ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL .5 ORDINANCE NO. 59 9' 6.Q 66 () WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of KENNETH AND RENEE DYKHOUSE on October 3, 2001 in the St. Croix County Agriculture Center, Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED Based on the following findings: 1. The Town of Baldwin supports the rezoning request and certified that the provisions of §91.77 have been met. 2. The request generally conforms to the County Plan. There is no Town plan. 3. The site is a portion of a larger 40 -acre site. Former farm field which now has some woods and is slightly rolling The application states that the site was in the Conservation Reserve Program but was removed in May. 4. The majority of the site has limiting soils for Private Onsite Wastewater Treatment Systems (POWTS), however, the site has been tested and a sanitary permit has been issued. 5. A small portion of the site is prime farmland. 6. Surrounding land uses include a mixture of large acreage farms and hobby farms. 7. Surrounding zoning is Ag/Residential to the south and east and Exclusive Ag to the north and west. 8. Rezoning would be fairly compatible with the surrounding neighborhood. 9. The site is located on a town road. 10. Proposed development is one home site. Further development may be limited by the soils. 11. One home site on the parcel is appropriate. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 4 +/- acre parcel is now rezoned from Agriculture to Ag.-Residential.
