Dear Mr. Johnson:
This letter confirms zoning approval according to the plans you have submitted to construct a stairway on your
property on the Pine Lake in the Town of Hammond.
Staff finds that the proposed stairway meets the spirit and intent of the St. Croix County Zoning Ordinance and the
Shoreland Overlay District with the following findings:
1. The proposed stairway will not detract from the natural beauty of the shoreline of Pine Lake;
2. Installation of the proposed stairway will not require vegetation removal within the OHWM setback;
3. Installation of the proposed stairway will be installed in an existing ravine and will not require grading and
filling on 20 percent slopes or greater;
4. The proposed stairway will not exceed 3 feet in width and 42 feet in length;
5. The proposed stairway features one 40-square foot lower landing located above the OHWM;
6. The proposed stairway features hand rails but no roofs or canopies;
7. All visible portions of the proposed stairway will be painted or finished in an earth-tone color to be visually
inconspicuous from Pine Lake;
8. A registered professional engineer has certified that the stairway will be securely anchored to prevent shifting
and accelerated erosion;
9. The Land and Water Conservation Department has been working with the applicant to address erosion
problems in the ravine and recommends approval of the permit if silt fence is installed properly and the
eroded ravine is properly seeded;
10. The Wisconsin Department of Natural Resources has reviewed the plans and has no objections; and
11. The approval of this project meets the intent and purpose of the Ordinance and will not affect the public
health, safety and welfare of County residents.
Approval of the land use permit is subject to the following conditions:
1. The applicant must contact the Zoning Administrator prior to commencing site preparation and when
installation is completed.
2. Prior to commencing construction, the applicant shall install silt fence in accordance with
recommendations from the Land and Water Conservation Department and the enclosed document, Silt
Fence (1056).
3. The applicant shall not remove any mature native trees and shrubs as part of the installation of the
stairway in order to maintain bank stabilization and natural aesthetics;
4. The landing of the stairway shall be located at least one foot above the OHWM;
5. Immediately upon completion of the stairway installation, the applicant shall re-establish native
groundcover over all disturbed areas in accordance with recommendations from the Land and Water
Conservation Department and the enclosed document, How to Establish and Maintain Native Grasses,
Forbs and Legumes, May 2005.
6. Upon completion of the stairway installation, the applicant shall submit to the Zoning Administrator
photos of the completed stairway as viewed from the shoreline of Pine Lake and from the top of the slope.
7. Upon completion of the construction, the applicant shall maintain natural shoreline vegetation and plant
additional native trees, shrubs, and aquatic/terrestrial vegetation as needed to screen the stairway and
landing from Pine Lake as viewed from any direction during summer leaf-on conditions.
8. Any minor change (or addition) in the project shall require review and approval by the Zoning
Administrator. Any major change and/or addition to the originally approved plan will require a new land
use permit as stated in the Ordinance.
This approval does not allow for any construction, grading, filling, or vegetation removal beyond the limits
of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department.
Please contact the Town of Hammond to obtain the necessary building permits for the proposed stairway. It is
your responsibility to ensure compliance with any other local, State, or federal rules or regulations.
