vegetation is successfully established on all disturbed areas of the site. No phosphorous fertilizers
shall be used on the disturbed areas of the site, unless a soil test confirms that phosphorous is
needed.

this' l6nd use permit application shall be subject to the review and approval of the Zoning
Administrator.
Your information will remain on file in the St. Croix County Planning and Zoning Department. It is your
responsibility to ensure compliance with any other local, state, or federal rules or regulations, including but
not limited to obtaining a town building permit and any permits that may be required by the Wisconsin
Department of Natural Resources.
