Title: Rehabilitate and Aerate Pine Lake Location: St. Croix County - three miles north of Baldwin. One Aeration unit will be placed on County park land and one on land owned by Glen Bolt. Justification: Pine Lake is a softwater seepage lake which is landlocked and subject to frequent partial winterkills. The lake lies in an agricultural watershed and approximately 12 residences are found on the lake shore. During 1988 the sinkhole was repaired and water levels are now dependent on runoff. Acreage and depth may vary from 108 acres and 21 ft. deep to over 140 acres and 30 ft. deep. During low water years fish kills increase. The fishery becomes dominated by species able to survive low dissolved oxygen levels (bullheads and some northern pike). On occasion near complete winterkills require rehabilitation through stocking. Pine Lake is extremely fertile and during periods of no winterkill it produces a tremendous sport fishery for bass, walleye, northern pike and panfish. Anglers quickly respond and fishing pressure becomes high. Western St. Croix County has few water resources capable of providing recreation. The county also maintains a park and public boat launch on the west shore. During years of winterkill the park receives little to no use. During years of good fishing the park becomes a focal point for area recreation. The great demand and potential for sport fishing opportunities on Pine Lake is evident. This was recognized by county residents-- the Baldwin Rod and Gun Club and the St. Croix County Sportsmen Alliance, who unsuccessfully attempted aeration of the lake. The small aerator (1/2 hp) was found to be grossly inadequate by Fish Management staff who have monitored D.O levels in the lake. Goal: The Eau Claire Area Six Year Fisheries Management Plan identified aeration as an opportunity to improve fishing and meet demands placed on our resources from urban growth around the Twin Cities area. It is consistent with Department goals and Fish 2000. Aeration is one of the few methods we can use to dramatically improve sport fishing in a relatively short period using public participation. The end product is well received by the public, as can be demonstrated on Squaw Lake, the last aeration system successfully installed by Fisheries Management in this area. Objectives: The goals of this project are: to restore a desirable sport fishery to Pine Lake through the elimination of winterkills and the reduction of bullheads; enhance county park use and associated recreation; meet increasing demands on sport fishing from urban expansion; and provide the mechanism to improve water quality if aeration is determined to be effective on St. Croix County lakes. Work Activities: St. Croix County government has been contacted and has agreed to sponsor the aeration project for a 20 year period. The county will accept liability, operation and maintenance of the units. Maintenance of the aeration units and installation of open water barriers will be done by the County Parks and Recreation Department in accordance with state statutes.. The Department will design the proper aeration system. The Fisheries Manager will order appropriate materials, process bids and secure required permits. The County will secure a 20 year easement from one landowner for the placement and operation of one unit. The other unit will be placed on county property. Electrical service with be contracted out. The aeration units, housing and air lines will be installed through the use of volunteers, county employees and local DNR staff. Oxygen levels will be monitored in successive winters to determine the best operating procedures. Once the aeration unit is installed the fishery will be restored. Bullheads will be intensively removed. Proper disposal will be arranged by the Fisheries Manager. Gamefish will be stocked through standard stocking procedures, while panfish will be reintroduced through live fish transfers from area lakes with over abundant populations. The fisheries manager will work through the district PIO to develop several news releases informing the public and giving recognition to all that contributed. COOPERATIVE AGREEMENT FOR THE INSTALLATION, MAINTENANCE AND OPERATION OF AN AERATION SYSTEM IN PINE LAKE, ST. CROIX COUNTY. This agreement is made and entered into, pursuant to section 23.09(2)(h),Wisconsin Statutes, by and between the State of Wisconsin Department of Natural Resources (hereinafter referred to as the Department) and St. Croix County (hereinafter referred to as the County). WHEREAS, the parties desire to maintain the water quality in Pine Lake, located in Erin Prairie, Hammond and Baldwin Townships, St. Croix County for the benefit of the fishery, and WHEREAS, the Parties intend to place two aeration systems in Pine Lake for that purpose; NOW, THEREFORE, for and in consideration of the mutual terms and conditions herein, the Parties, agree: 1. PERIOD OF AGREEMENT: This Agreement shall extend for a period of twenty (20) years from its signing by all parties with the option to renew upon agreement by the Parties. 2. ENTIRE AGREEMENT; AMENDMENTS: This agreement may only be amended in writing signed by the parties and may not be assigned, subcontracted or otherwise transferred. 3. CANCELLATION; The Department reserves the right to cancel this agreement in whole, or in part, without penalty, due to nonappropriation of funds, or for failure of the parties to comply with terms, conditions,or specifications of the Agreement. Upon breach of this agreement by the County, the Department may terminate it and remove the aeration system, enter into an Agreement for its maintenance with another person or take other action it deems necessary. 