CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE T 4 9 AG-RESIDENTIAL ORDINANCE NO. 53 g' WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of Kowski Farms, Inc. on March 22, 2000 in the St. Croix Agricultural Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land located in part of the Fractional Northeast Quarter of the Northwest Quarter and part of the Southeast Quarter of the Northwest Quarter and part of the Southwest Quarter of the Northwest Quarter and part of the Northwest Quarter of the Southwest Quarter, all in Section 3, Township 31 North, Range 19 West, Town of Somerset, St. Croix County, Wisconsin described as follows: Beginning at the North Quarter Corner of said Section 3; thence, on an assumed bearing along the north /south Quarter line of said Section 3, South 02 degrees 55 minutes 31 seconds West a distance of 2433.43 feet to the northeast corner of the Plat of "MEADOWOODS ", as recorded in said County; thence, continuing along the north line of said Plat, North 88 degrees 50 minutes 16 seconds West a distance of 1326.12 feet to the northwest corner of said Plat; thence, along that part of the west line of said Plat, South 03 degrees 04 minutes 38 seconds West a distance of 661.57 feet; thence, along the north line of a Certified Survey Map recorded in Volume 12 page" 3390 in said County and the north line of a Certified Survey Map recorded in Volume 12 page 3475 in said County, North 88 degrees 58 minutes 53 seconds West a distance of 1327.99 feet to the west line of the Northwest Quarter of the Southwest Quarter of said Section 3; thence, along last said west line, North 03 degrees 13 minutes 41 seconds East a distance of 664.96 feet to the West Quarter Corner of said Section; thence, along the west line of the Southwest Quarter of the Northwest Quarter of said Section, North 03 degrees 14 minutes 09 seconds East a distance of 289.99 feet; thence South 88 degrees 50 minutes 16 seconds East a distance of 1857.47 feet; thence North 03 degrees 04 minutes 43 seconds East a distance of 995.15 feet; thence North 89 degrees 25 minutes 01 seconds West a distance of 532.36 feet; thence, along the west line of the Fractional Northeast Quarter of the Northwest Quarter of said Section 3, North 03 degrees 04 minutes 43 seconds East a distance of 1124.29 feet to the north line of the Fractional Northeast Quarter of the Northwest Quarter of said Section 3; thence, along last said north line, North 89 degrees 52 minutes 42 seconds East a distance of 1320.92 feet to the point of beginning. Containing 3,934,015 square feet (90.31 acres). Based on the following findings: 1) The proposal meets Town of Somerset Land Use Plan. 2) The proposal meets all requirements of the St. Croix County Zoning Ordinance. 3) The Town and County confirmed that the request is compliant with §91.77. 4) The Town of Somerset recommends approval of the request. 5) The majority of the parcel is rolling woodland, with poor soils — including class VI soils. 6) The applicant modified his rezoning request from 135 acres to 91 acres (at the Towns request) to preserve tillable farmland on the parcel. 7) Existing Ag /Residential abuts the property to the northwest, south and southeast; the applicant intends on developing this parcel and connecting two existing subdivisions with this rezoning request. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag.- Residential.
