CROIX COUNTY ZONING ORDINANCE. ) August 28, 1984 Location: SW14 of the SW14 of Section 2, ) T29N-R17W, Town of Hammond ) The St. Croix County Board of Adjustment conducted a public hearing on August 28, 1984 to consider the request of Steven Breault for a special excep- tion use, Article 6.3 C. (1)(c), Holding Tank, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on-site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Executive Session to discuss the request. After returning to open session, the following decision was rendered. Motion by Supervisor Stephens to deny the request of Steven Breault. The sewer system inadequacies would become more severe in ensuing years, causing hard- ship to present and future residents, and possibly a year around home. Seconded by Supervisor Kelly. Motion carried. Vote to deny: Meinke, yes; Kelly, yes; Stephens, yes. r S All variances approved must be acted on or constructed within one (1) year `from date of approval or they shall be null and void. All members present. Minutes of the July meeting and hearings approved as written. Steve Weekes was advised to apply for a variance in September. Dean Hanson talked to the Board about a home he started building in the Town of St. Joseph. He does not meet the side yard setback. He would like to add this to his request for a lift. Chairman Stephens informed him that this would require another hearing. Chairman Stephens called the hearing to order. Zoning Administrator read notices of the hearings as published in the county and local newspapers. 1. ARTICLE: 6.3 C (1)(c), Holding Tank ` APPELLANT: Jehovah's Witnesses Church LOCATION: SWk SEAL, Section 33, T31N-R18W, Town of Star Prairie - 2 - Steven Breault presented his request to have a holding tank on his property. He explained the reasons for the holding tank. The system (Inground Pressure) cannot t meet the setbacks from the house. Attorney Tom Schumacher appeared on behalf of the Town of Hammond. The township has concerns about Mr. Breault meeting his com- mittments and violation of the County Zoning Ordinance. Nels Anderson, adjoining landowner, objects to the holding tank. Mr. Breault rebutted the remarks of Schumacher and Anderson. Mr. Philip Kjeseth presented his request for a feed lot in the Town of Stanton, explaining his reason for the feed lot. Town Board Chairman Bethke spoke in favor of the feed lot. The tovnship will be sending Mr. Kjeseth a letter showing some restrictions. Zoning Administrator read a letter from Henry Cotton objecting to the feed lot. Mrs. Glenda Goldsmith objected to the feed lot, explaining her reasons for objecting. Glen Goldsmith objected as he has a problem with the feed lot. Odors are affecting his business as people are unable to look at campers and discuss sales due to the odor. Philip Kjeseth rebutted the objecting remarks. Mark Gherty presented the request of Bruce Peterson to have a duplex in a one family residence for a period of two (2) years. Robert Jacobson, adjoining landowner, ob- jected to the duplex. Richard Saltness, adjoining landowner, objected to the duplex. Mr. Gherty rebutted the objections. Mr. Allan Petersen presented his request to have a greenhouse on his property that would be 25 feet from the property line. Mr. Dean Hanson presented the request of Croixview Acres to construct a lift for the development. Mr. Gerald Shurb, adjoining landowner, has no objections to the lift. Mr. Richard Sirek presented his request for a driveway separation. He would like to move his present driveway which is a joint driveway with an easement to his lot. He would like to have a driveway that is 140 feet from the south drive and 95 feet from the north drive. Mr. Jim Mc Nurney objected to the driveway separation as the subdivision was approved with a joint driveway and easement over the property to the south. Mr. Peter Stacy presented the request of the Division of Corrections to add on to the south facility. Mr. Donald Larson presented his request to construct a pole type building for grain and machinery storage that would be 73 feet from the centerline of a town road. The structure would not cause a traffic hazard. Mr. Sam Wicher presented the request of Mathy Construction to have a temporary hot mix plant in the Town of Springfield. This will be for a 3 - 4 month period. The hot mix will be for Glenwood City. Michael Fause presented the request of the Jehovah's Witnesses Church of New Richmond to install a holding tank on their property: They are putting an addition on the church, and the present system is inadequate, although it is not failing.(State reg- ulations). There is no area for an alternate type system. Elmer Peterson has no objections to the holding tank. Mrs. William Cody wanted a holding tank explained to her, after which she had no objections. Hearings recessed at 11:33 a.m. to inspect the properties in question. Committee went into Executive Session to discuss the request, returning to open session to render decisions. 1. Steven Breault: Motion by Supervisor Stephens to deny the request of Steven Breault. Motion carried. Vote to deny: Meinke, yes; Kelly, yes; Stephens, yes. 2. Philip Kjeseth: Motion by Supervisor Meinke~to approve with the following stipulations: 1. Thirty (30) day inspection of property by Zoning Administrator for the following conditions: a. Excess manure and/or liquid accumulation. b. Excess odor. c. Excess insect or rodent infestation. 2. Should the Zoning Administrator find complaints of adjoining residents and finds their complaints justified, this variance will be revoked in writing by - 3 - , certified letter with appellant given thirty (30 ) days to remove all cattle or and clean premises to Zoning Administrator's satisfaction. • 3. The Town Board of the Town of Stanton shall be required to assist in inspec- tion of premises to satisfaction of surrounding residents. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 3. Bruce Peterson:Motion by Supervisor Stephens to deny the request for a duplex. Duplex violated zoning objection of neighborhood residents with present condition. Present rental shall be terminated within sixty (60) days. Seconded by Supervisor Kelly. Motion carried. Vote to deny: Meinke, yes; Kelly, yes; Stephens, yes. 4. Allan Petersen: Motion by Supervisor Kelly to permit construction of a green- house that would be 25 feet from a property line. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; 'Stephens, yes. 5. Croixview Acres (Dean Hanson): Motion by Supervisor Meinke to approve the lift as it meets all DNR and zoning requirements. Seconded by Supervisor Kelly. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 6. Richard Sirek: Motion by Supervisor Stephens to deny the driveway separation as present driveway access is adequate. Seconded by Supervisor Meinke. Motion carried. Vote to deny: Meinke, yes; Kelly, yes, Stephens, yes. 7. State Division of Corrections: Motion by Supervisor Kelly to approve expansion of present facilities as previous permits pose no problems. Seconded by Supervisor Stephens . Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 8. Donald Larson: Motion by Supervisor Meinke to approve the building setback of 73 feet from the centerline of a town road as it will not cause a traffic safety hazard. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes, Stephens, yes. 9. Mathy Construction: Motion by Supervisor Meinke to approve the temporary hot mix plant as the temporary nature causes no long term effects on the neighborhood. This approval is for 3 to 4 months. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 10. Jehovah's Witnesses Church: Motion by Supervisor Stephens to approve the holding tank in conjunction with the present system provides adequate facilities. A cash bond of $500 to the Township of Star Prairie is requested to ensure pumping. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. Motion by Supervisor Meinke to close the hearings and adjourn. Seconded by Supervisor Kelly. Motion carried.
