THIS SEPTIC DRAINFIELD EASEMENT AGREEMENT (the Agreement) is between
EHRIC GULLICKSON and RENEE GULLICKSON, husband and wife (Lot One Owner) and
BRIAN R. DONAHUE and JENNIFER M. DONAHUE, husband and wife(Lot Two Owner).
RECITALS :
A. Lot One Owner is the owner of certain real property located in ST.CROIX County,
Wisconsin, referred to in this Agreement as Lot One and legally described as follows:
Lot One(1)of Certified Survey Map recorded in Volume 3 of Certified Survey Maps,Page 758,
as Document No.354756;
Located in the Northwest Quarter(NW ''/.)of the Northwest Quarter(NW ''/,),Section Thirty-four
(34),Township Thirty(30)North,Range Nineteen (19)West,Town of St.Joseph,St.Croix County,
Wisconsin.
B. Lot Two Owner is the owner of certain real property located in ST.CROIX County,
Wisconsin referred to in this Agreement as Lot Ttivo and legally described as follows:

Located in the Northwest Quarter(NW '/.)of the Northwest Quarter(NW '/.),Section Thirty-four
(34),Township Thirty(30)North,Range Nineteen(19)West,Town of St.Joseph, St.Croix County,
Wisconsin.
C. Lot Two Owner is willing to create an easement over its property to enable Lot One
Owner to use the easement under the terms of this Agreement.
AGREEMENT
For ood and valuable consideration,the receipt and sufficiency of which are acknowledged,

the parties agree as follows:
1. Grant. Lot Two Owner grants an easement and right-of-way to Lot One Owner and
Lot One Owner's successors and assigns as the owner of Lot One to use the easement for the
purposes of keeping and maintaining the septic drainfield that is currently located on Lot Two.Lot
One Owner shall use every reasonable effort to encroach on Lot Two Owner's property to the
smallest extent possible in keeping and maintaining said septic drainfield and in allowing runoff to
said drainfield.
2. Relocation of Drainfield. In the event that the soil conditions, or the laws or
regulations of the State of Wisconsin and/or the local applicable municipalities,require relocation of
the septic tank and drainfield or in the event that the septic tank or any part of the septic system
requires replacement, the septic tank and drainfield and all things related thereto shall be located
entirely on, in or under Lot One. In the event of said relocation,this easement shall terminate. Lot
One Owner and Lot Two Owner agree to properly execute and record with the St. Croix County
Register of Deeds a release of this easement at the time of said relocation.
3. Rehabilitation;Maintenance and Other Costs. In the event that the maintenance,
upkeep or any other work required of the septic drainfield causes damage or disturbance to Lot Two,
Lot One Owner shall cause to have Lot Two rehabilitated to substantially the same condition or state
of repair as existed before the damage or disturbance occurred. Lot One Owner shall be solely
responsible for all costs relating to the septic drainfield, including without limitation, general
maintenance, upkeep,disposal, insurance and costs of rehabilitation of Lot Two.
4. Indemnity. Lot One Owner shall indemnify and defend Lot Two Owner and its
officers,agents,and employees from all liability,suits,actions,claims,costs,damages,and expenses
of every kind and description, including court costs and legal fees, for claims of any character,
including liability and expenses in connection with the loss of life, personal injury, or damage to
property,brought because of any injuries or damages received or sustained by any person,persons,or
property on account of or arising out of the use of Lot Two by Lot One Owner or its agents,
contractors, subcontractors, invitees, or employees.

5. Covenants Run with Land. All of the terms and conditions in this Agreement,
including the benefits and burdens, shall run with the land and shall be binding upon, inure to the
benefit of,and be enforceable by Lot One Owner and Lot Two Owner and their respective successors
and assigns. The specific parties named as Lot One Owner and Lot Two Owner in this Agreement,
and each of their respective successors and assigns as fee simple owners of Lot One and Lot Two,
respectively, or any portion of Lot One or Lot Two, shall cease to have further liability under this
Agreement with respect to facts or circumstances first arising after the party has transferred its fee
simple interest in Lot One or Lot Two,respectively, except, however, for obligations that accrued
during the party's period of ownership of title.
6. Governing Law. This Agreement shall be construed and enforced in accordance
with the internal laws of the State of Wisconsin.
7. Entire Agreement. This Agreement sets forth the entire understanding of the parties
and may not be changed except by a written document executed and acknowledged by all parties to
this Agreement and duly recorded in the office of the Register of Deeds of St. Croix County,
Wisconsin.
8. Invalidity. If any tern or condition of this Agreement, or the application of this
Agreement to any person or circumstance,shall be deemed invalid or unenforceable,the remainder
of this Agreement,or the application of the term or condition to persons or circumstances other than
those to which it is held invalid or unenforceable, shall not be affected thereby, and each term and
condition shall be valid and enforceable to the fullest extent permitted by law.
