Dear Mr. Wiken:
On May 29, 1986 I inspected the proposed modifications you plan to make
on your cabin which is located within the Lower St. Croix Riverway
zone. It appears that the proposed modifications comply with the
riverway zoning ordinance.
I would have no objection to your dismantling the cabin and placing a
new foundation underneath it, provided the cabin is reconstructed to
its present size limits and is painted in an earth tone color. You
will still need a permit from St. Croix County to complete this work.

BOARD OF ADJUSTMENT MEETING AND HEARING
July 22, 1986
9:00 A.M.
Meeting called to order by Chairman Meinke at 9:00 a.m. in the
County Board Room, Courthouse, Hudson. All members present.
Motion by Supervisor Sweitzer to correct the minutes of the June
hearing to show June 24, instead of June 4, 1986. Seconded by
Supervisor Kinney. Motion carried. Minutes approved as
corrected.
Robert Frick talked to the board about his request for a setback
from STH 11128". Discussion by the board. Motion by Supervisor
Sweitzer to grant approval on condition that there be approved
plans for a mound system in the Zoning Office from the state,
after which the board will grant a 100 foot setback from the
centerline of the highway. Mr. Frick will not hold the state,
county, or Town of Springfield liable for loss of land,
buildings, or trees in future road construction. Seconded by
Supervisor Kinney. Motion carried.
Timothy Pitzen spoke to the board on a setback variance to a town
of Star Prairie road. The setback would be 106 feet. Chairman
Meinke informed him that the board would look at the site after
the hearings are recessed.
Chairman Meinke called the hearing to order at 9:30 a.m. Zoning
Administrator read notice of the hearings as published in the
newspapers.

1. Mr. Richard Huttner presented his request to construct a pole
barn that would be 63 feet from the centerline of a town road,
explaining that he has two roads going by his property, and
cannot meet the setbacks.
2. Michael Wiken presented his request to reconstruct a small
house in the St. Croix Riverway that cannot meet the bluffline
setbacks. The structure will be in the same location as the
present structure. Mr. Steve Johnson, MN-WI B.A.C., has no
objections as long as the house is painted earth tones. Mr. Jake
Vander Voort has no objections for the same reasons.
3. John Reinart presented their request to remove and construct
a house on the same site in the St. Croix Riverway. The house
will be a little smaller than the present structure. Mr. Reinart
would also like to rip rap the bank, which is being washed away.
Questions by board members. Mr. Steve Johnson, MN-WI B.A.C., and
Mr. Jake Vander Voort of D.N.R., have no objections as long as
the house is earth tone in color. They will also need approvals
from D.N. R. and the Corps of Engineers for the rip rap.
4.-7. Mrs. Merrill Johnson, Mr. Fred Mangine, Steve Wilcox for
Charles Vogel, and Bruce Huber presented their requests for rip
rap on the St. Croix River. Steve Johnson, MN-WI B.A.C., and
Jake Vander Voort, D.N.R., have no objections to the rip rap, but
all will need D. N. R. and Corps of Engineers approval.
8. Mr. Mike Early presented their request for a driveway
separation of 100 feet from an adjoining driveway, explaining the
reason for it was due to the grain dryer location and irrigation
equipment does not hit this area of the field The present
driveway would be removed if approval is granted.
9. Charles MacDonnell: Bruce Austinson and James Rusch presented
the request of Charles MacDonnell to construct a garage that
would be less than 100 feet from the bluffline of the St. Croix
River. Questions by board members. Steve Johnson and Jake

Vander Voort have no objections to the house addition, but would
like the garage to be as close to 100 feet from the bluffline as
possible. The structures shall be of earthtones.
10. Mrs. Stephen Gianoli presented their request to rip rap the
shoreline of the St. Croix River, and to construct an addition to
their deck that would be 88 feet from the bluffline. Steve
Johnson, MN-WI B.A.C „ and Jake Vander Voort, D. N. R., have no
objections.
11. Mr. James Comfort presented their request to construct a
lift and rip rap the bank and beach area on their St. Croix River
property. Mr. Comfort explained that the rip rap would
include gabions being placed in the river to reduce shoulder
erosion. Questions by board members. Steve Johnson, MN-WI
B.A.C., has no objections to the lift, but does not know anything
about the gabions. Jake Vander Voort has no objections to the
lift, but would need to get approvals from the department on the
gabions. Mr. Comfort would also have to have Corps. of Engineers
approval.
Hearing recessed for inspection of the properties in question.
After inspection of the properties, the board returned to session
to render decisions.
1. RICHARD HUTTNER: Motion by Supervisor Kinney to approve the
request for a 63 foot setback from a town road. Township to be
held harmless for damages for any future road construction.
Seconded by Supervisor Sweitzer. Motion carried. Vote to
approve: Sweitzer, yes; Kinney, yes; Meinke, yes.
2. MICHAEL WIKEN: Motion by Supervisor Sweitzer to approve the
request to construct a cottage in the same location as the
present structure. The cottage shall be earth tone in color.
Seconded by Supervisor Kinney. Motion carried. Vote to approve:
Sweitzer, yes; Meinke, yes; Kinney, yes. j
3. JOHN REINART: Motion by Supervisor Sweitzer to approve the
request to construct a house in the same location as the present
structure. The structure to be of earth tone colors, and to
approve the request to rip rap the shoreline of the St. Croix
River with Corps of Engineers and D.N.R. approvals. Seconded by
Supervisor Kinney. Motion carried. Vote to approve: Meinke,
yes; Kinney, yes; Sweitzer, yes.
4.-7. MERRILL JOHNSON, FRED MANGINE, CHARLES VOGEL AND BRUCE
HUBER: Motion by Supervisor Sweitzer to approve the above
requests to rip rap the shoreline of the St. Croix River with
D.N.R. and Corps of Engineers approval. Seconded by Supervisor
Kinney. Motion carried. Vote to approve: Sweitzer, yes;
Kinney, yes; Meinke, yes.
8. MIKE EARLY: Motion by Supervisor Kinney to approve the
request for a driveway separation of 100 feet north of the
driveway to the south. The present driveway shall be removed and
the new driveway will be for a field access only, not for a home.
Seconded by Supervisor Sweitzer. Motion carried. Vote to
approve: Sweitzer, yes; Meinke, yes; Kinney, yes.
9. CHARLES MAC DONNELL: Motion by Supervisor Sweitzer to
approve the request to add on to the cottage,
using earth tone colors, and to construct a 32 X 24 garage, 75
feet from the bluffline. Seconded by Supervisor Kinney. Motion
carried. Vote to approve: Meinke, yes; Kinney, yes, Sweitzer,

yes.
10. STEPHEN GIANOLI: Motion by Supervisor Sweitzer to approve
the construction of a deck 88 feet from the bluffline of the St.
Croix River, and to rip rap the shoreline with D.N.R. and Corps
of Engineers approval. Seconded by Supervisor Kinney. Motion
carried. Vote to approve: Kinney, yes; Meinke, yes, Sweitzer,
yes.
11. JAMES COMFORT: Motion by Supervisor Kinney to approve the
request for a lift with landing areas not to exceed 40 square
feet, and approve the rip rap and gabions upon approval from D.
N. R. and Corps of Engineers. Seconded by Supervisor Sweitzer.
Motion carried. Vote to approve: Meinke, yes; Sweitzer, yes;
Kinney, yes.

Seconded by Supervisor Kinney. Motion carried. Next hearing
date is set for August 26, 1986.