4. DESCRIPTION OF WORK OR PRODUCTS: Upon installation of the aeration system by the County the following are agreed to: a. The Department will provide technical advice and assistance regarding the installation, maintenance and operation of the aeration systems. b. The Department will initially purchase the following equipment, supplies, materials and services not to exceed $21,150.00. 1. The aeration systems to include: blowers, electric motors and air lines. II. The construction materials needed to house the blowers. III. Electrical connection charges. page 1 of 3 C. The County will: 1. Secure twenty (20) year easements for the placement, installation and maintenance of the aeration systems,housing and aeration lines. II. Provide labor to install the aeration systems, aeration lines, and housing units by December 15, 1994. Ill. Maintain the aeration system, to include: Repair, regardless of cause of damage or malfunction, operational maintenance and upkeep required on the helixors, blowers, electric motor, air lines warning devices,.three phase convertor, buildings in which the compressors are housed, and any associated equipment involved with the aeration system. IV. Inspect and check the aeration system on an annual basis for air leaks and vandalism, and repair, regardless of cause of damage or malfunction, when found. V. Pay the annual cost for supplying electricity to power the blowers used in providing air for the systems. VI. Provide and maintain fencing required by Section 167.26, Wisconsin Statues, as well as posting to warn of hazardous conditions within the fenced area. 5. INDEPENDENT CONTRACTOR: The County shall be an independent contractor and not an employee or agent of the Department. 6. LIABILITY: The County agrees to be held liable for actions or inactions of their employees or agents pursuant to law. 7. INDEMNIFICATION: The County agrees to defend and indemnify the State of Wisconsin, Department of Natural Resources and all its officers, employees and agents, against any injury to or death of any person or persons, and for loss or damage to any property (state or other) occurring in connection with or in any way incident to or arising out of the occupancy, use, service, operation or performance of work in connection with this Agreement or omissions of County employees, agents or representatives. page 2 of 3 8. NON-DISCRIMINATION CLAUSE: In connection with the performance of work under this agreement, the County agrees not to discriminate against any employe or applicant for employment because of age, race, religion, color, handicap, sex, physical condition, developmental disability as defined in s. 51.01(5), Wis. Stats., sexual orientation, arrest or conviction record or national origin. This provision shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. Except with respect to sexual orientation, the County further agrees to take affirmative action to ensure equal employment opportunities. The County agrees to post in a conspicuous place available for employes and applicants for employment, notices to be provided by the contracting officer setting forth the provisions of the nondiscrimination clause. 9. EFFECTIVE DATES: This agreement shall become effective when signed by the parties. WHEREAS, the Grantor is the owner in fee simple of certain real estate which is near and adjacent to the Grantee's project area at Pine Lake located in St. Croix County, Wisconsin; and WHEREAS, the Grantee desires to place an aeration system in Pine Lake to improve fishing for the use and benefit of the general public. THEREFORE, the Grantor, for an in consideration of the sum of One Dollar ($1.00) and the mutual terms and conditions hereinafter contained, conveys to the Grantee an easement and right to develop, operate and maintain an aeration system on the following described real estate, until such time as the aeration system at this sight may be discontinued: The location of said easement is shown on Exhibit A attached hereto, and made a part hereof. The Grantee shall have the right to install and maintain an aeration system including, but not limited to, electrical wiring, air lines, air pump, and housing for the air pump. This easement also allows a utility company to install and maintain utility service to the aeration system if needed by Grantee. If required by law, the Grantor shall co-apply with the Grantee for any and all Chapter 30, Stats., permits necessary for implementation of rights granted to the Grantee by this easement. The Grantor conveys to the Grantee, it's employees, officers, and agents, the right of ingress and egress on, in and over the easement for the purpose of constructing, altering, repairing, maintaining and replacing improvements which are provided for in this easement. It is understood that field roads, roadways, passageways, lanes, or other normally travelled routes will be utilized for such ingress and egress whenever possible and where such travelways exist. The Grantor releases the Grantee from any claims of damage which may arise as a result of floods and flash floods on the lands. The Grantee releases the Grantor of all liability resulting from work performed on and in the easement area by employees, officers, or agents of the Grantee, and all public and general liability resulting from the installation, maintenance, or operation of the aeration system. The Grantor shall neither lease nor convey any other easement in any way affecting the use and enjoyment of this easement without prior written permission of the Grantee.
