CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULAIREJO AG II ORDINANCE NO. .5 cr WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of GLENN MALCEIN on March 8, 2000 at the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77,voted to approve a rezoning of the following described land: A parcel of land located in part of Northeast % of the Southeast 1/4 , the Southeast % of the Southeast 1/4, the Southwest 1/4 of the Southeast 1/4, and the Northwest 1 /4 of the Southeast '/4, Section 11, Township 29 North, Range 16 West, Town of Baldwin, St. Croix County, Wisconsin, more particularly described as follows: Commencing at the East % Corner of said Section 11; thence, S 00 °09'09" E 633.14 feet along the East line of said Southeast '/4 to the point of beginning; thence continuing S 00 °09'09" E 421.76 feet; thence N 89 °29'55" W 854.56 feet; thence S 01 °17'26" W 831.49 feet; thence N 87 °50'01" W 459.27 feet; thence N 01 °54'53" W 282.49 feet; thence N 18 °59'47" W 360.63 feet; thence N 41 °45'51" W 377.49 feet; thence N 77 °20'00" W 297.31 feet; thence N 00 °52'36" W 874.95 feet; thence S 87 °24'00" E 428.20 feet; thence S 01 °43'47" W 277.08 feet; thence S 87 °01'41" E 899.91 feet; thence S 03 °15'47" W 241.92 feet; thence S 87 °24'00" E 709.21 feet to the point of beginning. Containing 1,772,129 square feet (40.68 +/- acres) more or Tess, and being subject to existing easements; AND A parcel of land located in the Southeast % of the Southwest %, and in the Northeast % of the Southwest '/4 of Section 11, Township 29 North, Range 16 West, Town of Baldwin, St. Croix County, Wisconsin, more particularly described as follows: Commencing at the South '/ Corner of said Section 11; thence N 87 °11'26" W along the South line of the said Southwest % of Section 11 a distance of 516.03 feet to the point of beginning; thence N 02 °23'25" E 1068.51 feet; thence S 86 °24'03" E 463.23 feet to the East line of the said Southwest 1 /4 of Section 11; thence N 00 °27'35" W along the said East line 1019.35 feet; thence N 87 °49'37" W 1015.47 feet; thence S 02 °10'10" W 749.63 feet; thence N 87 °17'43" W 266.84 feet to the Northwest comer of the said Southeast % of the Southwest 1/4 of Section 11; thence S 00 °23'40" E 1320.50 feet to the Southwest comer of the said Southeast 'A4 of the Southwest 1/4; thence S 87 °11'26" E 802.85 feet to the point of beginning. Containing 45.85 acres more or less, and being subject to existing easements. Based on the following findings: 1. The request meets all county zoning ordinance requirements. 2. The provisions of § 91.77 have been met with this rezoning request. 3. The Town of Baldwin has recommended approval, and also found, among other things, that the request is consistent with § 91.77. 4. This proposal demonstrates that the applicant is preserving good farmland by only selling off the Tess desirable farmland and woodland and opting for Ag II zoning (20- acre lot area minimum). THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag II. Dated this 02 / day of hm »- .
